STATEMENT OF THE CASE
I began work with WorldCom/MCI as a contractor in
October of 1999 and was converted to a permanent em-
ployee on April 10, 2000. I attended work regularly
through January 21, 2005. During this time, the original
company went bankrupt and re-emerged as MCI, then
was later sold to Verizon. During my entire time at this
2
company, I was forced to use stolen property against my
will, which according to Title 17, section 504 and Title 18,
section 2319 of the US Code is a felony if I was not able to
prove it was under duress, punishable by significant fines
and imprisonment. At any time during my employment,
authorities could have asked me to provide proof of owner-
ship of the software on my computer under threat of this
imprisonment. This illegal software was discussed at
length between co-workers many times throughout my
employment, and it was my understanding that if you
wanted to keep your job, you commit the felonies and keep
your trap shut. I committed these felonies under duress
for all of this time, always afraid, up until August of 2003,
to bring up the issue at risk of losing my job. This time
frame is consistent with the time frame that the Sarbanes-
Oxley Act updated Title 18 of the US Code in section 1513
and 1514 to make it safer for employees to object to the
use of stolen property without fear of retaliation by their
employer.
During the process of coming out of bankruptcy in and
around the summer of 2003, employees were subjected to a
wide range of exposure to alleged claims of having become
an ethical company. Prior evidence submitted at lower
courts discuss this in detail. Starting in the summer of
2003, I became brave enough to start objecting to this
forced commission of felonies. Earlier emails and my
testimony prove beyond reasonable doubt that I had at the
time and continue to this day to have every reason to
believe that much of the software in use was stolen prop-
erty. Some items in question were directly informed to me
as being illegal by the software company itself. The defen-
dant has time and again refused to provide proof of owner-
ship of items in question. If they did have proof, it would
3
only take a few seconds to pull it out of an email or filing
cabinet. Most of the items in question were locally con-
trolled at the department level and therefore, any proof of
ownership would be locally available if it existed. I
brought this issue to the attention of the company many
times, and they have repeatedly refused to provide proof of
ownership.
I have found myself in a position of having to write
this brief pro se. While I am convinced that the facts and
the law are absolutely in my favor, my untrained hand has
led me to a position of having to present my case to the
Supreme Court without ever having had an opportunity to
get a subpoena signed asking the company to provide proof
of ownership of items in question. As a pro se claimant, I
have limited experience and know how to fully grasp why
this case was thrown out at the lower courts. It is against
my religion to commit felonies, and it is my age that made
it more likely that I would have strong religious beliefs
against using stolen property. It was the Sarbanes-Oxley
Act that made me brave enough to object to the use of
stolen property because I thought it would protect me from
retaliation.
The issue at hand is whether or not a person of faith
over the age of forty is more likely to object to the forced
commission of felonies and therefore be subject to retalia-
tion for objecting to the illegal use of stolen property at a
higher rate than a person not of faith under the age of
forty. Considerable evidence was presented at earlier
courts. The reversible error that I am presenting in this
case is that not all of the evidence is being considered. |
presented evidence that a Higher Power is testifying on my
behalf; however, I was never given an opportunity for oral
argument to tie it into this case. I point out immediately
4
that I am absolutely not a religious fanatic and am com-
pletely of sound mind. I am simply analyzing data and
drawing a logical conclusion as is done in any secular case.
I am requesting that the United States Supreme Court
give me an opportunity to present all evidence in a lower
court, even though many will question if a Higher Power
would be willing or able to intervene on my behalf in this
case for the purpose of curing a nation in moral decline.

A
ARGUMENT
A. The Proceeding Involves a Question of Excep-
tional Importance, in that the Result, If Undis-
turbed, Will Lead to Significant and Unnecessary
Restraint from the Original Intent of our Found-
ing Fathers.
The argument can best be summarized in one ques-
tion by restating the QUESTION PRESENTED FOR
REVIEW (i.). Why did our Founding Fathers bother
praying to a Higher Power if they did not believe that this
Higher Power was willing and able to intervene on their
behalf? Or stated another way: Would the Higher Power
that our Founding Fathers prayed to and referred to in so
many documents be willing and able to create a series of
miracles over time with the express purpose of proving His
existence with intent of ~ddressing the moral decline of
this nation? Or stated specifically for this case: Do I have
the constitutional right to worship a God who instructs
me to not commit felonies and can | object to the commis-
sion of these felonies on religious grounds? As an un-
trained hand writing this appeal pro se, I beg the court’s
indulgence in understanding that I do not know the proper
legal means of getting across this message. I am actively
5
praying to this Higher Power for guidance in writing this
appeal. All errors are my own. I also point out to the court
that while my faith is Southern Baptist, the Southern
Baptists are in no way aware of or support my use of Bible
code. These findings are my own and are in no way sup-
ported, condoned, or refuted by my established faith
system. I contend to the court that these Bible codes were
given to me by a Higher Power to prove His existence. I
also point out that, with all due respect to those who read
this appeal, it requires an extremely high degree of spiri-
tual intellect to fully appreciate the mathematical prob-
ability that what I state in this appeal could statistically
never occur by random chance. I accept the fact that those
not strong in the spirit will mock and scorn me for writing
this appeal. I point out to the court that I myself do not
understand much of what God is revealing to me in writ-
ing this appeal. I reference Ezekiel 33:6 App. 22, para-
gravh 2, starting at line 11 as my reason for submitting
this appeal to the court.
App. 1 through App. 12 are the writings from the
earlier courts. No mention is ever given of the Bible code
or weather events presented other than the original order
was so ordered on the 13th day of the 10th month, on App.
10, line 9. The reason that I had given for including the
original Bible code on App. 16 was a request to the court
that the related workers compensation claim be heard on
this day by a state Industrial Commission court, App. 15,
paragraph 1, starting at line 12. This exact date, I con-
tend, ties the Bible code to this case. The reversible error
is that no other mention is ever made of the Bible code.
