TO: Pharmacy Benefit Managers

RE: Licensure Required by H.B. 2100, effective July 1, 2014

Pursuant to the recently enacted H.B. 2100, Pharmacy Benefit Managers transacting business in

Oklahoma are required to apply for and obtain a license from the Oklahoma Insurance

Department. A copy of the referenced legislation is available by clicking of the following link.

Insurance Commissioner John Doak has filed an Emergency Licensure Rule for approval by the

Governor but has not yet received such approval. Because the time involved before the law

becomes effective is very short, we are providing interested parties with a draft of the Emergency

Rule and forms for license application and surety bond.

PBM Rules OPTins Instructions/Checklist

We encourage all persons who are required by H.B. 2100 to obtain a license as a Pharmacy

Benefits Manager to prepare and submit applications based on the draft documents. Should the

Emergency Rule, as approved by the Governor, differ materially from the draft attached to this

bulletin, the Department will take good faith attempt to comply into account regarding any

failure to timely obtain such license.
