119.03 (A) Purpose, scope, and applicability. (1) The purpose of Chapter 3745-267 of the Administrative Code is to establish minimum standards which define the acceptable management of hazardous waste under a standardized permit pursuant to rules 3745-50-250 to 3745-50-320 of the Administrative Code. (2) Chapter 3745-267 of the Administrative Code applies to owners and operators of facilities that treat or store hazardous waste under a standardized permit pursuant to rules 3745-50-250 to 3745-50-320 of the Administrative Code, except as provided otherwise in rules 3745-51-01 to 3745-51-09 of the Administrative Code, or paragraphs (F) and (G) of rule 3745-54-01 of the Administrative Code. (B) Relationship of standardized permits to standards in Chapters 3745-65 to 3745-69 and 3745-256 of the Administrative Code. If the facility owner or operator has fully complied with the requirements for permit by rule under rule 3745-50-46 of the Administrative Code, the facility owner or operator shall comply with Chapters 3745-65 to 3745-69 and 3745-256 of the Administrative Code instead of Chapter 3745-267 of the Administrative Code until final disposition of the standardized permit application is made, except as provided under rules 3745-57-70 to 3745-57-75 of the Administrative Code. (C) Standardized permit's effect on imminent hazard action. Notwithstanding any other provisions of Chapter 3745-267 of the Administrative Code, enforcement actions may be brought pursuant to section 3734.20 of the Revised Code.