The prophesy was further fulfilled on the 31st of the 10th
month with Rosa Parks’ Bible code being tied to President
Bush on App. 35, starting at paragraph 5 and on App. 36,
6
paragraph 1. The method to find App. 35 was put on my
heart after the Rosa Parks’ code was fulfilled on the 31st
day of the 10th month. Highlighted on App. 35 is “what
hath thee base the consent sent by this ride, wrote salt,
write on salt.” I submit to the court that this was God’s
testimony te me to submit the appeal which was almost
past the statue of limitations at that point. “bush rosa sat
seat” is shown in App. 36 paragraph 1 as alternate letters
enclosed in parenthesis. I contend to the court that this
kind of Bible code simply does not occur by random
chance. The switch in number from 13 to 31 is shown
below in switching the first two letters of leon to elon, in
App. 16, paragraph 3. I ask the courts understanding that,
while the details can seem complex, this can be clearly
shown and explained in a full lower court hearing where
ample time is provided to explain each item at greater
length. I ask the court to understand that I am attempting
to explain what could be considered quite complex Bible
code in a very small amount of space. This Bible code is
not for the faint of heart.
I submit to the court that much of this testimony
came after the initial order and therefore should be con-
sidered because it did not exist prior to the close of the
initial case in the Federal District Court. I intend to show
the court that this new evidence ties directly to this case
and is therefore admissible evidence. I am writing this
case pro se with no legal training; however, one would
venture to reason that there is most likely limited verifi-
able prior case law on a non-secular testimony case. The
last paragraph of App. 13 is the location within my appeal
to the Fourth District Appeals Court that ties these
elements together and is supported by the remainder of
the appendices. It is first stated that these occurrences
7
could not have occurred by random chance. Any one, two,
or even three of the supporting testimony presented here
could have occurred by pure coincidence by the sheer
number of possible outcomes that could be deemed rele-
vant. What makes this case unexplainable by any other
means than from intervention o’ a Higher Power is that
the large number of highly improbable events all being
- linked and all relevant to this case. Every piece of Bible
code and weather event testimony presented here is
verifiable. Much of it, specifically the Bible code and
weather events, are completely out of the hands of any
person now or in the past. The 7 at the beginning of Rosa
Parks’ number, App. 13, paragraph 2, starting at line 5,
and App. 35, picture at top, is the sign of divinity which,
once all the evidence is tied together, shows that it is
testimony from a Higher Power.
It will be shown that the category 5 hurricanes came
in a set of 3 and peaked 53 days apart, as is consistent
with Rosa Parks’ number 7053. This limited length appeal
does not afford the luxury of describing in detail the
importance of these numbers. The limited space I have
here talks about several different numbers. The key to
understanding the significance of this testimony is the 53
scattered throughout. All other numbers in this testimony
refer back to this 53, and by Bible code and weather events
that could only have come from a Higher Power, and
absolutely could not have occurred by random chance. I
respectfully request the court to provide me oral argument
in lower court to better explain these findings than can be
done in a few pages of this brief.
This second paragraph, App. 13, paragraph 2, starting
at line 10, also points out that there are 53 chapter four
verse sixes in the Holy Bible as shown on App. 36, starting at
8
paragraph 3 through the bottom of App. 41. This chapter
and verse were in the court records prior to Rosa Parks’
interaction with President Bush and prior to the hurri-
canes. Witnesses can testify to my Sunday School lesson,
noted in App. 26, starting on line 30, about there being 39
chapter seven verse fours in the Holy Bible. This Sunday
School lesson was taught a few days before the honorable
Chief Justice was announced by the President. It was
stated on the news media that the now Honorable Chief
Justice John Roberts presented before the Supreme Court
39 times. I should point out that the first word in the Bible
code for Roberts is “robe.” The significance of the seven
and four were discussed in that Sunday School lesson and
will be described briefly in this argument. There was a 5.3
earthquake, App. 14, starting at line 4, and App. 25
starting at line 15, on the date noted on my email from
Senator Feinstein. I argue that it is unlikely that an out-
of-state person receive an email from Senator Feinstein at
all, and the chances of an earthquake occurring that
morning is extremely improbable. The chances of that
earthquake being of exactly 5.3 magnitude is astronomi-
cal. The fact that seven earthquakes occurred off the coast
of northern California over a four-day span, App. 25,
starting at line 9, along with these other conditions, make
this unquestionably an act of God. Note that the 5.3
earthquake, App. 25, starting at line 15 occurred at 53
minutes after the hour. The seven and four tie this to the
earlier events. MCI is first found in the Holy Bible at
character 50003, thus tying the significance of the 53 to-
MCI. MCIINC is the Bible Code which proves that a
Higher Power is testifying on my behalf of what happened
to me at MCI Incorporated. This data requires quite
intense spiritual intellect to fully grasp. The remainder of
9
this argument is devoted to explaining in some detail how
all this code and events are displayed and explained.
On Sunday, January 23, 2005, my children were
taken out of my home for their own protection from expo-
sure to my completely irrational and uncontrollable
behavior. The following day, my doctor ordered me not to
return to an environment where I would be subjected to
management approved forced commission of felonies, and
resulting hostile environment. My doctor diagnosed my
condition as situational anxiety. I kept my doctor informed
periodically until I lost my health coverage in October of
2005 that my company continued to refuse to address the
management approved forced commission of felonies
situation and my doctor continued to periodically write
down his recognition of my situational anxiety condition
from the resulting hostile work conditions.
During this week of January 23, 2005, with our
children out of our home, my wife and I broke down in
tears asking God what he wanted from us. He gave me the
vision that week that I later recorded and provided as a
Sunday School lesson. The prayer begins on the second
paragraph of App. 18 and ends at the end of App. 21. This
prayer with additions was given to the defendant as
discovery in my workers’ compensation case prior to many
of the events discussed in this appeal. I submit to the court
that this is an affect/cause as opposed to cause/effect thus
proving that this was a vision from a Higher Power to
record events going forward in exchange for this Higher
Power returning our children. I submit to the court to
consider the last paragraph of App. 21 as proof that this
Higher Power had a greater purpose than for the recom-
bining of just my family alone.
