PAWNEE NATION FLAG

The miniature stars and stripes of the blue field symbolize America.

The Plains Indian tribes called the Pawnee “Wolves” because of their

cunning and courage. Thus, the emblem of the wolf was created and

retained the double meaning of “Chaticks si Chaticks”or Men of Men.

Crossed on the blue field is a peace pipe and tomahawk; the peace

pipe standing for peace and the tomahawk for war.

Nine arrowheads emblematic of the wars in which the Pawnees fought

in the service of their country; the Indian wars, the Spanish-American

War, World War I, World War II, Korean War, Vietnam War, Desert Storm,

Operation Enduring Freedom, and Operation Iraqi Freedom.

The flag means Pawnee Indians, in peace and war, are always

courageous and loyal to America.

The flag staff is an old time Pawnee lance with a genuine flint spearhead.

The staff has bead work mounted on buckskin opposite the blue field.

The many colors in the bead work symbolize our various ceremonies

and our old people who have gone on before us.

The four prime eagle feathers attached at the top of the flag represent

the four Pawnee bands: Chaui, Pitahawirata, Skidi and Kitkehahki.

A sprig of cedar should be attached to the staff during Homecoming,

Armistice Day, Christmas and on occasions of state. We use cedar in

sacred ceremonies and in prayer. It is a token of prayer and a token

of peace.

Like the flag of the United States, the Pawnee Indian Flag should never

be desecrated and it should never touch the ground.

The Elder Center is seeking Volunteers to assist in the serving of the lunch

meals. If you could use your lunch hour to help serve a few times a month to

assist in giving back to the Tribal Elders, one needs to fill out complete the

Volunteer Agreement Form and return to Human Resources.

Any and all assistance would be appreciated, and can be used as often or

little as you are available. Volunteers that assist during their lunch hour can

enjoy the meal free of charge following the Elder serving time. Volunteers may

work with the Outreach Specialist to conduct home chores, visits, or assist in

the Coordinator in the Elder Garden.

First of all, let me thank the Pawnee

people for electing me as your

President. Service to the Public has

been my career for over 36 years, and

I shall lead with a servants’ heart. The

Pawnee people’s well-being will be

firmly at the forefront of my mind

guiding every decision. It is an honor

to serve in the leadership of our great

Nation and join the past presidents

and chiefs who have safeguarded the

Pawnee Tribe. To everyone: Thank you

I was elected to serve all Pawnee People, and I take that

charge very seriously. While elections can be divisive, I am

calling on all sides to come together so that we may move

the tribe forward. I have been elected in a period where the

tribe has lost millions of dollars, and millions more must be

accounted for. I ran on accountability and transparency, and I

have been diligent to my word by exposing corruption at the

PTDC as bad actors have tried to cover it up. They will be held

accountable. All is not doom and gloom. Like a sickness, the

corruption must be isolated and removed. As a Nation, we will

deal with our issues and move forward.

I have plans and ideas to make the tribe more efficient. I

have called on the PBC to pass employee protections and

whistleblower act. The tribe can increase efficiency, which will

provide more funds to better serve Pawnees. I have plans to

make it easier or Pawnees to apply for and attain employment

with the Nation and any subsidiary. With our recent win in the

FCC case, we would expect some funding to come back to the

tribe again for our cultural programs, though we will have to

wait and see what that time frame will be. I also plan to begin

some serious discussion with the Housing Authority to begin to

build new affordable homes for Pawnees.

I was elected on a platform of transparency, honesty and accountability. A clear majority

of the Pawnee people agreed with my ideas and overwhelmingly elected me to implement them.

I have taken an oath to uphold the laws of the Nation and to protect our Tribal Assets that have

provided jobs and should benefit our people. We MUST protect these assets.

The Pawnee Gaming Commission is delegated the authority of regulating our gaming

operations as both a responsibility and obligation (Gaming Ordinance Sec 3.6).

Thankfully the commission has done just that. Last year they held hearings and interviewed

several individuals who are involved in our gaming operations and oversight, and gaming

licenses were suspended. The findings from these efforts are disturbing and need to be shared

with our people.

The previous administration has kept these findings secret. When it came time for a frank

discussion of these findings with the tribal business committee and the gaming commission

members there were none, it was dismissed by the former president. Now is the time for these

issues to see the cleansing light of day.

These findings have not been remedied to date; it has been over a year.

I strongly urge the Gaming Commission to act on these violations and revoke the licenses

outlined in the report. We will hold the responsible parties accountable for these violations. I

have also reached out to the pertinent federal agencies to make sure action is taken, and our

assets are protected. Please encourage the council to work with me in moving the tribe forward

and find a successful resolution.

Physicians (AAIP) recently held their annual

American Indian Youth Health Career

Immersion Program to provide students

with opportunities in health careers within

Planning Division

The Planning Division is working along with

DHCS Division on developing a treatment

facility. Now, this is just a planning grant.

This grant will assist us in developing

innovated methods to bring a treatment

facility to our region. Roughly, we are

looking at a facility around 28,000 sq. ft.

