Subpart 1. Responsibility. Persons who prepare sewage sludge are responsible for ensuring that the applicable requirements in this chapter are met when the sewage sludge is prepared, distributed, or applied to the land. Subp. 2. Direct enforceability. No person shall use or dispose of sewage sludge through any practice for which requirements are established in this chapter except in accordance with such requirements. Subp. 3. Additional or more stringent requirements. When necessary to protect the public health or the environment from a potentially adverse effect of a pollutant in sewage sludge, the commissioner may include in a permit or site approval additional or more stringent requirements than established in this chapter. Subp. 4. Variance. Any person may apply for a variance from requirements of this chapter in accordance with chapter 7000, Minnesota Statutes, section 116.07 , subdivision 5, and other applicable statutes and rules; however, the agency shall not grant a variance from any federal requirement.
