v. Buffalo Air Handling et al., Civil Action No. 95-0053-L, was lodged

on September 29, 1995 with the United States District Court for the

Western District of Virginia. The proposed consent decree resolves

claims under Section 107 of CERCLA, 42 Sec. 9607, against certain de

minimis waste contributors for reimbursement of response costs incurred

and to be incurred by the United States at the

proposed consent decree requires the de minimis defendants to pay the

United States $471,042, which equals 100% of their share of past

response costs at the Site, plus a 160% premium on these future costs.