The treatment facility will be a co-occurring

facility and have three access points

(Outpatient, Inpatient, and Emergency

access). Currently, we are looking for

opportunities to fund the facility. Our team

is developing a market strategy. Next, we

are going to meet with IHS to see what

services they can assist us with. We are

almost finished with our project, and we

are excited about this project. When we

finish with our grant, we will schedule a

community meeting to share our results.

has always been so pleasing to serve, and

we look forward to all the positive changes

CHR and Health Education Update

Greetings from the CHR and Health

Education Program! We have had an

eventful and successful summer with

hosting the annual Pawnee Nation Health

Fair and Blood Drive! We also have a new

staff member that have come aboard this

summer.

The annual health fair is hosted by the

CHR/HE Program with help from other

Pawnee Nation Tribal Employment Rights Office (TERO)

FREE COURSE

Forklift Training – Compliance with

DHCS programs. There were around 361

participants and vendors in attendance this

year. We also worked with the Blood Drive

Institute, and 22 people donated blood

to help save others. This event is always

an exciting and great way to open the

annual Homecoming festivities. Program

staff would like to say thank you to all

programs, vendors, and participants for

another successful health fair!

The CHR/HE Program is excited to welcome

the following new staff member:

Taylor Pratt is the new CHR Generalist. He

is an enrolled member of the Pawnee

Nation. Taylor has previously worked for

the Pawnee Nation Education Division and

Pawnee Indian Health Center. He is excited

to work for the Pawnee Nation again, and

we are all equally excited to have him on

the team.

The Pawnee Nation of Oklahoma is empowered to maintain under any laws of

systems to protect the peace, safety, health, and welfare of the members of the

Pawnee Nation of Oklahoma, provided the concepts of separation of powers is

maintained.

The Constitution is the supreme law of the Pawnee Nation of Oklahoma and

all persons subject to its jurisdiction. The Pawnee Business Council shall

exercise its power consistent with the provisions of this Constitution and the

Corporate Charter of the Pawnee Nation of Oklahoma.

ARTICLE III-MEMBERSHIP OF TRIBE

Section 1. The current membership of the Pawnee Nation of Oklahoma shall consist of:

(a) All persons enrolled or entitled to be enrolled on the official annuity (base)

roll of the Pawnee Nation of Oklahoma as of February 19, 1937; and

(b) All children born of a lawful marriage between members of the Tribe

since the date of said roll;

(c) All children of one-quarter (1/4) or more Pawnee Indian blood born on or

after February 9, 1938, of a lawful marriage of an enrolled member.

Section 2. The future membership of the Pawnee Nation of Oklahoma, after the adoption

of this Constitution, shall include any individual who applies for membership and

possesses at least one-eighth (1/8) degree Pawnee Indian Blood, as amended on January

4, 2003 on Amendment Number 1.

Section 3. The Pawnee Business Council shall have power to prescribe rules and

regulations covering future membership of the Pawnee Nation, including the approval

and loss of membership, provided:

(i)

Such rules and regulations shall be subject to the review of the Nasharo

Council;

(ii)

A person shall not be eligible for membership, if enrolled as a member of

another Indian Tribe.

the determination to promote through marshaled efforts our social, economical and

political advancement, do solemnly ordain and establish this Pawnee Nation of Oklahoma

and adopt this constitution pursuant to the Oklahoma Indian Welfare Act of June 26,

1936 (49 Stat. 1967) which shall supersede the constitution approved by the Secretary of

the Interior on November 26, 1937, and ratified on January 6, 1938, as amended.

ARTICLE I-NAME

ARTICLE II-PURPOSE

Section 1. To secure for the Pawnee Nation of Oklahoma and its members rights, powers,

privileges and benefits of a sovereign nation.

Section 2. To establish its Jurisdiction and Powers.

(i)

The governmental powers of the Pawnee Business Council, acting for the

sovereign Pawnee Nation of Oklahoma shall extend to all persons and to all

real and personal property including lands and other natural resources, and to

all waters and air space, within the Indian Country over which the Pawnee

Nation of Oklahoma has jurisdiction. The governmental powers of the

Pawnee Nation of Oklahoma shall also extend outside the exterior boundaries

ARTICLE IV-PAWNEE BUSINESS COUNCIL

Section 1. The supreme governing body of the Pawnee Nation of Oklahoma shall be the

Pawnee Business Council, which shall consist of eight (8) members.

Section 2. Subject to the limitations imposed by this Constitution and applicable Federal

law, the Pawnee Business Council shall exercise all the inherent, statutory, and treaty

powers of the Pawnee Nation of Oklahoma by the enactment of legislation, the

transaction of business, and by otherwise speaking or acting on behalf of the Pawnee

Nation of Oklahoma on all matters which the Pawnee Nation of Oklahoma is empowered

to act, including the authority to hire legal counsel to represent the Pawnee Nation of

Oklahoma.

Section 3. All acts regarding Membership or Claims or Treaty Rights of the Pawnee

Business Council shall be subject to review by the Nasharo Council in accordance with

this Constitution.

Section 6. Regular quarterly meetings of the Pawnee Business Council shall be held on

the first Saturday in February, June, August and November of each year in a place

designated by the Pawnee Business Council, provided:

(i)

Special meetings may be called by the President.

(ii)

Special meetings shall be called by the President within two (2) weeks after

receiving a written request, by regular mail or by certified and return receipt

mail, from a majority of the occupied Pawnee Business Council positions,

provided:

(a) If the President fails to call and conduct a special meeting as requested

within two (2) weeks, a majority of the occupied members of the Pawnee

Business Council shall be authorized to call and conduct a special meeting

by affixing their signatures to a document listing in detail the need for the

meeting and citing this Section of the Constitution as their authority to

meet.