10
Within twenty-four hours of this vision, this Higher
Power that had given me this vision also revealed to me
how to extract His testimony on my behalf out of the Holy
Bible. I can only testify on my behalf that at no prior time
before receiving this vision did I ever do any work or write
any code of any kind relating to Bible code. I, in fact, had
been a staunch doubter of Bible code, and even a staunch
doubter of some of the interpretations of scripture of my
established belief system teachings. I testify here that,
with the direct intervention of God himself, I was able to
write a program from start to finish and derive Bible code
on iny first try that revealed direct testimony from God on
my behalf, and I further state that I now realize this
Higher Power’s complete purpose is in healing a nation in
moral decline. This Bible code is stated on lines five and
six of App. 16. in full and App. 17, starting at line 6.
“mciinc: elon (leon) that hate tenth rid hot sore reed shut
ate.” It was “Leon” King at “MCIINC” who got “rid” of
many earlier people from my department. I contend to the
court that it is God’s testimony that I was the “tenth”
person that Leon King had hatred for and got rid of, many
within MCI itself. I admit freely to the court that I was
“hot and sore” about this running me off because of my
objections to the use of stolen property. While there may
have been many reasons for his “hate” for the others, I
contend to this court that my objections to the use of
pirated software were what initiated and perpetuated the
increasingly hostile environment as to why he was after
me. I contend to the court that Leon King had a consider-
able amount of influence on the project manager Pamela
Hogg and was therefore directly responsible for ridding me
from the department, per God’s testimony from this Bible
code. I also contend that it is God’s testimony that 8 (“ate”)
of the 10 were “shut” up. God and myself are the only
11
remaining to bring this issue into play. Note that the el is
switched on the first word because leon in not found in the
Bible. This switching became more obvious when the 13
and 31 were switched from the dates noted on the original
order of the 13th of October and Rosa Parks’ in Washing-
ton D.C. on the 31st of October.
App. 17 further shows the company names involved
during this interval. Worldcom changed its name to MCI
Inc. During this time period, both Qwest and Verizon were
considering buying the company. Bible code for each name
shows a series of mathematically impossible items to have
occurred by random chance. Mciinc is at an interval of 13
while Worldcom is at an interval of 13019, the 19 being
the number of terrorists on September eleventh. The 13 is
the beginning verse in my sermon in front of Terri
- Schiavo’s hospice Good Friday showing God’s prediction
that she would die on day 13. A portion of the sermon
noting the 13 was recorded for posterity by the news
media at the event. Qwest is at an interval of 77 and
Worldcom is at in interval of 40077. The 77 is the day of
the 4 bombs on the 7th day of the 7th month in London,
England. Note that these bombings occurred after this
Bible code was generated. Senator Feinstein, who sent me
the letter dated the day of the 5.3 earthquake noted below
has an interval of 4554 noted not only my state house
precinct number of 45 (Asbury) an? district of 54, but is
also the last two digits of the startin, © aracter for mciinc
shown on line 6 of App. 17. On this same line, 8:43, noted
at the top of App. 16 is_releyant Bible verse John 8:43:
“Why do ye not understand my speech? even because ye
cannot hear my word.” Note on App. 17, line three, the 454
is the number of milliseconds it takes to run that particu-
lar Bible code. I submit to the court ‘%ct I did not know
12
until months later that this is the number of pages in the
Da Vinci code book. I should also point out that within the
past couple of days, Senator Feinstein’s rating on www.
Congress.org is 54.54, yet another confirmation from a
Higher Power. I submit to the court that it is no accident
that the high 53 occurrence and high 54 occurrence being
1 number apart, the number of unity that needs to be
added to address the moral decline of our society. I also
submit to the court that it may be centuries before these
discoveries I am pointing out are fully appreciated and
understood. My statement here that gravity will be deter-
mined to be a repulsive force will make doubters wonder
in years to come how I knew that in advance if not through
Bible code.
The means of deriving Bible code from a given word is
very simple. All the alphabetical letters of the Original
King James English version of the Holy Bible, as I was led
to several years ago by downloading from the internet, are
put in an array of characters. All spaces, headings, verse
numbers, and punctuation are removed. This array of
letters is searched from beginning to end first looking
every 2nd character, then every 3rd character, then every
4th character and so forth until the word in found. This
skip sequence is continued from that point for 7 times 70
total characters at that skip level. This set of 490 charac-
ters is then searched for words that are found in the Holy
Bible. This is the resulting words. The numbers associated
with this set of words is the character number that the
sequence starts, the skip level, and the number of words
found. Thus, an exact set of numbers and an exact set of
words is derived for any word that is entered into the
program. All Bible code noted in this appeal uses exactly
that same program and methodology to derive the resulting
13
numbers and words. For proof, a zipped version of this
program along with the exact version of the Holy Bible
used is available online at http://bible.alvinreed.com/word.
zip. I respectfully request the Supreme Court to provide
me the opportunity to prove these facts in a lower court.
