The opinion

HENDERSON, Judge

(Concurring.)—I agree to the result reached on the ground that under our statute and the evidence the court was only-required to charge on murder in the first degree, and there was no error in refusing to give the requested charge.

[Note.—Appellant’s motion for rehearing, filed May 24, 1899, was overruled without a written opinion.—Reporter.]