(b) A minimum of two (2) days notice of all meetings, regular or special, shall

be published in a newspaper and posted in public view. Provided, that in

an emergency, posting in public view for two (2) days shall be deemed

sufficient notice. Notice shall include the agenda.

Section 7. All members of the Pawnee Business Council shall attend tribal constitution

orientation classes as prescribed by the Pawnee Business Council.

Section 4. The present Pawnee Business Council members shall serve until the next

regular election or until their successors are elected and installed provided:

(i)

The Pawnee Business Council shall provide an election commission to

conduct all elections, provided that regular elections are held on the first

Saturday in May of each odd numbered year.

(ii)

No member of the Pawnee Nation of Oklahoma, eighteen (18) years of age or

older, shall be denied the right to vote by secret ballot, either in person or by

absentee ballot, provided that no write-in votes shall be allowed.

(iii)

Members of the Pawnee Nation of Oklahoma, twenty-five (25) years of age or

older, shall be eligible for election to the Pawnee Business Council. Members

of the Pawnee Nation convicted of a felony or dishonorably discharged from

the Armed Forces of the United States of America are ineligible for

candidacy.

(iv)

At the first regular election after the adoption of this Constitution (1999), the

President, Treasurer, and the First and Second Council Members shall be

elected to a four year term and the Vice-President, Secretary, and Third and

Fourth Council Members shall be elected to a two-year term in order to

stagger the terms of office:

(a) Candidates shall declare the position they are seeking.

(b) If there are positions which are vacant due to lack of candidates, those

positions shall be considered vacant and filled according to Article VI.

Thereafter, all members of the Pawnee Business Council shall be elected to a

four-year term of office and shall serve until their successors shall be duly

installed in office. In cases when a vacancy is being filled to complete an unexpired term due to death, resignation, forfeiture, or recall of a Pawnee Business

Council member, a successor will be appointed pursuant to Article VI of this

Constitution.

(v)

A Nasharo Council member shall resign his/her position if elected or

appointed to the Pawnee Business Council.

(vi)

A Pawnee Nation of Oklahoma employee shall resign his/her position if

elected or appointed to the Pawnee Business Council.

(vii) A Pawnee Business Council member shall not be eligible for employment by

the Pawnee Nation of Oklahoma.

(viii) Elected members of the Pawnee Business Council shall be inaugurated and

sworn into office fourteen (14) calendar days after the Election Day.

(ix)

Pawnee Business Council records and all related documentation for each

outgoing Pawnee Business Council member shall be made available to the

newly elected Pawnee Business Council members. Failure to comply shall

result in ineligibility to file for candidacy for the Pawnee Business Council for

ten (10) years or until records and documents are returned.

Section 5. All acts of the Pawnee Business Council shall be determined by a majority

vote of the membership present, provided five (5) members of the Council shall

constitute a quorum to transact business. In the event of a tie, the chairperson or

chairperson pro tem shall cast the deciding vote.

ARTICLE V-DUTIES OF OFFICERS

Section 1. The President shall preside at all meetings of the Pawnee Business Council,

joint meetings of the Pawnee Business Council and the Nasharo Council, and all general

meetings and shall vote only in the case of a tie. The President shall have general

supervision of the affairs of the Pawnee Business Council and shall perform all duties

pertaining to the office of the President. The President shall administer oaths and

affirmations when required or permitted. The President shall be bonded.

Section 2. In the absence of the President, the Vice-President shall perform the duties of

that office. In the case of vacancy, the Vice-President shall succeed at once to the office

of the President. The Vice-President shall be bonded.

Section 3. The Secretary shall, be responsible for the following duties:

(i)

Record the proceedings of all meetings of the Pawnee Business Council and

Nasharo Council, and all special meetings as assigned by the Pawnee Business

Council.

(ii)

Prepare the agenda for meetings of the Pawnee Business Council.

(iii) Maintain all records and files of the Pawnee Business Council. All records

and files of the Pawnee Business Council, except such records as shall be

explicitly made exempt by law, shall be public information to any member of

the Pawnee Nation of Oklahoma.

(iv)

Maintain the Pawnee Nation of Oklahoma official membership roll.

(v)

Attest to enactments of the Pawnee Business Council.

(vi)

In absence of the President and Vice-President, call to order regular and

special meetings of the Pawnee Business Council until a Chairman pro tem is

selected.

(vii) Perform the duties of the Treasurer, in the absence of the Treasurer.

Section 5. $ If a vacancy occurs in a First, Second, Third, or Fourth Business Council

member position before the last six months of a term, it shall be filled by a majority of

Pawnee member voters in a specially called election.

Section 6. $ If a vacancy occurs in a First, Second, Third, or Fourth Business Council

member position in the latter six month of that term, that position shall remain vacant

until the next general election.

Section 7. $ If a vacancy occurs in any Business Council position in the six months prior

to a general election, the specially called election shall be held with the general election.

Section 8. $ Any successful candidate who is elected in a special election shall serve only

the remaining term of that vacant position.