The morning of my Sunday School lesson July 3rd,
2005, it was put on my heart to talk about the distinctions
of 7 and 4. My initial thoughts were that this was to
signify that the following day was the Fourth of July, the
7th month and the 4th day. It was not until after I com-
pleted my Sunday School lesson that I fully realized the
significance of my discussion that day. In summary, my
Sunday School lesson was three significant weather events
had occurred with regard to 7 and 4. I pointed out to my
Sunday School that I determined just that morning that
the 4 hurricanes in Florida the summer before had oc-
curred over 7 weeks from the time Charlie hit land until
Jeanne was completely off the map, as I found on the
internet that morning, App. 25, starting from the 5th line
from the bottom, thus the significance of 7 and 4. The 7th
largest earthquake occurred the day after Easter, App. 26,
line 16, and App. 24, line 24, and the 4th largest earth-
quake had occurred the day after Christmas, App. 25, last
line, and App. 24, line 18, thus once again the significance
of 7 and 4. I should point out that the 4th largest earth-
quake is reported as some locations as the 5th largest and
at other locations at the 3rd largest, again tying these
values to the overriding number 53. There were 7 recent
earthquakes off the coast of northern California that
occurred over a four-day span, once again showing the
significance of the 7 and 4. I point out to the court that it
was not until after Rosa Parks’ passing many months later
that I realized that a 5.3 earthquake occurred the date
14
stated on my email from Senator Feinstein, App. 23. I also
point out to the court that it was not until after I received
the order from the appeals court that I realized that it was
exactly 153 days from the 7th largest earthquake until the
peak of the first category five hurricane. The 153 is signifi-
cant because of the 153 fish caught by the disciples. The
missing unity of 1 is the significance of the 53. Also 100,
the difference between the 153 and the 53 is 10 squared
which is Biblical for the 10 commandments, one of those
commandments noted in earlier testimony.
The morning of this Sunday School lesson, I felt led to
print out all chapter 7 verse 4s in the Holy Bible and
distributed that list to my Sunday School. I noted specifi-
cally that there were exactly 39 of such verses, having no
idea why this Higher Power led me to make that distinc-
tion. It was a few days later, when the Honorable Chief
Justice was first announced to the world by President
Bush and the number of times of 39 argued to the high
court was a significant number to everyone in the media. I
contend to this court that I had no advance knowledge of
that occurrence. It was not until after Rosa Parks’ death
that I realized that there were 53 chapter four verse
sixes in the Holy Bible. I contend that the Higher Power
led me to have witnesses for my Sunday School lesson
indicating the number of chapter 7 verse 4s in the Holy
Bible in preparation for this eventual disclosure, the first
of which talks about God controlling the weather in
Genesis 7:4. It was the day that Harriet Myers was ap-
pointed to high court that I had just purchased a Palm
Pilot Zire. Upon learning this, I felt led to look up the
Bible code for “Harriet Myers Zire.” The words associated
with Zire, “roe yes” led me to conclude that Harriet Myers
was still a believer in Roe vs. Wade. I sent several emails
15
to this affect to the White House that can be used to testify
to this fact. This revelation is consistent with what even-
tually led to her retraction and the appointment of a
replacement justice on the Supreme Court, notably the
Honorable Justice Samuel Alito. I contend to the court
that this entire set of events was playing out Bible code,
most of which the exact location has not yet been revealed
to me.
On August 22nd, 2005, I submitted to the defendant
the letter starting the second paragraph on App. 27
through the end of App. 29. This was put on my heart by
what I interpreted to be a Higher Power. The next day,
August 23rd, 2005, was the start of the confirmation from
this Higher Power that He approved of my letter and
agreed with its findings. App. 30, first picture, shows that
the first of three category five hurricanes started at 5 P.M.
the day after I submitted this letter to the defendant. The
illustration for hurricane Katrina on App. 31 shows 6:51
as the time of the first snapshot of Katrina becoming a
category 5 hurricane. App. 34, first paragraph after the
calendar, shows the Bible verse relating to weather that
this time stamp signifies. App. 32 shows 3:53 as the time
of the snapshot for Rita as a category 5 hurricane. App. 34,
second paragraph after the calendar, shows the Bible
verse tying Rosa Parks to this event. App. 33 shows 6:38
as the time of the final snapshot of Wilma as a category 5
hurricane. App. 34, third paragraph after the calendar,
shows the Bible verse tying the Da Vinci code Bible code to
this event. Wilma showed a distinct 2 just before hitting
land. 5 to the power of 2 is 25. 3 to the power of 2 is 9.
Jesus is found every 25th character creating 9 words by
the technique used consistently since January 2005. The
word Jesus in Bible code creates in part “eber (Ebbers)
16
wife end art,” signifying that this case initiated with
Bernie Ebbers’ actions would end the art (movie) of Da
Vinci code claiming Jesus had a wife. I submit to this court
that no one including myself could have had advanced
knowledge of the weather events that would trigger the
fulfillment of this Bible code debunking the Da Vinci code
and disproving it merely by its prediction. The calendar on
App. 34 clearly shows the 53-day interval between the
peaks of the category 5 hurricanes occurring 3 times in one
season.
The coal mine accidents near the end of 2005 and
beginning of 2006 revealed to me through a local newspa-
per article that 53 men lost their lives many years ago in
what is now my voting precinct, noted above as precinct
45. It was the largest mining accident in North Carolina
history. The stone marker noting these 53 lost lives is
prominent today within my voting precinct. I vote in
Asbury community building. The Bible code for asbury
includes the phrase: “down i oak heat hole been held.” I
submit to this court that even if I had known about this
prior to these weather events, which I did not, any reason-
able person would still conclude that this propensity of
events of 53 could not have occurred by random chance.
The probability of finding such exacting Bible code for this
event is astronomical. That it involved 53 lives is even
more mathematically unlikely. I submit to the court that
the fact it occurred in my voting precinct is virtually nil to
be considered a random event. This, once again, is a
Higher Power directly pointing to the fact that MCI is
found starting at character 50003.
I submit to the court that no reasonable person would
conclude that these hurricanes, along with all the other
weather and Bible code events could have occurred by any
17
other means than an Intelligent Designer, thus proving
the existence of God and the courts necessity to conform to
original intent by accepting that an Intelligent Designer
was involved in the creation of the events noted here.
Review of the earlier Court decision through a writ of
certiorari will yield a result for righteous employees of
faith over the age of forty that conforms to the original
intent of our Founding Fathers and restores harmony and
preserves fundamental notions of a righteous government.

