A FIFTY YEAR OLD FIGHT FOR WINNEBAGO LAND BACK, ACROSS THE MISSOURI RIVER

SLOAN, IA- It was the year 1970 when

approximately 2,000 acres of land was illegally

taken from the Winnebago tribe by the army

corps of engineers. A 50-year fight for the land

back hasn’t stopped. Today it continues, and

finally a land bill (H.R. 1240-Rep Feenstra) called

the “Winnebago land transfer act of 2023” is

being reviewed.

On a beautiful Monday morning June

7th, 2023, the temperature was 80 degrees and

the sun was shining. It was a great day to hit the

back roads for a site visit to the tracts of land the

tribe had been fighting for.

Prior to that the WTN Tribal Council met

with representatives from the U.S. representative

for Iowa’s 4th congressional district. The district

covers the western border of Iowa, which

includes Sioux city, IA and council bluffs.

Danelle Smith, legal council for the

WTN and Big Fire Law attorney opened up the

presentation by stating “the purpose of the bill

is to return the land that was taken by the army

1970.” I think visiting the land, seeing it in person

provides a lot of contexts for what the tribe is trying

to accomplish.

By sharing how the tribe has gotten to this

point, it is important to take a look back at the

history. In 1865, the Winnebago reservation was

established by treaty. Smith shared “the land was

promised to the tribe by treaty forever.” The United

States should take action to right this wrong and

honor that treaty that was entered into between the

Winnebago tribe and the United States in 1865.

At the time in 1970. There were two separate

condemnation actions brought by the army corps,

one being in Nebraska, and one across the Missouri

river on the Iowa side. Condemnation is when a

local, state, or federal government seizes private

property from an owner and then compensates that

owner for that property.

Tribal Councilman Louie LaRose was at

the forefront of the fight, and he shared a story

expressing “I was a team with Felix White Sr., and

Sterling Snake, we had a hell of a time. They told us

to take the money, we didn’t want the money, we

didn’t want to give up our land, it was ours. Sterling

told us we had a responsibility to fight for the land,

for our tribe. We came back to the tribal government

and told the council we have to fight for this land

and win. We were in charge of the fight with limited

resources. We didn’t know what kind of fight we

were getting into and the corps and the history of

beating tribes that are down the river."

Secretary shared her recollections of the moment

when the Army Corps was looking to seize the land.

“I was a young teenager when the corps of engineers

seized our Iowa land. We felt like we didn’t have

a voice for what we considered illegal seizure of

our lands. I’m proud to see that finally there is a

possibility after so many years, we have a chance

to get our Iowa land back.”

Smith shared “in 1970, the District Court of

Nebraska ruled in favor of the army corps and said

that the condemnation actions could proceed both

in Nebraska and then in 1971. Where that case was

decided in Iowa. Again the tribe lost at the lower

we must take these actions now to protect our community from those who, by their actions, show

a complete disregard for the safety and wellbeing of other members of the community.

The individuals against whom the Tribal Council has taken these actions include individuals who

have been convicted of violent and/or drug related offenses.

Pursuant to Winnebago Tribal Council Resolution #23-87 adopted March 10, 2023, the following

individual has been Ordered to either not return to, or to remove themselves from the Winnebago

Tribe of Nebraska Reservation or face additional criminal charges:

Violation of the Banishment Order by failure to leave or by returning to the Reservation once

removed shall result in charges of Criminal Trespass.

Through that time there has

been years of litigation and has been

introduced through legislation as the

Winnebago land transfer act back in

2017. By rep Steve King “that was H.R.

3688, the Winnebago land act of 2017.

So, the tribe was happy to have that

bipartisan support at that time and to

have the bill introduced. The bill did

not go forward."

We come to today and as a

result of Congressman Sharice Davids

introducing the bill late last year.

As well as congressman Feenstra

who was then a co-sponsor of the

bill “we’re happy he (Feenstra) took

it upon himself to be a primary

sponsor of the bill that is now pending

congress.”

That bill was presented

before the United States house of

representatives committee on natural

resources subcommittee on Indian

and insular affairs.

During a legislature hearing

on “H.R. 1240- The Winnebago Tribal

Chairwomen Victoria Kitcheyan

provided a statement stating “the

bill would transfer the tribe’s former

reservation lands from the army corps

back to the department of interior

to be held in trust for the tribe. The

land in this bill is mostly woodland

and marsh along the Iowa side of

the Missouri river and recreational,

hunting, and fishing area.”

Once the land is restored to the

tribe, the Winnebago Wildlife & Parks

Department would be responsible for

maintaining the land.