Section 9. $ Unless section 6 & 7 apply, the election Board shall set and conduct a

special election within 60 days but not before 30 days after a position is vacant.

Section 10.  A position is vacant when:

(i)

Subject to an effective date, a resignation is received in writing by the Office

of the president

(ii)

Vacant pursuant to Article VII, Section One

(iii)

Death

(iv)

Recall

(v)

Removal

(vi)

A suspension is imposed under Section 3, in which case a specially called

election is not required if the Business Council finds that suspension is likely

to be resolved within six months. If the Business Council finds that the

suspension is likely to be longer than six months, they may call a special

election. If the suspension is removed, the person elected in the special

election shall step down and the suspended Business Council Member shall

retake their position.

(viii) The Secretary shall be bonded.

Section 4. The Treasurer shall, be responsible for the following duties:

(i)

Receive funds from all sources for which the Pawnee Business Council is held

accountable, and maintain financial records which shall reflect actual receipts

and disbursements of all funds and which shall reflect the financial position of

the Pawnee Nation of Oklahoma.

(ii)

Deposit funds from any and all sources for which the Pawnee Business

Council is held accountable in an insured bank or other approved financial

institution.

(iii)

Disburse by check, the funds from any and all funds for which the Pawnee

Business Council. All checks shall be signed by the Treasurer and

countersigned by the President.

(iv)

An annual independent audit of all funds for which the Pawnee Business

Council is held accountable.

(v)

Present financial status reports and budget reports as determined by the

Pawnee Business Council.

(vi)

Perform the duties of Secretary, in the absence of Secretary.

(vii) The Treasurer shall be bonded.

ARTICLE VI-VACANCIES

Section 1. - In the event of Presidential vacancy, the Vice-President shall temporarily

vacate their office and fulfill the duties of the office of President until another president is

elected by a majority of Pawnee tribal voters in a specially called election. The Business

Council shall elect from the current council membership a Temporary Vice President to

serve until the next President is elected by a majority of Pawnee tribal voters in a

specially called election, at which time the Temporary Vice President shall return to

his/her previous position.

Section 2. $ If the offices of President and Vice President are vacant the Treasurer shall

temporarily vacate their office and fulfill the duties of President and the secretary shall

temporarily vacate their office and fulfill the duties of Vice President. The Business

Council shall elect from the current council membership a Temporary Treasurer and a

Temporary Secretary until the next President and Vice President are elected by a majority

of Pawnee tribal voters in a specially called election, at which time the Temporary

Treasurer and Temporary Secretary shall return to their previous position.

Section 3. $ If the offices of President, Vice President, and Treasurer are vacant the

Secretary shall temporarily vacate their office and fulfill the duties of the President. The

Business Council shall elect from the current council membership a Temporary Vice

President, Temporary Treasurer, and Temporary Secretary until the next President, Vice

President, and Treasurer are elected by a majority of Pawnee tribal voters in a specially

called election, at which time the Temporary Vice President, Temporary Treasurer and

Temporary Secretary shall return to their previous position.

Section 4. $ Notwithstanding Article 4 Section 5, if four or more positions are vacant a

quorum shall consist of all of the remaining members. If all officer positions are vacant

any remaining council members may call a special Business Council meeting, at which

that council member shall chair and the council shall elect officers.

ARTICLE VII-FORFEITURE, RECALL, REMOVAL

Section 1. Forfeiture  If a member of the Pawnee Business Council fails or refuses to

attend two (2) regular or special meetings per year from the date of oath of office, unless

excused by the Pawnee Business Council President for illness or other causes for which

the member cannot be held responsible, his/her office shall be declared forfeited by a

resolution of the Pawnee Business Council and the vacancy shall be filled.

Section 2. Recall  Upon receipt of a petition signed by twenty five per cent (25%) of

the number of voters who voted in the last regular election call for the recall of any

member of the Pawnee Business Council, it shall be the duty of the election commission

to call and conduct within thirty (30) days an election on such recall. Recall shall be

effective only if a majority of those voting shall vote in favor of such recall and that at

least 50 per cent (50%) + one (1) of the number voting in the previous election vote in the

recall election. Once a member has faced a recall attempt, no further recall action shall be

brought against that member until at least twelve (12) months have passed. No member

of the Pawnee Business Council shall be subject to recall action within the first six (6)

 '

Section 3. Suspension:

(i)

A Pawnee Business Council member shall be suspended from the Business

Council without compensation when:

(a) charged with a criminal offense, and

(b) that offense would be cause for removal as defined in Section 4.iv.(a), and

(c) the charging jurisdiction guarantees similar civil rights and due process as

is guaranteed within the Pawnee Nation.

(ii)

The suspension shall be effective from the date of the filing of the charges

until dismissed.

(iii)

It is the duty of the defendant Business Council Member to timely notify the

Business Council and the Attorney General of the charges.

(iv)

A suspended Business Council Member is excused from attending meetings

and other official duty during the suspension.

(v)

Any vote cast or other official action taken after such charges have been filed

shall be valid, but taking such official action while under suspension shall

constitute the crime of unofficial misconduct.

(vi)

The Business Council may by majority vote, with the subject member

abstaining, lift the suspension if it finds that the requirements of paragraph (i)

are not met.

(vii) The suspended Business Council Member may bring a declaratory judgment

action in Pawnee Nation Tribal Court to challenge the application of this

Section.

