-5The Chairman requested ~~. Barnes to look into the rehab house exchanges

that are pending and to find out the reason that they have not been approved.

Barnes promised to look into the matter when he returned to Aberdeen.

requiri.ng hi~h school attendance by all Indians on the reservation until the ag'3

of 19 or completion of the 12th grade for the reason that the juveniles who have

not finished school are becoming a problem on the reservation. No objections.

-7The Chairman announced that there would be a special meeting at the Pierre

Agency on November 18th with the Corps of Engineers, MRBI, BlA and others relative

to the Fort Randall an.d Big Bend Dams and requested that all councilmen attend.

The meeting would be at 10;00 a. m,

-8Motion by Andrew Estes, seconded by Thomas Two Hawk to appro'ie an exchange of

lands between Gail Langdeau Ziegler and the Tribe. The land to be conveyed to the

Tri!Je would be LB'-735, E~S1;'h; Sec. 26, 107-75 and she would receive in exchange

lands located in Sec.32, 107-73 located in the in~ediate proximity of the Ziegler

homesite, No objections. Vote: 5 for - none against.

K. Thomas, Asst. Director, Institute of Indian Studies, that in reply to his

request of October 10, 1958 the Tribal Council's choice of subjects for discussion

at the next conference on Indian Affairs to be held on June 12 & 13, 1959 are as

Andrew Estes and Garfield Grass Rope were selected by the council to attend

the Public Hen,lth conference to be held in Aberd3en on November 20 and 21, 1958

-14Julia Fire Cloud was admitted to the meeting and asked for assistance in

getting her house fixed up by x,ir. Hickey as she stated he did not comply with

the requirements for repairing the house after he had moved it. The Chairman informed her that the Council could not do anything for her since she had signed an

agreement stating that he had satisfactorily performed the services he had promised

but ~ir. Beitzel was called into the meeting and he promised to send Carl Smith to

inspect the house and that they would try to get IVlr. Hickey to make the necessary

repairs that he had promised to do,

Mrs. Arlene LaRoche complained about the distribution of commodities and

wanted to know why the council didn I t have an audit made. She was furnished vii th

a copy of the audit for examination that vlas made July 18, 1958 covering the

pe:.iod from July 1, 1957 through }~y 27, 1958.

~rrs. Dorothy Jandreau challenged the eligibility of Richard Thompson to be

a councilman because she was informed he was an enrolled member of another tribe.

She was informed that unkno,,".'l:1 to 1,J'. Thompson his mother had enrolled him in the

fJeoria Tribe of Oklahoma when he was a child and when he fOlmd out last year he

immediately relinquished his enrollment in the Peoria Tribe. An opinion from the

Area Solicitor determined that since Ricbard Thompson had relinquished his enrollment in the Peoria Tribe he was eligible to be an elected member of the Lower Brule

Tribal Council.

Various complaints and accusations against the tribal council were also

heard from hi's. Laura Ziegler.

-16A letter from f~arlowe Langdeau was read requesting permission to cut 100 posts

from the taking area. hotion by Richard Thompson, seconded by Clarence Thompson

to allow any Indian to cut timber from the taking area until January 1 at which

time the Tribe no longer has authority to grant this permission. This would allow

Indians to salvage timber from the Indian lands in the taking area but they have no

authority to cut from deeded lands in the taking area. No objections. Vote: 5

for - none against.

The minutes of meetings held November 5, 1958 'and November 18, 1958 were

Bids of Nartin Sather and Grimshaw Dril1-ing Co. for drilling artesian wells

on Indian units were read and discussed. Notion by Richard Thompson, seconded by

Andrew Estes to accept the bid of p~rtin Sather. No objections. Vote: 3 for and

Tom Two Hawk enetered the meeting at this time, 10:45.

~~. Howard Powell of the Powell Heating & Plumbing Co. and Mr. Frank Demo,

Construction Contractor, were admitted to the meeting and presented their bids

for remodeling the tribal hall. Motion by Andrew Estes, seconded by Thomas Two

Hawk to accept their bids so that they could start work when the Tribe receives

the Fort Randall settlement payment. No ob~ections. Vote: 4 for - 0 againt.

Motion by Richard Thompson, seconded by Andrew Estes to adopt a resolution

approving the program for expenditure of the intangible portion of the Fort Randall

settlement. Program adopted is outlined in the attached resolution. No ob~ections.

Vote: 4 for - 0 against. The amount of ~4l2,280.00 ~~ll be divided equally among

all members of the Tribe and paid out in accordance with the family plan program.

Each member will receive approximately ~ 500 which the Council felt was a substantial payment in view of the fact that the Fort Randall settlement did not provide

for any rehabilitation.

(foJen Goodface also requested the council to allow the tribal granary at the

old Enterprise ranch be used for a dance hall for Indian dances. The Chairman

informed Vlr. Goodface that. a lot of money had been spent on the tribal hall in order

t.o ha ve a good place to hold s uch th:il1gs as Indian dances and that i t is ava ilable

for that pUTpose and should be used by the people instead of having their 1n di an

dances in crowded homes. He also informed him that th e granary would not be a fit

place as it would be impossible to he at and t.here was g reat danger that i t mi g ht be

burned d own if it ,'[ere used for that purpose since it is not wired fo r electricity.

