applying the importance prong of the collateral order test only to an assertion of privilege before considering the merits of the appellant's argument that his deposition was not in the interests of justice
How later courts described this case
- applying the importance prong of the collateral order test only to an assertion of privilege before considering the merits of the appellant's argument that his deposition was not in the interests of justice
- deliberative process privilege is sufficiently important
- deliberative process privilege is separable from underlying cause of action for legal malpractice and breach of contract

The opinion
DEL SOLE, P.J.,
Concurring:
¶ 11 join the Majority in concluding that the issue is appealable and that the trial court erred in concluding that Appellees met their burden to establish the need for the relief sought.
¶ 2 I would not reach the issue of privilege since it is not necessary to resolve this matter.