Appellee.
Unpublished opinions are not binding precedent in this
circuit. See Local Rule 36(c).
PER CURIAM:
Alvin R. Reed appeals the district court’s order grant-
ing MCI’s motion to dismiss his claim of disparate impact
based on age, pursuant to the Age Discrimination in
Employment Act, 29 U.S.C. §§ 621-634 (2000) (ADEA). We
have reviewed the record and find no reversible error.
Accordingly, we affirm for the reasons stated by the
district court. See Reed v. MCI Worldcom Network Servs.,
Inc., No. CA-05-517-5 (E.D.N.C. Oct. 17, 2005). We dis-
pense with oral argument because the facts and legal
contentions are adequately presented in the materials
before the court and argument would not aid the deci-
sional process.

Plaintiff, |
v. ) ORDER
MCI, INC.,
Defendant. )
Alvin R. Reed (age 48) filed a pro se complaint alleg-
ing that MCI Network Services, Inc. (“MCI”) demoted him
“for refusing to commit felonies” associated with using
“pirated software.” Specifically, as part of his complaint
and his EEOC charge, Reed contends that he “was dis-
criminated against for refusing to commit felonies because
{his} generation wants to obey the law and the younger
generation is too unethical to understand the concept,”
and that he was “discriminated against because of [his]
age in violation of the ADEA.” Pursuant to Federal Rule of
Civil Procedure 12(b)(6), MCI has moved to dismiss the
complaint for failure to state a claim. In response, Reed
clarified that his claim was based on a disparate impact
theory under the Age Discrimination in Employment Act
(“ADEA”). For the reasons stated below, MCI’s motion to
dismiss is granted.
STANDARD OF REVIEW
In analyzing a motion to dismiss a complaint under
Rule 12(b)(6) for “failure to state a claim upon which relief
can be granted,” a court must determine whether the
App. 4
complaint is sufficient “under the facts alleged and undar
any facts that could be proved in support of the com-
plaint.” E. Shore Mkts., Inc. v. J.D. Assocs. Ltd. P’ship, 213
F.3d_175, 180 (4th Cir. 2000). A court “assume[s] the truth
of all facts alleged in the complaint and the existence of
any fact that can be proved, consistent with the com-
plaint’s allegations.” Jd. A court need “not accept the legal
conclusions drawn from the facts.” Id. “Similarly, [a court]
need not accept as true unwarranted inferences, unrea-
sonable conclusions, or arguments.” Jd.
Reed filed a pro se complaint, which entitles him to
some leeway. See Cox v. City of Charleston, 416 F.3d 281,
288 (4th Cir. 2005). Nonetheless, “[w]hile pro se com-
plaints may represent the work of an untutored hand
requiring special judicial solicitude, a district court is not
_required to recognize obscure or extravagant claims
defying the most concerted efforts to unravel them.” Weller
vu. Dep’t of Soc. Servs., 901 F.2d 387, 391 (4th Cir. 1990)
(affirming dismissal of sex discrimination disparate
treatment claim) (internal quotations omitted); Edwards v.
Johnston County Health Dep’t, 885 F.2d 1215, 1221-24 (4th
Cir. 1989) (affirming dismissal of race discrimination
disparate impact claim). Further, reviewing a pro se
complaint “does not transform the court into an advocate.
Only those questions which are squarely presented to a
court may properly be addressed.” Id.
DISCUSSION
Reed alleged that MCI discriminated against him
because of his age in violation of the ADEA. 29 U.S.C.
§§ 621-634 (2000). Reed’s complaint identifies the acts
complained of as his failure to be promoted, his demotion
App. 5
for refusing to commit felonies, and his receipt of a hostile
phone call to his house after asking the CEO for help in
connection with using pirated software. Compl. J 4. Reed
alleges that MCI committed age discrimination “because of
disparity in man’s law and God’s law over past generation
making pirated code rampant in corporate America.”
Compl. 7 6. Reed identifies the nature of his complaint as
follows:
i
[MCI] [florced me to use pirated software against
my will, tricked me into thinking that MCI is an
ethical company, and initiated a hostile phone
call to my home as a direct result of my wife's
plea for help from the office of the CEO of MCI
on this ethical issue, as noted in the attached
documents.
Compl. { 9.
Reed attached his EEOC charge to the complaint. In
that charge Reed alleges that on January 21, 2005, he was
“demoted from [his] position as a Senior Staff Programmer
... because fhe] refused to commit felonies by using
questionable software.” EEOC Charge (I. Reed also
alleges that on January 21, 2005, he was “reprimanded by
{his} Project Manager, Pamela Hugg, because of [his] job
performance,” and that after complaining to the Ethics
Committee, he “received a hostile telephone call from some
of its members because [his] wife had contacted Michael
Cappellas, CEO concerning [his] treatment and requesting
assistance.” Id. J Il. Reed’s EEOC charge then concludes:
“I believe that I was discriminated against for refusing to
commit felonies because my generation wants to obey the
law and the younger generation is too unethical to under-
stand the concept. I believe that [sic] was discriminated
App. 6
against in [sic] because of my age 48, [sic] violation of
ADEA.” Id. { III.
Reed also attached documents to his complaint stating
his belief that MCI took adverse employment action
against him because he objected to felonious activities. See
“Alvin Reed versus MCI Inc., Summary Sheet” { 2; “Short
Term Disability Appeal For Prudential Insurance” {{ 2, 5;
“Chronological Order of Events Leading to my Wrongful
PIP (written 5/26/05)” {J 4, 6, 12; various e-mails raising
concerns about “pirated software.” MCI filed a Rule
12(b)(6) motion to dismiss and argued that the allegations
in the complaint affirmatively disproved that age was a
determining factor in the relevant employment decisions.
