The opinion
WINDOM, Presiding Judge, dissenting.
I believe that the majority's decision conflicts with the Supreme Court of Alabama's opinion in Wagner v. State , 197 So.3d 517 , 519 (Ala. 2015). For that reason, I respectfully dissent.
