TO: ALL INSURANCE COMPANIES AUTHORIZED TO TRANSACT BUSINESS IN NEW MEXICO
RE: APPROVAL OF HEALTH INSURANCE FORMS
THE FOLLOWING BULLETIN is issued pursuant to Insurance Bulletin Rules, 13 NMAC 1.2.1 to 1.2.10.
The purpose of this Bulletin is to advise health insurers that all forms that will be distributed to a policyholder or prospective policyholder must be submitted to the New Mexico Office of Superintendent of Insurance, Life and Health Rate and Form Filing Bureau for review, unless specifically excluded by NMSA, in accordance with Section 59A-18-13.A, NMSA 1978
Pursuant to 59A-18-13.B, NMSA 1978; forms should be filed electronically through the system for Electronic Rate and Form Filing (SERFF).
59A-18-13. Approval or disapproval of health insurance forms (2011)
A. With policy, endorsement, rider and application forms and classification of risks filed by the insurer with the superintendent under Section 59A-18-12 NMSA 1978 as to health insurance and health care plans, the insurer shall also file with the superintendent its rates applicable to such health insurance forms. An insurer shall not use any form that has not been approved by the superintendent or that is not in effect in accordance with Section 59A-18-14 NMSA 1978.
B. All filings submitted pursuant to this section shall be filed electronically. The superintendent may designate an entity to receive the electronic filings submitted pursuant to this section.