See MCI Mem. at 4-7. Specifically, MCI argued that Reed’s
complaint and the documents attached to his complaint
state that Reed believed he was demoted and harassed
because he refused to commit felonies by 7 question-
able software.’
MCI’s argument is not without force. In response,
Reed asked the court to wait until MCI provided proof of
ownership of the software. “Plaintiff’s Appeal to Motion to
Dismiss” at 1. Reed also clarified that his “age discrimina-
tion case is based on the Supreme Court decision in March
of this year stating that age discrimination is valid if
persons over the age of forty are more adversely affected
than persons under the age of forty.” Jd. Reed also con-
firmed his belief that “[a]ge discrimination was an indirect
consequence of rampant pirated software.” Id. at 4.
* MCI denies the improper use of software or illegal harassment.
App. 7
Given that Reed has clarified that he is pursuing a
disparate impact claim under the ADEA pursuant to 29
U.S.C. § 623(aX(2) and Smith v. City of Jackson, 125 S. Ct. -
1536 (2005), this court will determine whether he has
stated a claim of disparate impact under the ADEA. An
ADEA disparate impact claim involves a challenge to a
facially neutral employment practice that allegedly ad-
versely impacts those age 40 and over. The facially neutral
employment practice is usually an employer’s selection
criterion for employment, such as an aptitude or intelli-
gence test, or a strength requirement. In connection with
ADEA disparate impact claims, examples of such facially
neutral employment practices litigated in other cases
include a decision to discharge employees due to high
salaries or due to tenure. See, e.g., Wooden v. Board of Ed.,
931 F. 2d 376, 379 (6th Cir. 1991); Dace v. ACF Indus., 722
F.2d 374, 378 (8th Cir. 1983).
In order to state a claim of disparate impact, “it is not
enough to simply allege that there is a disparate impact on
workers, or point to generalized policy that leads to such
an impact.” Smith, 125 S. Ct. at 1545 (emphasis added).
Rather, the employee is “responsible for isolating and
identifying the specific employment practices that are
allegedly responsible for any observed statistical dispari-
ties.” Id. (emphasis added) (citation and internal quota-
tions omitted).
Reed nowhere identifies what is considered a facially
neutral employment practice (e.g., a strength requirement;
a requirement to take and pass an aptitude test; a re-
quirement that an applicant have a high school diploma).
Instead, Reed identifies the practice at issue as the feloni-
ous use of pirated software. Reed then couples that alleged
practice with his view that the “younger generation” is
App. 8
willing to use pirated software without objection. Thus,
Reed’s theory is that the felonious use of pirated software
has a disparate impact on workers age 40 and over be-
cause those age 40 and over understand the need to obey
the law and will not use the pirated software and thereby
are subject to adverse employment action at MCI.
Reed’s complaint and the EEOC charge attached to
the complaint confirm this “logic.” Reed’s EEOC charge
states (1) that he was “discriminated against for refusing
to commit felonies” associated with using pirated software
and (2) that the younger generation is too unethical to
understand this concept. In making this argument, Reed
contends that proof that employees at MCI used non-
licensed software and proof of the alleged generational
differences will demonstrate that MCI violated the ADEA.
Reed’s claim fails for a number of reasons. First, Reed
has simply identified an alleged “generalized policy” — the
use of pirated software. See Smith, 125 S.Ct. at 15465.
Reed has failed to identify a “specific employment prac-
tice.” Id. Thus, he fails to state a claim.
Second, Reed’s argument is a non sequitur because the
conclusion (i.e., age discrimination) does not follow from
the premises by which it is supposed to be supported. Even
if MCI did not have proper licenses for the software that
Reed or other employees used, the absence of such licenses
is not logically connected to Reed’s proposed conclusion
(i.e., age discrimination at MCI against those 40 and
older). Stated differently, as a matter of law, the conclusion
that MCI discriminated against Reed based on his age
cannot be drawn as a permissible, let alone reasc able
inference, from the presence of non-licensed software. Cf.
E. Shore Mkts., Inc., 213 F.3d at 180 (in reviewing a
App. 9
motion to dismiss, a court need not accept as true unwar-
ranted inferences, unreasonable conclusions, or argu-
ments). Accordingly, even if the court assumes that all
employees faced the presence of non-licensed software,
that assumed fact cannot by any logical process lead to a
conclusion that MCI “limit[ed], segregate[d], or classif [ied]
[its] employees in any way which would deprive or tend to
deprive any individual of employment opportunities or
otherwise adversely affect his status as an employee,
because of his age.” 29 U.S.C. § 623(a)(2).
Finally, as for Reed’s second premise concerning the
lack of ethics of the “younger generation,” this court
cannot conceive of admissible evidence that Reed could
submit to prove that those under age 40 at MCI are “too
unethical to understand” the need to obey laws against
pirating software. Further, even if he could prove this
premise, such proof is not logically connected to proving
that MCI violated 29 U.S.C. § 623(a)(2). Instead, such
proof would show that the cause of the alleged harm to
Reed was not any specific employment practice that MCI
adopted, but instead was an allegedly unethical class of
people under age 40. Cf. Watson v. Fort Worth Bank &
Trust, 487 U.S. 977, 994 (1988) (“Once the employment
practice at issue has been identified, causation must be
proved; that is, the plaintiff must offer statistical evidence
of a kind and degree sufficient to show that the practice in
question has caused the exclusion of applicants for jobs or
promotions because of their membership in a protected
group.”); Anderson v. Douglas & Lomason Co., 26 F.3d
1277, 1284 (Sth Cir. 1994) (upholding district court’s
refusal to analyze the plaintiffs’ claims using the disparate
impact model because the plaintiffs did not identify a
specific aspect of the employer’s subjective decision making
App. 10
that was shown to have any causal connection to the
alleged class-based imbalance in the employer’s work-
place); Edwards, 885 F.2d at 1223 (finding that complaint
failed to contend that defendant’s actions affected pro-
tected class to a greater degree than non-protected class).
