Our client's landlord kept the full deposit. What does the Texas Property Code require, and does the cleaning clause in this lease help him?

Lease agreement.pdf

Donna

The landlord had to refund the deposit on or before the 30th day after your client surrendered the premises. The lease allows a cleaning charge only where the premises were left soiled beyond normal wear and tear, so routine cleaning is not a valid deduction. A landlord who keeps a deposit in bad faith is liable for $100, three times the amount wrongfully withheld, and the tenant's reasonable attorney's fees.

Texas Property Code§ 92.103

Sec. 92.103. OBLIGATION TO REFUND.

(a) Except as provided by Section 92.107,

the landlord shall refund a security deposit to the tenant on or before the 30th day after the date the tenant surrenders the premises.

(b) A requirement that a tenant give advance notice of surrender as a condition for refunding the security deposit is effective only if the requirement is underlined or is printed in conspicuous bold print in the lease.
