THORNAL, Justice

(dissenting;).

I dissent to the entry of the judgment of the majority. The appellee Board of Public Instruction by its brief concedes that it actually owes appellant Wright the sum of $38,692. I would therefore enter a judgment for this amount in favor of appellant.