Kitcheyan adds “the

department oversees hunting and

fishing on 10,000 acres of woodland

on the Nebraska side of the Missouri

river, they have the experience and

resources to regulate recreational and

conservation activities and ensure

laws and regulations are enforced.”

should be going through the full

national resources committee later

this week. Then after that it should be

going to the House (of Representatives)

for a full vote. The senate has a little

bit of a different process but should

be continuing to move through the

house.

However, the language in the

bill will need some readjusting Smith

expressed “the tribe does not intend

to do gaming. To eliminate that the

need to explain that we will go insert

a sentence in the bill that says gaming

would not be permitted on these

lands.”

Circling back Decora

expressed “I remember when I was

a teenager when it was decided they

were discussing we cant take on

the corps of engineers. We’re the

little Winnebago tribe of Nebraska,

some were getting up. At that time,

I remember Reuben Snake, he was

sitting back and listening, when

everybody got done, he said we’re

going to be okay, we’re going to make

friends along the way. You come in

here from Feenstra’s office. Those are

the friends he predicted.”

After the site visit, the group stopped to take a pic. Staff from the Physical

Resources crew had a big hand in helping the Tribe get to this point.

LaRose has been a part of the

fight for the Iowa land back for 53

years. He expressed” I keep telling the

council, we are the Winnebago tribe

we fight. to take advantage of people

who want to help us. To find people

who understand what we’re talking

about. When we say we’re natives,

we don’t believe in taking land and

dividing it up, we’re apart of mother

earth and the land is apart of us.

You’re helping us in a way that’s hard

to explain how much I appreciate your

endeavors you brought us together.”

present, and future generations of the

Winnebago tribe.

the Chief Nursing Officer

(CNO) at the Winnebago

Comprehensive

Healthcare System. Sara,

known for her dedication

to patient care and nursing

excellence, will continue to

serve as Deputy Chief of Staff

and will maintain her active

roles in the outpatient clinic

and emergency department

as a nurse practitioner.

Sara's journey with the

Winnebago Comprehensive

Healthcare System began

in 2019 when she started as

a Nurse Practitioner in the

Emergency Department.

She quickly rose through the

ranks due to her inherent

leadership qualities and

commitment to patient care,

becoming Deputy Chief of

Medical Staff in September

2021. She also admirably

fulfilled her responsibilities

as Interim CMO/CNO since

departments including

Inpatient Nursing, Emergency

“Growth” has been the theme

with Ho-Chunk Farms since

its inception in 2012, and this

year is no different.

“We’ve added another

full-time employee, putting

us up to seven now,” said

Aaron LaPointe. “And we’ve

added two Ambassadors

to our team, both Tribal

members.”

Aaron has recently

been promoted to Ho-Chunk,

Inc.’s Senior Director of

Business Operations, where

he oversees operations at HoChunk Farms, Pony Express,

Ho-Chunk Trading Group,

and Management Services.

Filling his previous

position as Agribusiness

Manager is Cory Cleveland,

Winnebago Tribal member

and former Ho-Chunk, Inc.

intern. Cory will handle the

day-to-day operations at HoChunk Farms and has worked

with Ho-Chunk Farms for

over a year.

A d d i t i o n a l l y,

longtime Ho-Chunk Farms

employee and Tribal member

Jeffrey Thomas Jr. has been

promoted to Agribusiness

Operations Senior Supervisor,

where he will manage field

operations.

“I’m happy to see

the growth at Ho-Chunk

Farms and to have the ability

to promote Tribal member

employees while we continue

to enhance the food and land

sovereignty of the Tribe,”

Aaron said.

T h e Fa r m s t e a m

will manage 6,200 acres of

land total this season, which

will mostly be comprised

of conventional corn and

soybeans, but also 1,000 acres

of organic crop. Additionally,

they will farm 14 acres of

Indian corn.

Additional staff and

the recent purchase of a

planter with ARPA funding

has allowed the Ho-Chunk

Farms staff to farm 3,000

acres themselves, up from

1,200 acres from 2022. The

remaining acres are farmed

by contractors.

forward is acquiring more

farmland.

“Our growth is

dependent on our ability to

acquire land,” said Aaron.

“ We ’ ve b e e n wo r k i n g

with the Tribe on land

acquisitions.”

Since its inception,

Ho - C h u n k Fa r m s h a s

worked directly with the

Tribe to increase farmland

lease values by creating

competition on trust land

and separately begin buying

back non-trust farmland

within the reservation.

The approach has

created millions in annual

lease payouts for the Tribe

a n d Tr i b a l m e m b e r s.

Each of the last two years,

Ho - C h u n k Fa r m s h a s

returned $1.4 million in

farmland lease payouts to

the Winnebago Tribe and

Tribal members.

EDITORIALS

OBITUARY

Irene Marie LaMere, 81, of

Colorado Springs passed

away into the embrace

of Our Lord on May 31, 2023

after a short illness.

