(dissenting): In view of the conclusion reached by the majority of the court as reflected in the foregoing opinion, it is essential that the opinion be promptly filed. We content ourselves by saying that in óur judgment the conclusion reached by the court is not sound and under analogies which may be drawn from it, the validity of much of our school and other legislation may be open to question.