(viii) If the charges are dismissed because the defendant is found innocent, the

suspension is automatically removed and all withheld compensation shall be

paid without interest.

Section 4  Removal of Pawnee Business Council Members

(i)

Removal for Cause $ Pawnee Business Council members may be removed for

cause by petition filed in Pawnee Nation District Court with right of appeal to

the Pawnee Nation Supreme Court.

(ii)

A petition may be filed only;

(a) by the Attorney General, or

(b) by Resolution of the Pawnee Business Council, or

(c) by any individual or individuals who deposits $10,000 in cash or bond

with the court clerk.

(iii)

Conviction is defined as a final conviction or a plea of no contest or guilty,

whether or not dismissed, pardoned or expunged, and irrespective of whether

it is denominated a felony, misdemeanor, or otherwise.

(iv)

Cause if defined as:

(a) conviction of any of the following offenses in any legitimate governmental

jurisdiction:

A. Fraud

1. Making false representation

2. Knowledge of such false representation by the perpetrator

3. Reliance on the false representation by the person defrauded

4. An intent to defraud

5. The actual act of committing fraud

6. Passing bad checks

7. Knowingly possessing stolen property

B. Evil Intent

(v)

ARTICLE VIII-NASHARO COUNCIL

Section 1. The Nasharo Council shall consist of eight (8) members with a quorum of five

(5) to transact business. Each band shall have two (2) representatives on the Nasharo

Council selected by the members of the tribal bands, Chaui, Kitkehahki, Pitahawirata and

Skidi. The Nasharo Council shall have the right to review all acts of the Pawnee Business

Council regarding the Pawnee Nation of Oklahoma membership and Pawnee Nation of

Oklahoma claims or rights growing out of treaties between the Pawnee Nation of

Oklahoma and the United States, provided:

(i)

Such acts of the Pawnee Business Council shall be valid and valid unless

formally disapproved by the Nasharo Council within thirty (30) days after

such acts are referred to the latter Council;

(ii)

Where such are disapproved by the Nasharo Council, the Pawnee Business

Council may submit them to a referendum of the Pawnee Nation of Oklahoma

and they shall be valid and effective if approved by a majority vote of the

adult members voting in person or by absentee ballot; provided, that, at least

fifty (50) of those qualified to vote shall cast ballots in such election.

Section 2. The Bands of the Pawnee Nation of Oklahoma shall elect their respective

representative under rules and regulations prescribed by the Chiefs of each Band. The

representatives selected shall serve until the next regular selection of members of the

Nasharo Council.

Section 3. Vacancies in the membership of the Nasharo Council shall be filled under

rules and regulations prescribed by the Nasharo Council.

Section 4. The Nasharo Council shall have the power to establish its own offices and to

designate its own officers, to fix is own meeting days, and to adopt its own rules of

procedure; provided a quorum is present to transact business. Records of the proceedings

of this body shall be kept.

Section 5. All members of the Nasharo Council shall attend tribal constitution classes as

prescribed by the Pawnee Business Council.

4. Taking part in conspiracy (or attempting to take part in a

conspiracy) to commit a crime listed in this Section.

(b) Willful neglect or refusal to fulfill statutory duties.

(c) Intentional conduct reflecting very negatively on the dignity and integrity

of the tribal government.

Court Review

(a)The District Court shall review the removal petition in a new trial. The

Judge must hold an initial hearing within 30 days and resolve the case

within 90 days. The petitioner must prove the facts by clear and

convincing evidence. Any party to the case shall have a right to appeal.

(b) The defending Council member may be represented by Counsel. If the

Court denies the petition then the defending Council member shall be

awarded costs and attorney fees not to exceed $10,000.00.

(c) If the petition was filed by Business Council or the Attorney General the

cost of attorney fees shall be paid from tribal funds. If the petition was

filed by an individual the cost of attorney fees shall be paid from the

deposit. An exonerated Council member charged under paragraph (iv) (b)

or (iv) (c) of this Section shall not be charged again under such paragraph

until more than twelve months have passed since the previous petition was

filed.

(d) If a petition filed by individual(s) is successful then their $10,000 deposit

shall be refunded. If the attorney fees of a winning defendant are less than

$10,000 then the balance shall be refunded.

ARTICLE IX- COURTS

Section 1. Establishment of A uthority - The judicial power of the Pawnee Nation of

Oklahoma shall be vested in the current Pawnee Nation Courts established by Resolution

93-65 and shall consist of five Justices and at least one trial court, known as the District

Court, and additional courts as may be established by tribal law. The courts shall be a

separate branch of government.

Section 2. Jurisdiction $ The Courts of the Pawnee Nation of Oklahoma shall be courts

of general jurisdiction and shall further have jurisdiction in all cases arising under the

constitution, laws, and treaties of the Pawnee Nation of Oklahoma. The Supreme Court

shall have original jurisdiction in only such cases as may be provided by law, and shall

have appellate jurisdiction in all other cases.

Section 3. Selection of Judicial O fficers $ The Justices of the Supreme Court and

Judges of District Courts shall be selected by a majority vote of the Business Council.

Justices and Judges may by Supreme Court rule assume the duties of a member of the

other court to hear a specific case in which the regular Justices or Judges are disqualified

or are otherwise unable to perform their duty as to the case.

