The opinion
O’Hara, J.
(dissenting). The opinion relied upon by my colleague to mandate remand is by. its express terms prospective and limited to appeals filed after its date of publication (January 28, 1974). See People v Robinson, 390 Mich 629, 634 ; 213 NW2d 106, 109 (1973).
I find no error and vote to affirm the conviction.
