The opinion

HOUGH, Circuit Judge

(dissenting). I agree with the statements of law made in the opinion of the court and relating to the general liability of physicians and surgeons in respect of claims for malpractice, but as to the trial of this particular case I am of opinion that it was so managed, especially in respect of the allowance of unfair and misleading hypothetical questions as to produce a result at once unjust and unlawful.

Eor this reason I dissent.
