2022 WATER QUALITY CONTROL PLAN

RESOLUTION OF THE TRIBAL COUNCIL

OF THE PYRAMID LAKE PAIUTE TRIBE

NIXON, NEVADA

the Pyramid Lake Paiute Tribe, is organized pursuant to the provisions of Section 16 of

the Indian Reorganization Act (25 U.S.C. § 476), and is Federally recognized by the

United States Government through the Secretary of the Interior to negotiate with the

U.S. Department of the Interior and the Bureau of Indian Affairs; and

the Pyramid Lake Paiute Tribal Council is the duly-elected governing body of the

Pyramid Lake Paiute Tribe, responsible for enacting laws and regulations, and the

planning and implementation of policy that directly affects the environment, specifically

Water Quality, within the exterior boundaries of the Pyramid Lake Indian Reservation

(PLIR); and,

the Pyramid Lake Paiute Tribe is authorized to promulgate and enforce regulations

governing the conduct of members and on-members within the PLIR; and,

Water Quality Standards (WQS) will provide protection for the physical, chemical, and

biological integrity of water bodies within the PLIR, and will provide the ability to

regulate habitat protection for plant and wildlife species dependent upon the Truckee

River and Pyramid Lake water resources; and,

the United States Environmental Protection Agency (US EPA)-Region IX approved the

Pyramid Lake Paiute Tribe’s application for treatment in the same manner as a state on

January 30, 2007 to administer the WQS and Certification programs under Sections 303

and 401 of the Clean Water Act, giving Program Authority to develop WQS; and,

the Pyramid Lake Paiute Tribal Council approved the 2008 Water Quality Control Plan

(WQCP) for formal submission to the US EPA-Region IX for final approval on September

19, 2008 with Pyramid Lake Resolution PL 66-08, and achieved US EPA approval on

December 19, 2008; and,

the Pyramid Lake Paiute Tribal Council approved the 20015 WQCP for formal submission

to the US EPA-Region IX for final approval on September 16, 2015 with Pyramid Lake

Resolution PL 79-15, and achieved US EPA approval on December 23, 2015; and,

the Pyramid Lake Paiute Tribe initiated the Triennial Review Process of the PLPT WQCP

in Fiscal Year 2022 by conducting multi-year data analysis, and received funds from the

US EPA to conduct Triennial Review activities; and,

Whereas, the Pyramid Lake Paiute Tribe held public workshops regarding the Triennial Review

process of the PLPT WQCP and the proposed changes to the PLPT WQCP; and, gave

presentations to various stakeholder classes regarding the Triennial Review of the PLPT

WQCP and proposed changes to the PLPT WQCP; and,

Whereas, the Pyramid Lake Paiute Tribe held a public hearing on August 2, 2022 on the Zoom

online platform to accept verbal comments regarding the proposed changes to the PLPT

WaQCP, and subsequently responded to all concerns, verbal and written, raised by

persons or agencies regarding the proposed changes to the PLPT WQCP; and,

NOW, THEREFORE, BE [T RESOLVED that the Pyramid Lake Paiute Tribal Council hereby approves and

adopts the 2022 Water Quality Control Plan attached to and incorporated in this resolution; and,

BE IT FURTHER RESOLVED that the Tribal Chairperson or designee is hereby authorized to implement

the intent of this Resolution; and,

BE IT FURTHER RESOLVED that any changes to the foregoing Water Quality Control Plan shall be

through the same resolution process; and,

BE IT FINALLY RESOLVED that the Pyramid Lake Paiute Tribal Council directs the formal submission of

the 2022 Water Quality Control Plan to the US EPA-Region IX for approval.

CERTIFICATION

it is hereby certified that the foregoing resolution of the Pyramid Lake Paiute Tribal Council, governing

body of the Pyramid Lake Paiute Tribe, composed of ten members, of whom nine (9) constituting a

quorum were present at a meeting held on the 7* day of September, 2022 was adopted by the

affirmative vote of eight (8) FOR and zero (0) AGAINST, with zero (0) ABSENTIONS; pursuant to the

authority contained in the Constitution and By-Laws of the Pyramid Lake Paiute Vl tewur,
