1.02 The undersigned Bidder proposes and agrees, if this Bid is accepted, to enter into an Agreement

with the Penobscot Indian Nation (referred herein as Owner) in the form included in the Bidding

ARTICLE 2 — BIDDER’S ACKNOWLEDGEMENTS

2.01 Bidder accepts all of the terms and conditions of the Instructions to Bidders, including without

SECTION 01010

SUMMARY OF WORK

PART 1 - GENERAL

1.01 REQUIREMENT INCLUDED

A. The work to be performed under this Contract shall consist of furnishing all tools,

equipment, materials, supplies, and manufactured articles and for furnishing all

transportation and services, including fuel, power, and essential communications, and

for fulfillment of all labor, work, or other operations required for fulfillment of the

Contract in strict accordance with the specifications, drawings, and other Contract

Documents as herein before defined, all of which are made a part hereof, and including

such detail sketches as may be furnished by the Owner from time to time during

construction in explanation of said Contract Documents. The work shall be complete,

and all work materials, and services not expressly shown or called for in the Contract

Documents that may be necessary for the complete and proper construction of the

work in good faith shall be performed furnished and installed by the CONTRACTOR as

though originally specified or shown, at no increase or cost to the Owner.

1.02 WORK COVERED BY CONTRACT DOCUMENTS

A. Installation of a water service line from the basement or crawlspace of dwelling to the

existing water main, consisting of 1” K Type Copper water service line, 1” curb stop, 1”

corporation and all other appurtenances to make a complete working system. Piping

shall be set at a depth of no less than 5 feet, unless prohibited by physical constraints,

whereby rigid foam insulation shall be applied as directed by the engineer. Detectable

warning tape shall be set 18” below grade.

1.03 CONTRACT PERIOD

A. The CONTRACTOR shall complete the WORK within the time specified in the agreement.

B. Construction work shall not be normally permitted on Saturdays, Sundays, or Federal

and/or Tribal holidays. The CONTRACTOR may submit a written request to the Owner at

least 72 hours in advance, for permission to work on any Saturday, Sunday, or Federal

holiday. Written approval must be obtained before the CONTRACTOR may work on any

such day.

1.04 CONTRACTOR USE OF PROJECT SITE

A. The CONTRACTOR’s use of the project sites shall be limited to construction operations,

including on-site storage of materials and equipment. Further use of the owners’

facilities and storage areas must be approved by the OWNER.

1.03 SURVEY AND MEASUREMENTS

A,

All quantity measurements shall be the responsibility of the Contractor and will be

verified by the project engineer or representative.

All measurements and subsequent payments will be based on completed and

accepted work performed in strict accordance with the drawings, specifications,

and other contract documents.

1.04 PAYMENT FOR INCREASED OR DECREASED QUANTITIES

A.

When alterations in the quantities of work are ordered and performed, the

CONTRACTOR shall accept payment in full at the Contract price for the actual

quantities of Work done. No allowance will be made for anticipated profits.

If the Contractor encounters an unforeseen condition that may require additional

work or affect the Contract Price or Contract Time, the Contractor shall promptly

notify the Owner before proceeding with the affected work. Both the Owner and

Contractor shall approve and execute Change Orders before the associated work

proceeds whenever reasonably practicable.

1.05 INCIDENTAL WORK

A.

Incidental work items for which separate payment will not be made includes the

following items, unless explicitly included as a bid item:

Mobilization and Demobilization

Project record documents

Clean up and restoration of property.

Restoration of fences and other structures.

Cooperation and coordination with other Contractors and utility

companies.

6. Repair and replacement of utility lines, culverts, under-drains, drainage

ditches, pavement or stone driveways or streets, sidewalks, landscaping and

other site specific items damaged by construction activities and

corresponding proper disposal of removed materials unless otherwise paid

for.

Dust and Erosion Control.

Contract administration and insurance.

Pipe Markings.

10. Any other incidental items not specifically listed on bid schedule to make a

complete and working system.

3.04 BEDDING

3.05 HAUNCHING AND INITIAL BACKFILL

A. General:

1. Provide complete and uniform bearing and support for the pipe, including allowance for

bell holes, or structure.

2. Work material under and around the pipe to ensure full pipe support.

3.09 UTILITY CONFLICTS

Protect existing utilities from damage during excavation and backfilling operations.

