A maximum occupancy limit may not be established or enforced by any local government, as defined in ORS 197.015 (Definitions for ORS chapters 195, 196, 197 and 197A) , for any residential dwelling unit, as defined in ORS 90.100 (Definitions) , if the restriction is based on the familial or nonfamilial relationships among any occupants. [2021 c.24 §1]

Note: 90.112 (Maximum occupancy limit) was enacted into law by the Legislative Assembly but was not added to or made a part of ORS chapter 90 or any series therein by legislative action. See Preface to Oregon Revised Statutes for further explanation.
