If it appears that the fence is insufficient, the owner of the animals shall not be liable to make satisfaction for the damages. Code 1858, § 1685 (deriv. Acts 1807, ch. 8, § 2); Shan., § 2986; Code 1932, § 5208; T.C.A. (orig. ed.), §§ 44-1707, 44-9-107.
