Section 001. Scope

These rules establish acceptable standards for design and construction, and guidelines for evaluating the safety of new or existing dams. The rules apply to all new construction including existing structures considered fo r enlargement, alteration, modification, or repair as specifically provided in the rules. The Director will evaluate any deviation from the standards hereinafter stated as they pertain to the safety of any given dam. The standards liste d herein are not intended to restrict the application of other sound engineering design principles that will provide for th e public safety. Under no circumstances shall these rules be construed to deprive or limit the Director of any exercise o f powers, duties and jurisdiction conferred by law, nor to limit or restrict the amount or character of data, o r information which may be required by the Director from any owner of a dam or for the proper administration of th e law.