Provide temporary support for existing water, gas, telephone, power, or other utility services

that cross the trench until backfilling of trench is complete

1. Compact backfill to 95% of Standard Proctor Density under disturbed utilities.

2. Repair or replace any damaged existing utilities, at no additional cost to the project.

Upon approval by the ENGINEER, water and sewer mains may be installed closer than 10

7. Sewer main shall be constructed to water main pressure pipe standards, and successfully

pass a 150-psi pressure test prior to backfilling.

8. Either the water main or the sewer main may be encased in a watertight carrier pipe that

extends 10 feet on both sides of the crossing. The carrier pipe shall be of materials

approved by the regulatory agency for use in water main construction.

3.10 MOVING FENCES AND MINOR STRUCTURES

Remove and reset culverts, drainage pipes or other minor structures that fall within the

alignment of the new construction, to their original location and grade.

Visit the project site and determine actual conditions with regard to the existence of old car

bodies, abandoned houses, fences, driveways, trees, stumps, brush, sidewalks, approaches,

and other miscellaneous obstacles to construction.

1. Unless specifically referenced in a bid item, no separate payment will be made for the

removal or replacement of these items.

3.11 RECORDS

Provide as-builts for all installations, relocations, crossings as per closeout procedures or as

directed by the ENGINEER.

2.02 PIPING AND FITTINGS

A. Copper tubing: 1 inch seamless, thick-wall type L with a minimum wall thickness of

0.045 inches,

1. Only copper tubing is allowed for installations under mobile homes and other homes

without a basement where piping is located in an unheated space.

B. PEX tubing: 1 inch cross linked polyethylene tubing, ASTM F876 and F877, and approved

for use with potable water.

C. Copper tubing fittings: Compression type connections or adapter with union used for

copper pipe equal to those manufactured by Hays Manufacturing Company, A.Y.

McDonald, Mueller Company or Ford Meter Company.

D. PEX tubing fittings: Crimp fittings specifically manufactured for use on PEX tubing.

E. No galvanized fittings are allowed.

2.03 TRACER WIRE AND BOX

A. Wire: Provide #10 AWG jacketed solid copper wire, with 30 mil HDPE coating rated for direct

bury, #12 AWG extra-high-strength copper-clad steel tracing wire, insulated with 45 mil

HDPE, equal to Copperhead #12 (EHS-CCS) Tracing Wire.

B. Box: Tracer wire access box with ABS stand and cast iron top and lockable lid. Valvco

Tracer Wire Access Box, SnakePit Roadway Box, Trace Safe, or equal.

C. Splice Kit: Provide underground waterproof splice materials.

G. Install tracing wire with all pipe.

1. Wrap or tape tracing wire to pipe a minimum of every 20 feet.

2. Make any splices with an underground, waterproof splice kit.

3. Bring tracing wire up along outside of curb stop box.

a. Tape wire to stem of the curb box just below cap.

b. Fold wire back down over tape leaving approximately 12” of extra wire.

4. Termination of the tracing wire:

a. Near home: Terminate in tracing wire box within 3 feet of the home.

b. At service line corp stop: Terminate and wrap around corp stop. Do not connect

to water main tracer wire.

3.02 UTILITY CONFLICTS

A. Refer to Section 02315.

3.03 WATER METER

A. _ Install water meter (as required and approved by the Orono-Veazie Water District) in

accordance with manufacturer’s recommendations.

B. Install at a location within the home as per the requirements and approval of the Orono-

Veazie Water District.

3.04 CONNECTION OF WATER SERVICE LINE TO HOME

A. Connection of the water service line to the home within a heated space shall be done with

similar pipe material as the house plumbing with either copper or PEX tubing as specified.

3.05 TESTING

A. Turn on each corporation stop and apply main pressure to the service line in the presence

of the Engineer or Engineer's representative before backfilling.

1. Option: If a new water main is pressure tested, test the water service lines at the same

time and pressure as the water main. Provisions shall be made to prevent pressurizing

of interior plumbing.

B. Repair all visible leaks and retest the line until test is successfully completed at no cost to the

owner.

C. Test tracing wire for proper functioning using a conductive/inductive type locator in the

presence of the Engineer and/or Owner Representative. Repair and retest, at no additional

cost to owner, any section of tracing wire that does not function properly.

3.06 AS-BUILTS

A. Provide as-built information on each system in accordance with Section 01780. Use

standard forms (if supplied) by the Engineer.

SECTION 02850

ASPHALTIC CONCRETE PAVING

PART 1 - GENERAL

utility construction or otherwise damaged due to any activity related to the work.