CONCLUSION
The defendant’s motion to dismiss the complaint
pursuant to Fed. R. Civ. P. 12(b)(6) is GRANTED.

court is deciding if she should be imprisoned for using
stolen property. Rosa Parks provides to this court evidence
consistent with what I have provided in the form of emails.
The paradox is: would this court imprison Rosa Parks,
even though she objected to the use of stolen property. I
remind the court that, in this parable, Rosa Parks repeat-
edly objected to the use of stolen property to the employer.
Now substitute myself, not as the defendant, but as the
plaintiff, into this analogy of a person of faith over the age
of forty. Do I get the same constitutional rights as Rosa
Parks?
What I state in this paragraph, I point out can draw many
different conclusions. I do point out as fact that these could
not have occurred by random chance. I draw here no conclu-
sions other than relational facts which are verifiable must be
accepted into evidence.7 is the number of completion. Rosa
Park’s mug shot, 7053, ended in 53. Numbers 7:53 in the
Holy Bible indicates the number 5 for 3 different items. This
year, category 5 hurricanes occurred 3 times over 53 days.
This occurred August twenty eighth through October
nineteenth. There are 53 chapter four verse sixes in the

Holy Bible, the first of which was mentioned previously in
this case. Genesis four, verse six denotes the first pre-
meditated murder, Genesis three denotes the first sin and
at every other character notes “Rosa sat seat”. There was a
5.3 earthquake in California the day of the date noted on
my email from Senator Feinstein, also noted previously.
MCI is first found every other character at position 50003
in the Original King James Version of the Holy Bible. I

of this case strictly to proof of ownership of the items in

the age of forty would be expected to experience anxiety
when being forced to commit felonies over an extended
period, then learning that the felonious activity is man-
agement approved. I maintain that setting a precedent
where any employee who objects to felonious activity
would have to provide his life’s history to feed his family is
irrelevant and totally out of the scope of an employee who
is forced to commit felonies under duress. Per attachment,

Did the Founding Fathers intend the Judicial Branch of
government to consider evidence that has no other expla-
nation then to be testimony from a higher power? If the
evidence presented here is not considered sufficient, I feel
led to respectfully request oral argument. My proof is in
this prayer put on my heart in preparation for my Sunday
school lesson on July 3rd, 2005 shortly before my family
drove to Washington, D.C. to pray inside of the Supreme
Court that God give guidance to President Bush in select-
ing the next Supreme Court Justice.
Dear God,
Thank you for getting my attention. For twenty three years
you asked me to go to Nineveh. You knew all along that I
would continue to refuse. I now realize that was all battle
training. I was in your boot camp all those years. Your
training methods God are so powerful that I actually
thought it was the real thing. I now realize I was in your
boot camp preparing for the real war ahead. You knew,
when the time was right, I would be well conditioned for
battle for I was battle trained in your loving care, all along
not realizing that my refusal to go to Nineveh was your
plan all along. You knew, God that you could break every
bone in my body and I would have continued to refuse to go
to Nineveh. You knew, God that you could have ravaged my
entire body with painful sores and I would have continued
to refuse to go to Nineveh. You knew, God that you could
have taken away my food, my clothing, and my shelter and
I would have continued to refuse to go to Nineveh.
For all of those years while you were training me for
battle, you knew all along that taking away from my wife
and me our most prized processions was the only way to
get our attention, was the only way to convince us to go to
App. 19
Nineveh. You took away our children. You got our atten-
tion God. In our living room, on our knees, in tears, we
gave ourselves completely to you that lonely evening in
January. We now realize that you had just conferred our
graduation from your boot camp of life and now it was
time to make the journey to the real battleground. We had
no source of income for this journey. We trusted in you to
provide. We gave back to you that evening only a tiny
portion of what you have so richly blessed us with for so
many years, knowing full and well that we could trust you
to provide, which you did in overabundance in the coming
days. Days later, you heard my prayer to stop sending us
money in abundance for we started feeling guilty finding
large hoards of found money in the mail every time we
went to the mail box over the next few days. Some would
call it a coincidence. Call it what you may, you provided us
in abundance for trusting you that evening.
You held our children in your loving arms in the boat to
Nineveh. All we need do was walk across the water, from
the safety of the solid rock shore to the boat to Nineveh.
We knew that as long as we kept our eyes on you, we could
walk across the water without fear. We knew your shield
would protect us on our journey across the sea. Once we
reached the boat where you were standing, you gave us
back our greatest treasure, our children.
You asked us God, once we reached the boat, to go to
Nineveh to put Intelligent Design in the textbooks in
Nineveh. Did you realize God that you were asking my
seven year old son to defend your very existence to the
greatest minds in the most prominent universities in
Nineveh? Did you realize God that you were asking my ten
year old son to defend your very existence to the nine
justices in the highest court in Nineveh? Did you realize
App. 20
God that you were asking my wife to defend your very
existence to the boards of directors of the most powerful
Corporations in Nineveh? Did you realize God that you
were asking me to bring together the African-American
and the European-American churches in rural Nineveh
knowing that this complete union was the only way to get
Intelligent Design into the textbooks in Nineveh?
Along the way to Nineveh you stopped the boat three days
before Palm Sunday. You told my family to walk across the
sea to the Holy Spirit on the shore. We kept our eyes on
you every step of the way for we knew if we faltered, we
would sink into the sea. Your Spirit told us to write a
simple message, “Please support Intelligent Design”. You
asked us to send this to the President of Nineveh which we
did for we knew he was strong in your spirit. You then
asked us to send the message to the Senators of our State
within Nineveh, which we did because we knew they were
strong in your spirit. You then asked us to send the mes-
sage to the Governor of the State within Nineveh that had
been ravaged with four hurricanes over a forty nine day
period the summer before, which we did because we knew
that, being the brother of the President of Nineveh the
Governor of this ravaged State was strong in the spirit.