Section 4. T erm of O ffice $ The Justices and Judges of the Pawnee Nation of Oklahoma

shall serve six year terms beginning at the date of their confirmation in office and

continuing if reconfirmed or until their successor shall be duly confirmed and installed.

Section 5. Removal $ Justices and Judges of the Pawnee nation of Oklahoma may be

removed from office only by a majority of the other active Justices and Judges sitting

together upon a showing of habitual neglect of the duties of office, oppression in office

Interior, so long as such approval is required by Federal law, and ratified by the adult

members of the Nation.

for personal gain or advantage, or for cause as defined in Section 4, D. In no case may a

judicial officer be removed from office because of his decision in any case before the

Court.

Section 6. Judicial Review $ The Courts are specifically authorized to review, in any

case properly before them, the actions of the Business Council, or any other officers,

agents, or employees of the government of the Pawnee Nation of Oklahoma to determine

whether those actions are prohibited by Federal law, this constitution or the laws of the

Pawnee Nation of Oklahoma. If the action complained of is outside the scope of

authority delegated to entity in question, or if a proper authority is being exercised in a

prohibited manner, the Court may enter injunction or other proper equitable relief or

declare the action unconstitutional and void as justice may require.

Section 7. E ffective date, Interim Provision $ This article shall be effective upon

approval in accord with Article X. The Business Council shall thereafter have the

authority to enact such laws as may be necessary for the full and proper functioning of

the Courts of the Pawnee Nation of Oklahoma not inconsistent with this article. All

current laws regarding courts shall remain in effect and as amended to the extent that they

do not conflict with this Constitution.

Section 8. Court F unding $ The Court shall be funded in a reasonable amount in the

annual budget.

1. Court funding shall be equal to or exceed funding amounts for

fiscal year 2007.

2. In the event that overall funding shortfalls require budget cuts, the

court budget may be reduced but proportionately not more than any

other department.

ARTICLE XII-PLACE OF MEETINGS

Unless some other location in the Pawnee Nation of Oklahoma jurisdiction is designated

in the notice, all meetings of the Pawnee Business Council and of the Nasharo Council

shall be held at the Pawnee Nation Reserve at Pawnee, Oklahoma.

ARTICLE XIII-ADOPTION

This Constitution when approved by the Secretary of Interior, shall be submitted to

referendum vote of the adult members of the Nation, and shall become effective if

approved by two-thirds vote of the adult members voting in person, provided that at least

fifty votes are cast.

ARTICLE XIV-SAVINGS CLAUSE

All enactments of the Nation adopted before the effective date of this Constitution shall

continue in effect to the extent to that they are not inconsistent with this constitution.

ARTICLE XV-SEVERABILITY

If any part of this Constitution is held by the Federal Court to be invalid or contrary to the

U.S. Constitution or Federal law, the remainder shall continue to be in full force and

effect.

CERTIFICATE OF APPROVAL

I, NANCY JEMISON, Acting Deputy Commissioner of Indian Affairs, by virtue of the

authority granted to the Secretary of the Interior by the Oklahoma Indian Welfare Act of

June 26, 1936 (49 Stat. 1967) and delegated to me by Secretarial Order No. 3150 as

extended by Secretarial Order No. 3177, as amended, do hereby approve the Constitution

of the Pawnee Nation of Oklahoma. This Constitution is effective on the date ratified by

the adult members of the Pawnee Tribe of Oklahoma; PROVIDED, that nothing in this

approval shall be construed as authorizing any action under this document that would be

contrary to Federal law.

ARTICLE X-BILL OF RIGHTS

Section 1. All members of the Pawnee Nation shall enjoy without hindrance freedom of

worship, conscience, speech, press, assembly, and association.

Section 2. The Constitution shall not in any way alter, abridge or otherwise jeopardize

the rights and privileges of the Pawnee Nation as citizens of the State of Oklahoma or of

the United States. The Indian Civil Rights Acts of 1968 (ICRA) and rights guaranteed

under this Act is applicable to the tribal members and other persons within tribal

Section 3. The individual property rights of any member of the Pawnee Nation shall not

be altered, abridged or otherwise affected by the provisions of this Constitution and ByLaws without the consent of such individual member.

ARTICLE XI-AMENDMENTS

Amendments to this Constitution may be proposed by a majority vote of the Pawnee

Business Council or by a petition signed by at least fifty (50) of the adult members of the

Pawnee Nation of Oklahoma.

This Constitution may be amended by a majority vote of the qualified voters of the

Pawnee Nation voting in an election called for that purpose by the Secretary of Interior

and conducted pursuant to the rules and regulations of the Pawnee Nation of Oklahoma.

Provided, that, at least fifty (50) of those qualified to vote shall cast ballots in such

election. The amendment shall become effective when approved by the Secretary of

John Thomas Lefthand

October 3, 1986 - June 12, 2019

32 of Tampa passed away on June 12th 2019.

John was born October 3rd 1986. He was a very

intelligent outgoing, and enthusiastic person

who was well travelled. John took pride in being

the greatest Uncle he could be. He majored in

Women’s studies at USF. He worked as a store

manager at Walgreens for many years starting

at a very young age. He always made sure his

family would never go without. John is survived

by his mother Georgia Lefthand, sister Audrey

Cunningham, Niece Ashtyn Miller, nephews

Avree and Ashtyn Miller, and extended family.

children, Kirk, Kristen and Kathryn. She happily

lived out her days in San Diego near her children

and grandchildren. She loved spending time with

them and was a dedicated member of the San

Diego Church of Christ.

