(dissenting). — I concur in the result reached by the opinion of our learned commissioner in this case, but dissent as to what is therein said regarding contributory negligence and the assumption of risks. I fully expressed my views upon those questions in the recent case of Johnson v. Waverly Brick & Coal Company, 205 S. W. 615 , l. c. 617, paragraph three,
