43 TAC § 9.204. Discriminatory Actions Prohibited

(a) An individual or entity may not exclude any person from participating in, deny any person the benefits of, or otherwise discriminate against anyone in connection with the award and performance of a contract covered by this subchapter on the basis of race, color, religion, sex, age, disability, or national origin.

(b) An individual or entity may not use criteria or methods of administration, directly or through contractual or other arrangements, that have the effect of defeating or substantially impairing accomplishment of the objectives of the DBE program with respect to individuals of a particular race, color, religion, sex, age, disability, or national origin.
