The opinion

MORGAN, J.,

concurs in the decree for defendants on the first cause of action but DISSENTS from the similar decree on the second cause of action for the reason that property and assets of the Railway Advertising Company were property and assets of the “transit system” within the meaning of Sec. 113-3 of the City Charter and therefore could not be disposed of without the consent of the City Council.
