St.
Regis Mohawk Tribe
Constitution
The Election Board has requested
clarification of two decisions Deborah Thomas et al. v. St. Regis Mohawk Tribal
Council#96CI0080 decision dated June 7, 1996, and Randy Jock v. St. Regis Mohawk Tribal
Council #96CI0080 decision dated December 31, 1996, with respect to the voting rights of
Saint Regis Mohawk Tribe members who reside on the Canadian side of the Mohawk Territory,
and to those persons who may be nominated as candidates, and to those persons who may be
elected.
His Honour Judge Horn in his December 31st
decision reiterated the findings of the June 7th decision of Judge Deom when he stated
that there "was no mention of a residency requirement in the Constitution with
respect to members." The Constitution states clearly at Article III Section I Rights
of Members that a duly enrolled member of the Saint Regis Mohawk Tribe shall have the
following rights:
(a) Voting in all tribal elections:
What is the extent of the political rights of
members?
The Constitution can guide us to the obvious
rights as set forth in that document.
Article III Section 1. Members may vote in
all tribal elections.
Article V Section 6. States that voters must
be qualified.
This section gives rise to a requirement for
a registration mechanism of some kind which would qualify voters in a list.
Article V Section 10. Candidates for tribal
elected office must be enrolled members with significant other requirements such as age,
absence of felonious record within the past 5 years. In order for there to be a finding
that certain persons are not entitled to vote or hold office or nominate persons for
office, there would have to be direct and specific language within the constitution to
support those restrictions.
1. In the present Constitution a member may
vote.
2. It follows that a member may also be
placed on the registered voters list if he meets the requirements of age.
3. There is currently no residency
requirement. There is in fact a mechanism for voting when you are not resident in the
territory and when you are at a significant distance from Saint Regis Mohawk Tribe.
4. All political and civil rights are
guaranteed by the Constitution to those who are Members of Saint Regis Mohawk Tribe at
Article IV Section I of the Constitution. Essentially, all qualified members are eligible
to exercise their political rights, either as voters, or candidates, unless barred through
Constitutional articles or sections.
Should there be a desire to change the rights
found in the Constitution and restrict who may vote as a member, there is a requirement
that a proper Amendment to the Constitution be made. Article XVI Amendments to the
Constitution requires at least thirty percent of the eligible voters vote in the election
called specifically to Amend the Constitution. Procedures for the process of amending the
constitution were to be enacted as part of the tribal election code.
Any Amendments, whether seeking a Residency
requirement for any elected official, or Member, or to restrict Membership, must be clear,
specific, and have the numbers required to validly amend the Constitution.
C. Zachary Deom -- Chief Judge
POWERS OF THE
ELECTION BOARD: ADVISORY
In advance of the Election of 1999 and in
response to a question from outgoing members of the Election Board and candidates for
Election concerning the powers of the Election Board and the issue of Residency, the
following advisory is given.
1. The residency issue:
In my April 21, 1999, Advisory, I held that
for the purposes of voting, no residency requirement is valid. I stated that a
Constitutional amendment was required in order to change those provisions directly. Any
attempt to legislate laws which would be in conflict with the Constitution would be an
invalid exercise of political and legislative rights.
2. Candidates for Public Office:
To be eligible for public office the
following are requirements under the Constitution:
-validly enrolled member of the St. Regis
Mohawk Tribe
-no convictions within the past five years of felonies
-over 30 years old.
The Constitution has not been amended to
incorporate any restrictions on candidates other than those already in the Constitution.
Therefore, the Constitutional requirements for candidates are what prevails over the
Election Code.
It would be invalid to restrict a candidate
on the basis of residency when the Constitution does not speak of residency as a
requirement. It is finally left for the people who vote to decide the best candidate for
the position.
The Elections Board:
Once a candidate has been nominated and
accepted the nomination, the Election Board is delegated with the job of ensuring that
elections and voting are fair, impartial and in conformity with the Constitution.
The members of the Election Board determine
and certify the eligibility of candidates for office, and approve and certify election
petitions of any kind, certify election results, and referee initial disputes arising
under the election laws.
The Tribal Clerk:
The Tribal Clerk is also the Executive
Director of the Election Board. The Tribal Clerk has no voting power as a member of the
Board, however, the Tribal Clerk must ensure that regulations conform with the
Constitution.
1- The Executive Director and members of the
Election Board have the duty to ensure that the Election code provisions are in conformity
with the Constitution.
2- The Executive Director of the Election
Board shall not be a
voting member of the board.
3- The Executive Director of the Election
Board oversees members of the Election Board with respect to the administration of the
election code.
Should candidates for office be invalidated
on the basis of residency and such requirement as contrary to the constitution, the
Election Board would be in error and that invalidation of a candidate would be invalid and
unfair.
Should voters at the election be disqualified
on the basis of residency, and those voters have failed to register on the qualified
voters list, those voters will be disallowed from voting. Those voters who have registered
themselves and who may not be resident on the US side are entitled to vote.
Please refer to the April 21, 3.999, Advisory
for further detail.
