Appellant, Lyle H. "renzler, was sued on a sister money -

Judgment, Cal .Cod.Civ.Proc. 1710,10-1710,65 for deficiency on

real property in Arizona in July 1978, while this judaqment was void

and voidable, and on denial of cross-complaint to include the

indispensable party of the hroker on same real property for

lack of personal jurisdiction for lack of service of summons

with complaint pursuant to Cal.Cod.Civ.Proc. 418.10, 413.10, 415.10

this case was petitioned for removal to the District Court of

Central California on September 18, 1978; for denial of equal

protection of the laws under color of state .. Statute and

repugnant to laws, statutes and Constitution of the lInited States

by a party of co-conspirators as 26 11.5.C. 1343, 42 U.S.C. 1983, 1985

and as an interpleading action under 28 11,5.C. 2361, 1397, 1335, lla,

and Federal Rules of Civil Procedure 22(1), both original jurie-

diction of district court. (Appended 182) On November 20, 1978,

the honorable Robert M, Takasugi, judge presiding, '.S. District

Court, Central Vistrict California Ordered remand to Superior Court

of the State of California pursuant to 28 U.S.C. 1441(b) and 1447

(c).(Appended 3) Oral Order was made for reason that the District

JURISDICTION

This appeal! involves the oriainal jurisdiction of the federal

courts in interpleader sections and actions for conspiracy to deny

equal protection of the laws as above referred to in 28 .5.C. 2361

and 1343et al., for diversity of citizenship in 28 U.S.C. 1332; 5 fase

28 U.S.C. 1254(2) and for reliance by appe!lant on state statute

Cul. Cod. of Civ. Proc, 426.10-426.60 which is herein held hy the

court of appeals to he invalid as repugnant to the Constitution,

and in effedt denyina a cross-complaint and redress by appellant

in all and any jurisdictions and thereby denied due process and

open heiring as in Amendment 1,V,%tV, which hy the secondina of

denial of jurisdiction in federal courts denial of eaual civil

rights as in 28 U.S.C. 1443 and no trial on the issues with

Jjudament on deficiency Jjudoment,,as above, awarded, and deni«cl

of consolidation of what is in effect a multi-distdiet litiaqation.

STATEMENT OF THF CASE

Has been stated concisely under heading Opinions Below,

hereinabove. In addition, the appellant has heen denied Filing

of appeals, accountina for moneys in filina cases and service of

summon by U.S. Marshal, to the denial of any favorable judament

in this and all ancillary actions; denial of notification,

appearances and representat ion.

REASONS WESTIONS PRESENTED ARE SUBSTANTIAL

This claim or right arises under the Constitution, treaties,

laws of the United States and the district court has original

jurisdiction and therefore removable without regard to citizenship

or residence of the parties; in this instance by the defendant,

to the district court for the district embracing the ploice

wherein it is pending, who has been denied or cannot enforee in

the courts of State of California a right under any law provid-

ing for equal civil riahts of citizens of the United States,

or of all persons within the jurisdiction thereof; and for any

act under color of authority derived from any law providing for

equal rights, or for refusing to do any act on the ground that

it would be inconsistent with such law. This case haa not been

removed improvidently and the trial court has and had jurisdiction

as does this Gourt ‘and the appeals court. Subject matter juris-

diction is res judicata in this trial court and appellant is

entitled to claim equal protection of the laws as in the Four-

teenth Amendment especially as to venue; and by denial of

persona jurisdiction of appellees; such Constitutional rights

are denied; appellant having heen ¢auséd to submit to persona

jurisdiction in Arizona, over objections as 28 U.S.C. 1404, 1406,

A preliminary injunction requested pursuant to Federal Rules

of Civil Procedure was filed on October 18, 1978 and has never been

answered or heard hy the Trial Court; citing 28 U.S.C. 1441 (a)

and requesting consolidation of the multiple actions for same

liabilities to decrease possibility that one adverse judgment

would forever defeat possibility of appellant to receive redress

and equal protection of the laws, and United States Constitution

Amendment XIV;

“The States neh ts bted fFom abridaing privileges or

immunities of citizens of the United States or depriving

any person of due process or equal protection under the law”

and citing the purpose of jurisdictional qrants to Federal Court

in suits hetween citizens of different states was to avoid dis-

crimination against non-residents. Szantay v. Beech Aircraft Corp,

(19605) 349 F 2d 60, The trial court and appellate court have

erred of law by denying injunction, amendment or vacating and

irreparable damage has occurred to appellant thereby and this is

the appellant’s only remedy at baw. These and other constitutional

challenges raised by this appeal are substantial and important to

all citizens affected by such statutes--present and future. For

the reasons given above, the que tions raised ore substantial and

require a consideration of this cose. The nature of the case and

the rulings below are such as to bring the case within the juris-

dictional provisions relied on ang cases cited, ahove, to sustain

the jurisdiction,
