AVERAGE AGREEMENT

WHEREAS, THE S/S “WILLDOMENO”

whereof

was Master, having on board a cargo of merchan-

dise, sailed from the port of Palermo and Mes-

sina during the month of June 1920, bound for

New York via Lisbon and in due prosecution of

her said voyage, it is alleged, that the machinery

became disabled and she put into the Azores,

repairs were made and the vessel resumed her

voyage, but subsequently put into Sydney, After

leaving there she struck a rock off Cape Canso

which necessitated putting into Halifax where

repairs were effected and the voyage resumed.

And whereas by reason of the occurrences of

the voyage, certain losses and expenses have been

incurred, and other losses and expenses hereafter

may be incurred, which may constitute a general

average; to be apportioned on the said Vessel,

her earnings as Freight and her Cargo, and other

losses and expenses have been and may be in-

eurred, which apply to and may be due from

specific interests; Now, in consideration of the

premises, we, the subscribers, owners, shippers,

or consignees (or agents or attorneys of certain

owners, shippers or consignees) of said Vessel,

her earnings as Freight, or her Cargo, do hereby

for ourselves personally, and our principals and

executors and administrators, severally and _ re-

spectively, but not jointly, or one for the other,

covenant and agree to and with Convoy Steam-

ship Company, Ltd., and/or Rodgers & Carr, Inc.,

as Trustees for all concerned, that all losses

and expenses aforesaid, which shall be made to

appear to be due from us or our principals, or 26385

from any firm of which we are or have been

copartners, either as owners, shippers or con-

signees, shall be paid by us respectively, accord-

ing to the part or share in the said Vessel, her

earnings as Freight, or her Cargo, which shall

belong to us or shall belong to or be consigned

to any person or persons for whom we are agents,

or attorneys, or with whom we are or have been

partners or in which we are or have been in any

manner concerned, provided that such losses and

expenses shall be stated and apportioned by

Rodgers & Carr, Inc, Average adjusters, in ac-

cordance with the established usages and laws in

similar cases. And we do further bind ourselves

to furnish promptly, on request of said Adjusters,

all such information and documents as they may

require from us to make said adjustment. This

agreement may be executed in several parts of

like tenor and date, the whole of which is to

constitute but one agreement, with the same effect

as if each of said part were severally signed by

us.

whole or in part to the cargo be determined by

amicable settlement or by arbitration WE HERE- 9637

BY AGREE to pay, each our rateable propor-

and in the event of an action or suit being brought

to recover for such services, WE HEREBY

eing advised of damage to the above ship-

ment we proceeded on August 10th to Pier ©,

Jersey City. We learned that this shipment was

stowed in the No. 1 lower hold. That owing to .

engine trouble the steamer put into the Azores

in distress. {

She sailed from there on July 10th and then

put into Cape Breton for coal, When she re-

sumed her voyage she struck some obstruction

and sprung a leak, filling No. 1 hold with water,

making it necessary to put into Halifax in dis-

tress.

The above shipment was stowed in the No. 1 2659

hold and was submerged.

The Steamer sailed from Halifax to New York

on August 3rd.

After arrival at New York the work of dis-

charging her cargo of Lemons proceeded, after

which the Steamer was taken to the foot of 134th

Street, North River. On August 20th we visited

her at that pier but found that no work was be-

ing done and we were unable to see the ship-

ment. We again visited the Steamer on August

23rd and in company of a _ representative of

Messrs. Pfizer & Company went aboard the

Steamer and into the hold, finding the top tier

clear of the water but all the remaining tiers

were submerged. The top tier packages had also

been submerged. The contents was thoroughly

wet and had the consistency of a heavy paste.

Messrs. Pfizer & Company’s representative did

not consider the Citrate would have any value.

The Agents of the Steamship Company stated

it was impossible to discharge the casks with

the hold one-half full of water and it was im-

possible to get the water out of the compartment

until the Steamer was placed in dry dock.

We have had samples of the Citrate drawn and 2661

have submitted these to a Chemist and are now

awaiting his report as to the quantity of Citrate

remaining in order to determine if it has suffi-

cient value to warrant processing. We fear that

there will be little of value, if any.

We are submitting this as a preliminary report

in the matter.

MERCHANDISE: Citrate of Lime

NATURE OF LOSS: See Below

SHIPMENT

C A C 5899/6066—168 Casks Citrate of Lime

The steamer “Willdomino” while enroute from

Italian ports to New York struck on a rock off

Canso and as a result the No. 1 Lower Hold was

reported to have been flooded.

It is reported that she then proceeded to Hali-

fax, where measures were applied to permit of

the vessel preceeding on the voyage to New York

to where she was towed and arrived on August

7th.

When the steamer was berthed at Pier C, Jer-

sey City, on August 9th, I proceeded to the pier,

when I found that the hatch covers were on the

No. 1 Hold and that it was intended to discharge

only the cargo of lemons at this pier.

Again on August 11th, and 17th, I proceeded

to the steamer finding that the No. 1 Hold in

which the cask was said to be stowed was not

being discharged and that the casks of the above

shipment were not accessible.

Subsequently on August 24th, the vessel having

heen removed to the Pier ft. 135 and North

River, I proceeded to that pier and found that

the cargo of corkwood was being removed from

905

Claimant's Bahibit 15.

the No. 1 Lower Holl, which permitted my exam-

ination of the casks, all of which had evidently

been submerged in seawater and contents had

become heavily wet, caked and discolored. At this

time I wrote the General Average Adjusters ree-

ommending special care in the discharge of the

casks in order to avoid breakage of staves with

consequent scattering about of their contents.