Lynn Kristen Lester, and Kathryn Lindlan along

with her husband Tim. She will also be fondly

remembered by her five grandchildren, Claire,

Charles, and Charlotte Lester and also by Luke

and Sarah Lindlan. A graveside memorial was

held on Monday July 1st at the Summit View

Cemetery in Guthrie, Oklahoma.

Wanda Lester-Seck

March 13, 1936 - June 21, 2019

Beloved mother and grandmother, Wanda

Louise Lester-Seck passed away peacefully

at home in San Diego California on June 21st,

2019 at the age of 83 years. A native of Guthrie

Oklahoma, she was the daughter of Wayne and

Marie Eshelman.

Wanda was a devoted mother raising her three

Alfred Paul Frejo son of Sam Ascension Frejo

and Leota Littleeagle Frejo has passed away at

the age of 77 in Oklahoma City Saturday July 6,

2019. He was born March 16, 1942 in Pawnee,

Oklahoma. Hes a member of the Pawnee

Nation of Oklahoma and of Mexican descent.

Al was a proud graduate of Capital Hill High

School and attended Chilocco Indian School

Vo-Tech Program. He studied at Okmulgee

Tech and worked for IHS in Oklahoma as a

Facilities Engineer Tech where he retired. He

was a U.S. Veteren, certified mediator, Grief and

coping skills facilitator (Calm Waters), T’ai Chi

Master, DJ, Softball and Basketball Coach, aka

Coach Frejo.

He is survived by his 5 children Brian Frejo,

Connie Frejo, Happy Frejo, Lucky Frejo, Marcus

Frejo and 12 grandchildren. Al touched many lives

with his Positive, Encouraging, Compassionate,

Strength and Kind Hearted Spirit. Family, Friends

and Acquaintances were invited to the Wake

Service Monday, July 8th at 7:00pm at Glorieta

Baptist Church. The funeral was held Tuesday

July 9th in Pawnee, Oklahoma. Services started

at 10:00am at Pawnee Nation Roundhouse.

Marshall Gover

November 17, 1946 - July 11, 2019

Pawnee Nations’s former President Marshall

Gover’s had impressive careers. He has fought

at the front lines of Direct Service Tribes, tribal

public health issues, and veteran’s affairs

issues. President Gover is a Marine combat

Vietnam Veteran who served two tours in

Vietnam honorably. During his tenor, President

Gover has proven himself as a fearless leader

as a Councilman, Vice President, and former

President of the Pawnee Nation of Oklahoma.

He provided to the United States Congress

that the Pawnee Nation meets all definitions of a

Federally Recognized Reservation in the State of

Oklahoma. Marshall Gover was approved by the

BIA Field Solicitor, which began the first-ever tribal

Road Maintenance Program created and owned

by a reservation in Oklahoma. He worked with

IHS officials on the HHS Secretary’s Technical

Advisory Committee, served as a member of

the Pawnee Service Unit Health Board, served

on the Southern Plains Tribal Health Board, the

Direct Service Tribe Advisory Committee, and

various other national committees. President

Gover was one of few Tribal Leaders who met

with President Obama on Health Disparities

concerning American Indians and Alaska

Natives. He worked with IHS to prove line item

monies that can be moved the same as Self

Governance in three line items: dental, mental

health, and clinics and hospitals.

Because of his work with Direct Service Tribes

and American Indian Veterans, he was awarded

the IHS Director’s Special Recognition Tribal

Leadership Partnership Award, AARP Indian

Elder Award, he has been honored by the U.S.

Veterans Affairs, and in 2016 the Direct Service

Tribes Advisory Committee honored him with

the Carole Anne Heart award at their national

awards ceremony. President Gover has been a

small business owner and is a master silversmith

and artist, with his work currently being displayed

in the Chicago Field Museum. He served as a

two-time drum keeper and Vice President for

the Pawnee Indian Veteran’s Organization, was

a lifetime Tail dancer for the Skidi war dance,

and sat on the Advisory Committee of tribal

leaders and veterans for the Smithsonian’s

National Native American Veterans Memorial

that is located prominently on the National Mall

in Washington, D.C. His strength comes from his

lovely wife, Jaci.

Marshall is survived by his wife Jaci Gover, his two

daughters; Jacqui Robb and her husband Kent

and Jenifer LittleSun and her husband David; his

sisters, Joy White and her husband Bob, and Ada

Barber and her husband, Robert; step-children

Crystal DeLeon and her husband Gilbert, Jay

Zito and his wife Brenda; grandchildren, Logan

Robb, Taylor Robb, Carter Robb, Alexia Zotigh

ShieldChief, Kaydee Zotigh, Nicole Alcorn,

Shelby LittleSun, Anthony DeLeon, Dylan

DeLeon, Dominic DeLeon, and many, many

other great-grandchildren, nieces, nephews. He

is preceded in death by his parents, Stephen

G. Gover, Vera F. Gover, his brother Stephen

C. Gover, his sister Aline A. Hyatt and his stepson Michael-Paul Culbertson. In his free time, he

loves to laugh and tease with family and friends,

as well as participate in Pawnee ceremonies and

war dances.

