BOOKOUT, Judge,

concurring specially:

I do not concur in the holding that Brace-well, supra, applies in the instant case. I concur with the result reached by the majority on the ground that Act No. 14, Acts of Ala. 1978, approved August 7, 1978, amended Act No. 594, supra, before the jury was selected in the instant case. Act No. 14 delayed the mandatory date for refilling the master jury box to December 31, 1978.