After which I awaited word as to when to dis-

charge of the casks would be completed when

a more detailed examination could be made of

the casks in company of the consignees.

I had, in the meantime, requested consignees

to lodge notice of claim in writing with the steam-

ship agents, and also suggested they take the

necessary steps in order to obtain relief of duty

in proportion of the damage sustained.

The casks were not discharged at New York,

but were left in stowage and the steamer was

then placed in drydock, presumely to have the

damaged hull surveyed for repairs and on August

28th, I proceeded to the Tiet jen & Lange Drydock

at Hoboken, where I found a number of casks

had been removed from the Lower Hold and

set on the open deck, number of which had staves

broken or head staves forced out. I then drew

representative samples of the casks which samples

I submitted to Messrs, Sherer Bros. Analytical

Chemists to have them determine the citric acid

contents remaining in the material: the chemist’s

subsequent report as follows:

Citrie Acid

Bulk 40.7%

Centre 36.9%

Surface 33.7%

Bored from Casks 38.7%

Ts

mtte

2715

2716

2717

2718

906

Claimant’s Exhibit 15.

On the above basis the average test was about

37.5% citric acid.

Upon communicating with the said chemical

company they informed me they were not equipped

to handle all of the damaged casks at once and

in view of the consequent delay to which the

measure part of the casks may be subjected while

awaiting to be processed, they were of the opin-

jon that the citrate would continue to ferment

and thus continually lose more of the citrate acid

contents and for that reason alone they were

inclined to consider the situation hopeless.

Further samples subsequently were drawn by

Messrs. Koehler Kemp & Koehler, Surveyors ap-

pointed by the General Average Adjuster, analized

from 26.3 to 42.8 or an average of 33%, which

our assured and also Charles Pfizer & Co., the

consignees of 335 casks citrate of lime in similar

damaged condition, stated that the 33% was too

low to warrant the expense of working material.

These tests were submitted to our Philadelphia

Office and in turn to Messrs. Powers-Weightman-

Rosengarten Co., who also process citrate of lime,

and who stated that the cost of extracting the

citric acid would be considerably more than the

final value of the citric acid obtained and that

the material in its damaged condition was abso-

lutely worthless for any other purpose.

As assured considered the shipment worthless

I endeavored to obtain a possible purchaser for

the casks and after a short while I finally found

a prospect of a buyer with whom I proceeded to

the drydock when samples were drawn by him

and after several days he made an offer of $2.25

per cask, which offer was so low that I naturally

907

Claimant’s Exhibit 10.

rejected it as it would not pay the duty on the

shipment.

This was the only offer that I could obtain

and, after further consideration, it was finally

decided to consider the shipment a total loss so

far as underwriters were concerned, I believe the

casks were sold by the Williams Steamship Co.,

to the buyer, whom I had interested in the above

casks,

TREASURY DEPARTMENT

WASHINGTON

January 19, 1921.

The Collector of Customs,

New York, N. Y.

Sir:

The Department refers to your letter of the

24th ultimo, transmitting entries Nos. D-16797

and D-17044, filed at your port on July 14, 1920

and August 9, 1920, respectively, by the Citro

Chemical Company and Chas. Pfizer & Company,

Inc., covering importations of citrate of lime.

It is alleged by the importers that an accident

to the importing vessel during the course of the

voyage resulted in the merchandise being sat-

urated with sea-water and rendered practically

unfit for commercial use as citrate of lime: and

913

Claimant’s Exhibit 18.

that they were unable to secure definite informa-

tion concerning the condition of the vessel and

its cargo in time to permit of the filing of timely

abandonment notices under paragraph X, of See-

tion III of the tariff act. It appears that a no-

tice of abandonment was filed with respect to

entry D-16797 but not within the statutory period.

\ ou report that the total entered value of the

two shipments is $143,945.00; that on appraise-

ment the merchandise in question was returned

as entered at 1 cent per pound under paragraph

41 of the tariff act, the appraiser reporting that

the same was damaged, “saturated with sea-

water”; and that in a supplemental report the

appraiser states that the shipments were sat-

urated with sea-water and unsuitable for com-

mercial use in the condition as received, without

reconditioning, and that both shipments have

been sold for $2500.

You submit the question in view of the great

difference between the entered value of the mer-

chandise and its value in its imported condition,

whether in liquidation of the entries the deposit

duties amounting to $6675.62 should be refunded

on the ground of non-importation.

The Department is of the opinion that the facts

do not bring the shipments within the legal mean-

ing of a non-importation, as it is not shown that

the citrate of lime was rendered utterly worth-

less as merchandise by reason of the casualty,

but rather that its usefulness as a commercial

commodity in its condition as imported without

reconditioning was lost; and the fact that a pur-

chaser was found although the price paid by

him was greatly less than the value of the mer-

chandise as entered, would sustain the conclu-

2737

2738

2739

2740

914

Claimant’s Exhibit 18.

sion that the case is one of damage rather than

of non-importation, the merchandise having be-

come greatly depreciated in value but not wholly

destroyed.

For the foregoing reasons, and for the further

reason that no notice of abandonment was filed

as to either shipment within the time and in the

manner prescribed by paragraph X, Section ITI

of the tariff act, the Department is without au-

thority to grant relief from the payment of the

duties on the basis of the entered value.

The papers are herewith returned.

Respectfully,

GEO. W. ASHWORTH

Chief, Division of Customs.
