Zimmerman, J.,

dissenting. The writer dissents for the reason that, in his view, the majority opinion extends Section 3939.01, Revised Code, beyond its intended limits, and past acquiescence in the unauthorized operations of the appellants does not now preclude the confinement of those operations within statutory bounds.