QUALITY ASURANCE

A. Comply with all local, Tribal, State and Federal Requirements concerning paving.

B. Use only materials, which are furnished by a bulk asphalt concrete producer regularly, engaged in

production of hot-mix, hot-laid asphalt concrete. The Plant shall conform to ASSHTO M 156.

on Reference Standards

1. Current version of 'Standard specifications Highways and Bridges' Maine Department of

Transportation, and ‘Special Provision, Hot Mix Asphalt Pavement’ by MDOT and

subsequent revisions.

D. Quality Requirements: Comply with al MDOT Specifications.

E. Testing Agency;

1. In place testing to be performed by a testing laboratory employed by CONTRACTOR.

2. Tests on materials to be performed by a testing laboratory employed by CONTRACTOR.

F. Obtain materials from same source throughout.

SUBMITTALS

A. Submit proposed mix design of each class of mix to the Engineer for review prior to

commencement of Work.

B. Submit to the Engineer result of all laboratory tests performed on all mix designs.

ENVIRONMENTAL REQUIREMENTS

A. Apply bituminous prime and tack coats only when the ambient temperatures in the shade is at

least 50° F and when the temperature has not been below 35° F for 12 hours immediately prior to

application.

B. Do not apply when the base surface is wet or contains an excess of moisture that would prevent

uniform distribution and the required penetration.

c. Construct asphalt concrete surface course only when atmospheric temperature is above 40°F,

when the underlying base is dry, and when weather is not rainy.

D. Base course may be placed when air temperature is above 35°F and rising, when acceptable to the

Engineer.

E, The CONTRACTOR shall thoroughly clean the surface upon which Hot Mix Asphalt Pavement is to

be placed of all objectionable material. When the surface of the existing base or pavement is

irregular, it shall be brought to uniform grade and cross section as directed or a specified. All

driveway areas and trench repairs shall be prepared with base materials matching existing

materials and compacted to provide a suitable paving surface.

2.05 PAVEMENT MARKINGS

A. Pavement Marking Paint: Alkyd-resin type, ready mixed, complying with ASSHTO M-248, Type N,

regular dry or Type F, fast dry traffic paint, color to match adjacent markings.

PART 3 - EXECUTION

3.01 GENERAL

A. Install according to MDOT Specification, Sections 401, 403, and other applicable sections

3.02 HOT BITUMINOUS PAVEMENT

A. Conditioning of Existing Surface:

1.

The CONTRACTOR shall thoroughly clean the surface upon which Hot Mix Asphalt

Pavement is to be placed of all objectionable material. When the surface of the existing

base or pavement is irregular, it shall be brought to uniform grade and cross section as

directed or a specified.

2. Base course shall be shaped to a tolerance above or below the required cross sectional

shape of 3/8".

3. Do not place pavement if base or existing pavement layers are wet, excessively damp, or

frozen.

4. Place binder and surface courses to the depth and elevations shown on the Drawings.

B. Weather and Seasonal Limitations: The State is divided into 2 paving zones.

1. Zones

a. Zone 1: All area north of US Route 2 from Gilead to Bangor and north of Route 9 from

Bangor to Calais.

b. Zone 2: All area south of Zone 1 including the US Route 2 and Route 9 boundaries.

2. Bituminous plant mix for use other than traveled way wearing course may be placed in

either zone between the dates of April 15th and November 15th, provided that the air

temperature as determined by an approved thermometer placed in the shade at the

paving location is 2°C (35°F) or higher and the area to be paved is not frozen.

3. The CONTRACTOR may place Hot Mix Asphalt Pavement as traveled way wearing course in

Zone 1 between the dates of May 1st and the Saturday following October 1st and in Zone 2

between the dates of April 15th and the Saturday following October 15th, provided the air

temperature determined as above is 10°C (50°F) or higher.

4. For the purposes of the Subsection, the traveled way includes truck lanes, ramps, approach

roads, and auxiliary lanes.

5. Hot Mix Asphalt Pavement used for curb, driveways, sidewalks, islands, or other incidentals

is not subject to seasonal limitations, except that conditions shall be satisfactory for proper

handling and finishing of the mixture. Unless otherwise specified, the CONTRACTOR shall

not place Hot mix Asphait Pavement on a wet or frozen surface, and the air temperature

shall be 4°C (40°F) or higher.

c. Trucks used for hauling bituminous mixtures shall meet the requirements of MDOT ‘Special

Provision’ Section 401.09.

D. Pavers shall meet the requirements of MDOT ‘Special Provision’ Section 401.10.

E. Rollers shall meet the requirements of MDOT 'Special Provision’ Section 401.11.

F Spreading and Finishing:

1. The mixture shall be laid upon an approved surface, spread and struck off to the grade and

elevation established.

