The opinion

Second Motion for Rehearing.

HALL, X

Appellees have filed a second motion for rehearing, in which one of their attorneys, W H. Kimbrough, confesses that he is responsible for -the irrelevant and impertinent matter which we criticized in our opinion disposing óf the first motion. Our criticism is therefore limited accordingly. On account of the irrelevant and impertinent matter contained in this motion, it is ordered stricken from the files.

HENDRICKS, X, not sitting.
