The opinion

I must respectfully dissent. I believe the majority's dismissal of this appeal, case No. 2005-G-2652, while acknowledging there is a viable appeal concerning the identical subject matter, case No. 2006-G-2721, raises the potential for prolonging this already tortured string of lawsuits. The better approach, in my mind, would be to treat case No. 2005-G-2652 as a premature appeal and, then, consolidate it with case No. 2006-G-2721.