Irene was born in

Winnebago, Nebraska on

April 9, 1942 to Vernie and

Gail LaMere and was the

third of eight children. She

graduated from Bishop

Heelan High School in

Sioux City, IA and worked

at a variety of places in

Sioux City before moving

to Colorado Springs in the

late 70’s. She was a tenacious

and hardworking woman

who worked mostly in the

Electronics

and Defense industries in

the Colorado Springs area,

eventually retiring from

Northrop Grumman in the

late 90’s. She made many

lasting friendships

throughout her career and

thoroughly enjoyed her post

retirement jobs at FoxworthGalbraith Lumber Company

in Monument, CO, and as a

babysitter/caregiver for

the children of relatives

and friends. Irene enjoyed

reading, gardening, tending

to her home and took in

many animals over the

years. She absolutely loved

her dogs!

Irene is preceded in death

by her parents, Vernie

and Gail (Dean) LaMere;

siblings, Sister Mary

Anno LaMere of Denver

and Charles LaMere of

Pueblo, CO. She is survived

by sisters, Gwen (Tim)

McKivergan and Theresa

(Mark) Rush of Texas;

brothers, Harold ( Jean)

LaMere, Edward (Sherry)

LaMere and Tim (Cheryl)

LaMere of Nebraska. She

had numerous nieces and

nephews, including grand

and great-grand, whom she

loved very much. She was a

wonderful daughter, sister and

aunt. Irene was especially

close to nieces Teresa and

Michelle who helped her so

much over the years. (We all

appreciate you both for taking

such good care of her.) Her wit

and sense of humor will be

missed by us all.

A celebration of Irene’s life

will take place at 11:00 AM on

June 23, 2023 at Holy Trinity

Catholic Church in Colorado

Springs, followed by the Rite of

Committal in South Sioux City,

Nebraska on July 28, 2023.

SUICIDE IN INDIAN COUNTRY PT. 30, CONTINUED...

Some of the things that parents go through are

really awful. That is a fact, and there’s nothing

wrong with your child seeing your distress; after

all, she is learning that life can indeed be hard at

times. But to learn resilience, she also needs to

see you cope and then gradually recover. That’s

the real life lesson she learns by watching how

you handle things.

When things go wrong,

you can model resilience by:

• appropriately expressing your anger, hurt, loss;

• showing that you go to trusted persons

(including health professionals) to talk things

over and ask for help;

• showing confidence (sometimes even when

you don’t feel it) that you’re going to handle the

problem;

• showing your pride when you do solve the

problem, or make a step in addressing part of it.

If you are pretty good at regaining stability after

a bad experience, you only need to let your child

see how you do it. If you are depressed or stuck

in negative territory, be aware that your child is

watching – and learning from – you. Get help so

that you can move on; there’s nothing wrong with

letting your child know: “I’m seeing a counselor,

someone who can help me fix what’s wrong so I

can feel better.” A final point; although you want

to model resilience, it’s the child’s resilience

we’re concerned with here. If things in your life

cause you to lose your temper, don’t try to fool

yourself that giving him a quick hug afterwards

makes everything okay. You may feel better,

but he’s likely to feel hurt and confused by your

mixed messages. If you recognize that this a

pattern of behavior, you’ll probably benefit from

getting help to change it; and this is a life lesson

in resilience you want your child to copy.

things! And some are the same things that hurt

adults:

• the loss of a loved one;

• parental separation or divorce;

• physical (including sexual) abuse of himself

or a sibling;

• witnessing violence or substance abuse at

home, or in the neighborhood;

• poverty, and the worry that it brings;

• parental job loss;

• a serious illness of either the parent or the

child.

You know what these things feel like; you know

too that it can take some work and some time

to get over them. Your child is likely to have the

same range of emotional responses as you do,

but probably with a good deal more doubt and

fear. The fact is that children do not see things

just the way adults do and sometimes the parent

barely notices what is, for the child, a traumatic

experience. Some examples of these:

• being and/or feeling different from other kids;

• difficulty measuring up to expectations;

• parents who may fight a lot, leading the child

to fear a divorce even when there’s none being

considered;

• being excluded or bullied at school;

• being humiliated in front of others;

• frequent moves, especially if the child is the

quiet type;

• absence of parent.

This past Sunday, many took time to thank

his/her father for serving in his God-given

vocation or calling. This special day is in

accord with the following command of God:

“Honor your father and your mother, that your

days may be long in the land that the Lord your

God is giving you" [Exodus 20:12 (ESV)].

The vocation of fatherhood mirrors that of

our Creator - Jesus' heavenly Father. Creator

God is the giver of life. Reflect on the words

of Paul to the saints, the believers in Christ,

at Ephesus: 'For this reason I bow my knees

before the Father, from whom every family in

heaven and on earth is named, that according

to the riches of his glory he may grant you to

be strengthened with power through his Spirit

in your inner being, so that Christ may dwell

in your hearts through faith—' [Ephesians

3:14–17a (17b-19) (ESV)].

