Robert L. Brown, Justice, concurring. I concur with the result based on this court’s decision in Ward v. Consolidated Underwriters, 259 Ark. 696 , 535 S.W.2d 830 (1976). However, should the General Assembly not clarify Ark. Code Ann. § 23-89-403 (a)(1) (Supp. 2003), with respect to uninsured-motorist coverage and hit-and-run situations, I would not close the door to revisiting our Ward decision.
