The opinion

PRETTYMAN, Circuit Judge,

(dissenting) : Chief Judge STEPHENS, Judge PROCTOR and I adhere to the views expressed in my dissent to the original opinion and decision of the court. 1 We are of opinion that this court has no jurisdiction to review orders of the District Court upon original applications for authority to write these bonds or upon applications for renewals thereof, except where an abuse of discretion by that court is charged. We think the present ruling will have a disastrous effect upon the control which Congress intended to, and did, give the District Court and the Municipal Court over professional bondsmen who write bonds in criminal cases.

Judge 'CLARK and Judge WASHINGTON took no part in this rehearing.