The request for the granary was turned down.

Mr. Beitzel entered the meeting and he announced that the tribal council was

invited to attend the me eting at Fort Thompson with the Corps of Engineers on

December 16. He also suggested that the council meet with ivIr. Bennett at the

Pierre Ag ency on Dec. 17t h relative to the family plan program and that the council

should app oint one person to sit on the committee for the family plan program.

The Chairman read a letter from lVir. 1'l. . Q. Sharpe informing the council that

he had been su cce ssful in having the salvage released from the court and that he

had fJ r",\,a rded a c he ck to Hr. Beitzel in the amount of '!(6300.00 sent him by the

court -which r epr es e nts the amount withheld for salvage. Hotion by Andre-w Estes,

seconded by Garfield Grass ROpe to authorize and request the Superintendent to disburse the salvage mon ey to the individuals entitled to i t in accordance with the

land with the rental tre refrom to be dep osited to tribal accounts the same as

though it came from tribal land. This action is in accordance with the prOVision

in Public Law 85-923 which gives exclusive permission, without cost, to the Lower

Brule Tribe and members thereof to graze stock on the land between the water level

of the reservoir and the exterior boundary of the taking area. No objections,

effect that individual leases of tribal lands and submarginal permits on submarginal lands should be leased to non-Indians at the same rates as apply to range

unit rentals that raise or lower on a sliding scale basis. Leases to Indians to

be at the rate of 40¢ per acre for grazing with no charge for hay cutting and

:jjil.OO per acre for farm land which is the same rates previously charged Indians.

The minutes of the regular meeting held on January 6, 1960 and the

minutes of the special meeting held on January 11, 1960 were read. Motion by

Clarence Thompson, seconded by Andrew Estes to approve the minutes as read.

Th8 Chairman reported on a discussion he had with the State Fish, Game

& Wild Life Service relative to stocking the reservation with wild life such

as eL~, wild turkey, antelope and the setting up of a goose reserve. Much

discu.ssion was given to problems that would arise from this such as, would

the wild game stay on the reservation, hiring full time game wardens

and the need for strict hunting regulations. The ~ouncil is now waiting for

word from the state Fish, Game & Wild Life Service for definite plans as to

stocking the reservation.

The Chairman announced to the Council that he has received word from

Mr. Sonosky, that the Interior Dept. & Corps of Engineers has estimated

the cost of moving Lower Brule to a new town site at near ~3 million. He

fl.18o stated that representation by .the Tribe may be needed in v/ashing\on

for t.he justification of this new town later on. Mr. Sonosky would keep

us advised.

Law & Order on the reservation was discussed and various questions were

r?ised. The leniency by the judicial department in disciplining the people,

the recent transfer of l-iir. Ferris and the lack of proper orientation of new

law & order personnel both by the Special Officer & Area Office people •. ' The

enforcement department cannot properly enforce law when the judicial department continually suspends sentences, this does not conform with Section 2,

of Chapter 4 of the Tribal Code • . Mr. Ferris was one of the best officers

to work in Lower Brule and was very efficient, effective, fair and respected

by our people. The council was of the opinion he was treated very unfairly

by certain employees in Pierre Agency in forcing his transfer and further

yet requesting his separation from the Service. It was decided that the

Council should make a deeper study of this, for possible use in the future

should the Law & 6rder controversy come to a head in the Central Office.

Motion by Richard Thompson seconded by Clarence Thompson to approve the

Mr. Erickson, from Aberdeen Area Office was present to discuss the

maintenance of reads on the reservation. Th9re was mu~h discussion as to t~e

routing of Highway 47 from Highw~ 16 to the Big Bend Dam. The Council informed ~. Erickson of roads which they know need repair. ~ Erickson informed the 60uncil that a road system is set up to meet the budget and at. ·

present the following roads are first on the list for repair, The road in

.:the L1 ftle Bend Area, the T~!O Hawks ' road' "in the Cedar Ci'eek area r the road

in the .Iron Nation which goes to Kennebec, and the road from Lower Brule to the

reservation ' line . which goes South. Richard Thompson inquired. as to v;he"ther

the road in the Ft. Hale Area could be repaired. Mr. Erickson stated that

this road was not on the Bureau road system and inquired as to how m3J1Y

families are involved. He also stated that roads are mair.tained accordir.g

to how many families are involved. ~ Erickson was informed that the~e ~e

about six Indian families and approximately )0 Indian people in the Ft. Hale

District, ~"'1d as to the condition of these roa~d.s. Motion by Clarence Thorepson

seconded by Richard Thompson to adopt a resolution requesting that the Ft.

Hale road be included on the BIA Road System for repair and maintenance by the

Bureau Road Department. No objections. Vote: 5 for-none against.

waterfowl only. The fee for a hunting permit will be $5.00 and permits will

be issued at Tribal office only. Hunting will be allowed only on allotted

and standard and exChange assignments lands and then permission must be given

by the owners of the land. No objections. Vote: 5 for-none against.

