assigning “little probative value” to the post-trial appointment and reelection of a black judge in Florida’s Second Judicial Circuit, which includes Liberty County, and the “recent” election of a black judge who faced a white opponent in Leon County, Florida
How later courts described this case
- assigning “little probative value” to the post-trial appointment and reelection of a black judge in Florida’s Second Judicial Circuit, which includes Liberty County, and the “recent” election of a black judge who faced a white opponent in Leon County, Florida
- noting in footnote 14 that “[o]ur en banc court established this principle as part of our Section Two jurisprudence in our interpretation of the first Gingles factor in Nipper"
- holding that the “Miller and Gingles lines [of cases] address very different contexts”
- noting that while analysis of white-white elections is relevant, evidence from black-white elections is more probative

The opinion
FAY, Senior Circuit Judge,
concurring specially:
I concur in sections I, IIA, 1 throiigh 4, of the opinion for the court. It seems to me that Section IIB is simply unnecessary and therefore dicta with which I disagree but find no need to discuss. I do concur in footnote 22.
