The opinion
I concur in Judge Wise's analysis and disposition of Weinfeld's appeal and Wellings' second assignment of error.
However, I respectfully dissent from Judge Wise's decision, concurred in by Judge Edwards', the Wellings' first assignment of error is moot. Unlike my colleagues, I believe a ruling on the Wellings' first assignment of error could have a significant impact on Weinfeld's pending damage claims. ________________________ WILLIAM B.
