The opinion

McCOMB, J.

I dissent. I would affirm the judgment in favor of defendants for the reasons expressed by Mr. Justice Salsman in the opinion prepared by him for the District *176 Court of Appeal in Quintal v. Laurel Grove Hospital (Cal.App.) 38 Cal.Rptr. 749 .

Schauer, J., * concurred.

Respondents’ petitions for a rehearing were denied January 13, 1965. Traynor, C. J., and McComb, J., were of the opinion that the petitions should be granted.

Retired Associate Justice of the Supreme Court sitting under assignment by the Chairman of the Judicial Council.