Mr. Collins was in to discuss what arrangements could be made with the

Tribal Council concerning the use of the tribal hall o Motion by ClcoIence

Thompson, seconded by Richard Thompson that an agreement be written up to

be signed by the Superintendent and the Chairman concernir.g use of the tribal

hall by the school for their school activities for this school year. No

objections. Vote: 5 for-none against.

Miller complimenting the Tribal eouncil on their action taken for the protec tion and control of tribal property and '6'q~ipment und.er Ordinance No. LB-61-A

adopted on September 7, 1960.

The Chairman informed the Council of the reply they received from th~

Area Office relative to the Councils request for clarification of Article II

Section 1 (b) of the Constitution ru1d Bylaws of the Lower Brule Sioux Tribe

which pertains to the eligibility of enrollment which states as fo~lows:

All children born to any member of the Lower Brule SiotL"'(

Tribe who is a resident of the reservation at the time of

the birth of said children but children born to any member

after the effective date of this amended Constitution and

possessing at least one-fourth degree Lower Br~iLe Indian

blood shall be members regardless of the residence of their

parents at the time of their birth.1I

The reply received from the Area Office and the Central Office stated that all

children born to resident members of the Tribe are eligible for enrollment

regardless of degree of Lower Brule blood and children born to members of the

Tribe residing off the reservation must be one-fourth or more Lower Brule

Indian blood to be eligible for enrollment.

The Chairman reported that under authority from the Tribal Council he

has leased the Enterprise Ranch to Vera Gandt. Mrs. Gandt requested a t~r~~

year lease on the ranch, she also stated that she would repair the builolW~

as needed, and has paid a year' 5 rent in advance. Notion by Richard Thompson

seconded by Thomas Eagle Thunder to adopt a resolution gi'nng V~~Se Gandt the

The Chairman announced that since the Council was having a meeting they

should take care of ~ business that has come up instead of leaving it for the

next regular meeting.

The Chairman read a letter to the Council that was received that morning.

The letter was ~om the Fish and Wildlife Service in which they offered a new

proposal to the Tribe relative to taking of lands in the Little Bend Area and

Ft. George Area for wildlife-management purposes. The Fish and Wildljfe Service

would like to have full control of these lands through acquisition in order

to establish a complete and manageable project. They further stated that. :. ~ :.., o T

do not have the intention to acquire a single acre of tribal land unless C"l.,:;

Tribe voluntarily agrees to this sale. This new proposal offered by the Wildlife service states that "in lieu" lands will be acquired for the Lower Brule

Tribe, if the Tribe 50 desired, to replace on an equal value basis the lands

which are obtained for wildlife purposes. It is the desire of the Fish and

Wildlife Service that the Tribe notify them as to whether the Tribe will

reconsider this proposal. The Chairman announced that a copy of this letter

has been sent to our Attorney. M.J. Sonosky, along with a few questions

pertaining to this proposal. If-arrangements can be agreed upon bet~~3~ the

on January 15, 1960. The biggest question confronting the Tribe is w~e:e :Ild

There was a discussion by the Council on maintenance of the road in the

Little Bend Area. If the Wildlife Service does acquire this land in the Little

Bend Area there would be no nee~ for the Bureau to make extensive repair to

this road. · Hotion by · Clarence l'hompson, seconded by Andrew Estes to request

that the Bureau use the funds, which would be used to make extensive repairs

to the road in the Little Bend Area, on the roads in Ft. Hale instead. After

the tribe negotiates with the ~iildlife Service it will be known for sure

whether the vJildlife Service will acquire the lands in he Little Bend Area.

Cl~rence Thompson reported on a meeting he attended earlier in the day

at Pier~e. The Corps of Engineers, MRBI personnel, Bureau personnel from

Aberdeen were pr~sent at the meeting. A few statements made at this meeting

were, the exact taking line from the Big Bend Dam, would not be known until

1962, there are approximately 60 families on the Lower Brule reservation who

will be affected by the Big Bend Dam, and approximately 600 individuals have

interests in lands that will be in the taking of the Big Bend Dam. Half of

the land in the taking is tribal and the remaining half belongs to individuals.

A. meeting will be held on Octebcr 21, 1960 with the Corps of Engineers for

the public at Pierre. The purpose of this meeting will be on the subject of

the Big Bend Dam and Oahe Dam. There was some discussion as to c . . rtairi "

Members of the MRBI, Corps of Engineers, Bureau of Indian Affairs and

Interior and Insular A~~rs Committees who were present at the meeting in

Pierre came down to look over this part of the reservation. vfuile they were

down they were invited to the Council meeting. There was a discussion on the

proposal by the Hildlife Service, relative to the acquistion of lands in the

Little Bend Area, discussion on the relocation of the school facilities, townsite water situation, and roads. The Chairman expressed the Tribes' views on

these subjects. The Chairman stated that the Tribe vlOuld like to have the

intangibles broken down on an induvidual basis if possible. No definite

statementsweremade by the }ffiBI, Corps of Engineers or members of the Interior

and Insular Affairs Committee on the subjects discussed.