2. Bituminous pavers shail be used to distribute the mixture either over the entire width or

over such partial width as may be practicable.

PAVEMENT MARKING

No marking shall be applied for a minimum of thirty day after paving or unless otherwise

directed by the Engineer.

All pavement lines and markings shall be applied in accordance with the Manual of Uniform

Traffic Control Devices.

Longitudinal lines placed on tangent roadway segments shall be straight and true.

Longitudinal lines placed on curves shall be continuous smoothly curved lines consistent

with the roadway alignment. All pavement markings placed shall meet the dimensions and

layout shown on the plans or as existed in the field prior to the start of work.

Broken lines shall consist of alternate 3 M (10 foot) painted line segments and 9 M (30

foot) gaps.

Temporary pavement markings shall be applied in accordance with the pattern shown on

the plans or as directed.

Newly painted lines, markings, and curb shall be protected from traffic by the use of cones,

stationary vehicles or other approved methods until the paint is dry.

Preparation of Surface: Immediately before applying the pavement marking paint to the pavement

or curb, the surface shall be dry and entirely free from dirt, grease, oil, or other foreign matter.

Application

Prior to applying paint for final pavement lines, the CONTRACTOR shall perform a test for

paint thickness by furnishing and placing a piece of smooth, clean metal with an area of at

least144 square inches (0.1 M2) in the path of the striping truck. The striping truck shall be

passed over the piece of metal, painting the surface as it passes, without applying beads.

The result of this test will be used to determine the pressure setting and speed of the truck

when applying paint to obtain the specified thickness. Additional paint thickness testing

may be required on the final paint markings. The wet thickness of paint without beads on

final pavement lines shall be minimum of 16 mils (0.400 mm).

On other final pavement markings and on curb, where the paint is applied by hand painting

or spraying, application shall be in two uniform covering coats, each at least 10 mils (0.25

mm) thick. Before the second coat of paint has dried, the glass beads shall be applied by a

pressure system that will force the glass beads onto the undried paint as uniformly as

possible.

Glass beads shall be applied to the final and temporary pavement lines, marking the curb

at the rate of 4.5 pounds per gallon (0.54 kg/L) of paint and in sufficient quantity to assure

complete and uniform coverage of hand painted surfaces.

Establishment Period:

1.

Marking material furnished and installed under this contract for final pavement markings

shall still be subject to a six months period of establishment.

The period of establishment shall commence as soon as the markings are complete and in

place and shall continue for six months, At the end of the establishment period, a

minimum of 95 percent of the markings shall still be in place to be acceptable.

if less than 95 percent of the markings are in place after sic months, the CONTRACTOR shall

replace all unsatisfactory markings on the project without additional payment.

Markings designated for replacement shall be installed according to these specifications,

unless otherwise directed.

Markings replaced at the end of the six-month establishment period will not be subject to a

further establishment period.

SECTION 02920

TOPSOILING, SEEDING, FERTILIZING, AND MULCHING

PART 1 - GENERAL

1.01 SUMMARY

A. This section includes topsoiling, seeding, fertilizing, and mulching areas disturbed by

construction activities.

PART 2 - PRODUCTS

2.01 TOPSOIL

A. Material shall be screened loose friable loam, sandy loam, fine sandy loam, free of subsoil,

refuse, stumps, roots, rocks, cobbles, stones, brush, weeds, litter and/or other materials

larger than % inch in any dimension.

Neither excessively acid nor excessively alkaline.

Organic matter shall constitute not less than 5% nor more than 20% of loam.

D. Use of stockpiled topsoil may be acceptable but must be free of refuse, stumps, roots, rocks,

cobbles, stones, brush, litter and/or other materials larger than % inch in any dimension with

approval of Engineer or Representative.

2.02 FERTILIZER

A. Fertilizer shall meet specifications complying with Maine Erosion and Sediment Control

Handbook for Construction.

1. Asoil analysis is required to determine fertilizer and limestone application rates.

Selection of nutrients may be made based on experience and past success with the

approval of the ENGINEER.

2.03 SEED

A. Seed shall meet material specifications complying with Maine DOT Specification Seeds

B. Seed mixture shall be selected based on Maine Standards and Specifications for Erosion and

Sediment Control.

2.04 MULCH AND SEED STABILIZERS

A. Mulch shall meet requirements of Maine Erosion and Sediment Control Handbook for

Construction.

B. Select mulch material and application rate based on site conditions and/or engineer

recommendations.