Creator God blesses men with the role of being

fathers of their child(ren). An earthly father is

to serve in many ways including providing for

the basic needs of his offspring by providing

emotional, mental, physical and spiritual

support.

Creator God has also called fathers to serve as

discipliners of their children. Again, this role

is similar to the role of Creator God. Solomon

wrote the following proverb: “My son, do not

regard lightly the discipline of YAHWEH, nor

be weary when reproved by him. For YAHWEH

disciplines the one he loves, and chastises

every son whom he receives” [Proverbs 12:511].

It is truly an act of love to discipline, not to

abuse, but to train up a child in the fear (a

healthy respect) of YAHWEH. We turn again

to Paul and his letter to the saints at Ephesus:

'Fathers, do not provoke your children to

anger, but bring them up in the discipline and

instruction of the Lord' [Ephesians 6:4 (ESV)].

One of the key roles of a father is to be the

spiritual teacher of his child(ren). The father

is to lead his family in prayer. He is also to lead

his family in attending divine services, where

Creator God serves his family - his adopted

sons and daughters, on a weekly basis.

The father is to instruct his family in regard

to the Lord Jesus through daily devotions,

reading God's Sacred Word and leading them

in prayer. It is good for a father to be a model

of a spiritual warrior by beginning his day in

prayer, offering a prayer at meal times, and

closing the day with a prayer. What a comfort

it is to be blessed with such a father!

Adults need to also remember that their greater

experience with life may mean they tend to

dismiss as just “a little bump in the road” what

is for a child a big deal. If you think back to your

own childhood, you can easily understand how

adults make light of something that is huge in

the eyes of a child – and, the fact is, some things

are huge for a person of any age.

REMEMBERING DAPHNE EVANS, NOV. 26, 1961 - JUNE 14, 2023

WINNEBAGO, NE - Daphne Evans,

known by her Ho-Chunk name, Caxji

Nacge Pi Maxi Nazi (Good Buffalo Heart

Woman Standing On Cloud), passed away

on June 14th, leaving behind a legacy of

love, community service, and a profound

impact on those she touched. She was 61.

Daphne was born on November 26,

1961, in Winnebago, Nebraska, embracing

the rich heritage and traditions of her

Native American roots. As a proud member

of the Winnebago Tribe, she dedicated

herself to advocating for Indian Education

and the well-being of her community.

In her early years, she attended

Winnebago Public Schools and then

graduated from Phoenix Indian High

School and was crowned Ms. Phoenix

Indian High School in 1980, exemplifying

her poise, intelligence, and leadership.

Throughout her life, Daphne actively

engaged in various roles and initiatives

that shaped the lives of many. She served

as a member of the Winnebago School

Board, where she tirelessly worked to

enhance educational opportunities for

tribal youth. Her passion for education

and her commitment to fostering a

nurturing learning environment were a

driving force in her work.

Daphne's dedication to her tribe

extended beyond the realm of education.

She served on the Winnebago Tribe's

Enrollment Committee, playing a vital role

in ensuring the integrity and inclusivity

of tribal membership. Additionally, she

served as the Assistant Administrator of

Housing, diligently working to provide

safe and affordable housing options for

her community.

R e c e n t l y, D a p h n e a s s u m e d

the esteemed role of Ho-Chunk, Inc.

Ambassador, representing her tribe with

grace, dignity, and a commitment to

economic empowerment. Her efforts to

strengthen the tribal economy and create

opportunities for future generations will

continue to have a lasting impact.

D ap h n e's i mp a c t e x t e n d e d f a r

beyond her professional and community

involvement. She was a loving mother, a

devoted wife, and a cherished friend. Her

nurturing spirit, infectious laughter, and

kind words brightened the lives of those

around her. She enjoyed the company

of four canine fur babies. Daphne will

forever be remembered for her resilience,

compassion, and unwavering support.

Daphne is survived by her husband Reno

Evans, her mother, Catherine Frenchman,

her siblings, Jamie (Diane Redhorn)

Frenchman, Sharon (Avery Blackhawk)

Frenchman, and John Bouchal, her sons

Teddy (Roxanne) Frenchman and John

(Kristina) Jensen, her daughter KT Evans,

her seven grandchildren, and a community

grateful for her contributions. Her memory

will be forever etched in the hearts of those

who had the privilege of knowing her.

Wake services will begin June 15, 2023

at the Blackhawk Community Center, and

funeral services on Saturday, June 17th

at 2 pm at the same location. Issac Smith

officiating.

May her legacy continue to inspire and

guide us, and may her spirit find eternal

peace.