Then God, you asked us to send the message to all of the
Senators and all of the Governors within Nineveh. Did you
forget God that there were those that would not be receptive
to this message? Did you not realize God that this was not a
message that those not strong in the spirit wanted to hear?
We put our faith in you God and did as you asked us to do.
As we started to walk back across the water to you in the
boat, did you realize God that the devil was in another
boat behind you trying to take our eyes off of you? The
devil went to great lengths to get our attention, for the
App. 21
devil knew that if we took our eyes off of you God for even
an instant, we would sink to the bottom of the sea. Did you
realize God in the deep fog of the morning, we could not
clearly see? Did you realize God that we needed confirma-
tion that we were walking to the right boat, for the view
was not clear? We wanted to do your work. We just wanted
to make sure the message was from you.
The morning of Palm Sunday, we worshiped in your house.
The room was strong in your spirit that morning. Your
overwhelming presence in the room overcame me when
you whispered in my ear that a storm was brewing on the
sea. That afternoon, we watched State Senators from the
ravaged State in Nineveh talk on the air waves, about a
starving woman in their State as if she had no soul, no
soul at all. These State Senators seemed to be claiming
that they had a better understanding of the existence of a
soul than you God. I then understood the storm that you
had enlightened me to earlier. The highest Senate in the
land of Nineveh was reported to have voted unanimously
to do everything they could to save the life of this starving
woman. Those in this highest Senate, both of the spirit,
and not of the spirit, voted unanimously. I recognized God
that this was a miracle possible only with your divine
intervention. Do you remember God that I jumped in my
truck and headed to the ravaged State to see if I could
help? I did it on faith God because I knew that your shield
would protect me from harm on this journey.
Your unanimous vote in the highest Senate in the land of
Nineveh was the confirmation that I needed to know that
we where headed to the right boat.
Amen

Mr. Alvin Reed
481 Lydia Perry Road
Sanford, North Carolina 27330
Dear Mr. Reed:
Thank you for writing to me about the use of the filibuster
for judicial nominations and the so-called “nuclear option.”
I appreciate hearing from you and am happy to respond.
As I am sure you are aware by now, a compromise was
struck between 14 senators, seven Democrats and seven
Republicans, to avoid taking action on the nuclear option
which I believe would have fundamentally harmed our
country and the Senate.
The substance of the compromise is that the seven
Democratic senators agreed to vote to end debate on three
of President Bush’s nominees, Priscilla Owen, Janice
Rogers Brown and William Pryor. Additionally, the seven
Republican senators agreed to vote against any effort to
change Senate precedent and force votes on judicial
nominations during the 109th Congress.
While I am pleased that a compromise was reached
which preserves the rights of the minority in the Senate, I
am disappointed that, as part of the compromise struck,
some judicial nominations will not be subject to the rules
and procedures provided for in the Senate.
Please know that I will continue to do my due dili-
gence when considering all judicial nominations, and I
evaluate each nominee based on their intellect, tempera-
ment, legal experience and their ability to demonstrate a
commitment to applying the law fairly and impartially.

Again, thank you for writing. If you should have any
questions or additional comments, please do not hesitate
to contact my Washington, DC staff at (202) 224-3841.
Sincerely yours,
Dianne Feinstein

Re: Alvin R. Reed v. MCI, Inc.
Per our conversation today, my wife and I have determined
that two years salary is the make right we would accept to
drop all civil and criminal charges against MCI. This is
the time we estimate it will take to get our “ethical rating
system for businesses” off the ground, which will get us
back to where we would have been financially had I
continued to look the other way. I cannot go back to corpo-
rate America because of the confusion of whether or not to
obey the law, and the resulting situational anxiety that
this causes. As I pointed out in our conversation, statisti-
cally, virtually everyone is inadvertently using pirated
software. If an employee cannot object to the use of pirated
software without fear of retaliation, then I have no way of
knowing whether or not I am suppose to follow the words
of the executive management to obey the law or the
actions of executive management to look the other way. In
the case of MCI, I was repeatedly forced to use pirated
software against my will even though I repeatedly ob-
jected.
- App. 28
If it becomes necessary to take this all the way to the US
Supreme Court, we estimate that it would result in a
significantly higher total cost to MCI. We conclude this
because MCI responded to the EEOC charge by approving
my wrongful demotion, which is retaliation and by EEOC
rules significantly increases the penalties. This is age
discrimination because citizens over the age of forty have a
greater understanding of right and wrong because man’s
law and God’s law where more in synch a generation ago.
This makes it more likely that an employee over the age of
forty will listen to the public relations verbiage of execu-
tive management to obey the law which is what caused
MCI to retaliate against me in this case.
In our conversation, I indicated that I am being denied
disability because my medical doctor has indicated all
along that the issue is situational anxiety due to hostile
workplace. My medical doctor is well aware that the
hostile workplace is a direct result of my objections to
felonious activity at MCI. Righteousness is not considered
a disability by either Prudential Insurance or the US
Social Security Administration. A cure for righteousness is
not something I would accept as a resolution.
I explained to you why I am convinced that the US Su-
preme Court will rule in my favor. A felony is a felony is a
felony, whether it is to knowingly and with premeditation
disobey a bankruptcy court order such as occurred in this
situation, or pirated software which occurred in this
situation, or any other felony whose prison time is consis:
tent with pirated software. For example, if an employee is
forced to use a dozen pirated software programs, that
employee could spend five times twelve or sixty years in a
federal penitentiary even though he only committed the
felonies because he was under economic duress. I have
App. 29
been told that federal marshals come into a business with
loaded guns when doing a pirated software raid. For an
honest employee who does not have proof of ownership
readily available, even something as innocent as an
inadvertent sneeze at the wrong moment could trigger an
automated response from a federal marshal that the
employee’s widow would have to explain to their children.
This is, in part, the reason for my situational anxiety to
being forced to commit felonies under duress.
