43-26.1-05.1. Use of criminal history record checks

The board may require a physical therapy or physical therapy assistant applicant, or a

licensee under investigation, to submit to a statewide and nationwide criminal history record

check, including a fingerprint-based criminal history background check. The criminal history

record check must be conducted in the manner provided by section 12-60-24. The criminal

history record check is an exempt record but may not be disseminated by the board to the

physical therapy compact commission or a similar entity. All costs associated with a criminal

history record check performed under this section are the responsibility of the applicant or

licensee.