Pawnee, Oklahoma. Prayer

Service and Wake was held at 7:00 pm, July 17, 2019, at

the Roam Chief Hall, Pawnee, Oklahoma. Final resting

place North Indian cemetery, Pawnee, Oklahoma. Funeral

will be under the direction of Poteet Funeral Home.

Officiated by Pastor Josh Leading Fox.

Yvonne was a loving and caring Mother, Grandmother,

and Great-Grandmother. Devoted to her family, she lived

a life of self-sacrifice for others rather than herself. Her

commitment to her health career and the care of others

has touched the lives of many in the communities she

lived and worked in. Her nursing career took her to

California, Denver and Colorado Springs, Colorado, Enid,

Oklahoma, Lawton, Oklahoma, Oklahoma City, Oklahoma

and her hometown of Pawnee, Oklahoma.

Yvonne was the eldest daughter of Chester Leading Fox

and Lillie Carson, and she was born on November 26,

1936. She was 82 years old. Yvonne was a proud member

of the Pawnee Nation - Skidi Band, and descendent of

the Iowa and Otoe-Missouria Nations. She cherished all

the memories and loved all of her Indian people. Yvonne

started her young life at Pawnee “Gravy U” Boarding

School. She left immediately for Haskell Institute in

Lawrence, Kansas. Upon her graduation at Haskell,

Yvonne continued her education at Saint John’s Nursing

Academy, where she completed all requirements with

high honors. At this point in her life, Yvonne was pressed

by the Holy Spirit to become a Nun within the Catholic

Church. Her loving Grandmother, Mary (Maw) DupeeIrving, stressed to her Granddaughter that there were

other paths to serve mankind in caring ways. Yvonne

chose Nursing and health care for the sake of humanity,

yet, owed her life servitude to Jesus Christ.

Yvonne is survived by her children, Joe Bruce Kaulaity,

Carol Kaulaity of El Reno, Lillie Kaulaity-Nelson of Lawton,

Mary Kaulaity of El Reno, Sandra Kaulaity-Kelley of OKC

and adopted son Jake Adams Leading Fox of Pawnee.

She is survived by her sisters; Hazel Downing and Kay

Leading Fox, and brothers; Charlie Leading Fox, Chester

Leading Fox, Greg Leading Fox, Pratt Leading Fox, Pat

Leading Fox, Lance Leading Fox, Chris Leading Fox, and

her son in laws; William Nelson Sr. and John Kelley.

Yvonne leaves behind her sweet loving legacy to

her eighteen (18) Grandchildren and her twenty-five

(25) Great-Grandchildren. Indeed, a Good Mother,

Grandmother, and Great-Grandmother passed through

us all.

Elizabeth “Maw” Dupee-Irving, her parents; Father

Chester Leading Fox and Mother Lillian Mae Carson, her

son; Michael James (Skidi) Kaulaity, her sisters; Darlene

Alexis Joy Warrior

July 24, 1959 - July 18, 2019

Alexis Joy Warrior passed away on July 18th, 2019 in

Oklahoma City one week shy of her 60th birthday. She

was born to Melvin Collins Jr and Emalyne Horsechief

Collins on July 24th, 1959 in Pawnee, Oklahoma.

Alexis grew up in the Ponca City area, graduating

from PoHi. On February 11th, 1979, Alexis married her

soul mate, Dominick Warrior, in Wichita, Kansas. They

were able to enjoy thirty-one years together before he

passed on August 2010. Dominick supported her in

receiving two associate degrees from NOC; one in Child

Development and one in Business Administration. These

degrees served her well with her calling as the Director

of Early Child Development for the Ponca Nation Tribe

Headstart and Day Care. From 2007-2012 Alexis ran both

establishments on her own. She also brought the daycare

up to a two-star recognition from DHS.

Alexis is fondly remembered for her loving, compassionate,

honest, forgiving and giving qualities. She was there for

everyone she knew. She believed in people and thought

everyone deserved a chance. Alexis had the ability to see

the good in everyone. She was a true rock for those who

knew her. She made a great difference for all the children

under her care, but her grandbabies were her world.

Left to mourn her passing are her daughters; Lyndsey

Warrior, Domico Warrior, Yvonne Warrior, and Dominique

Warrior, grandbabies; Azariyah Warrior, Kaden

Warrior, Solomon Warrior. Mihonga Roughface, Jeriah

Buffalohead, Mikah Buffalohead, David Ray Warrior,

Vinola Warrior Hernandez, Dominique Tsoodle, Suzacha

“Mona” Buffalohead, Matthew G Buffalohead, III and

Sevetlana Tsoodle, sisters; Deborah Overland, Laura

Jones, and Melvina Collins, brothers; Melvin Collins and

Mark Collins. She is preceded in death by her husband;

Dominick Warrior, and parents; Melvin Collins, Jr and

Emalyne Horsechief Collins.

Funeral services in Alexis honor were held at 10 am

Sunday, July 21st, at the Ponca Indian Cultural Center in

White Eagle with Pastor Bruce Johnson presiding. Burial in

the Ponca Indian cemetery followed. Services concluded

with the tribal feast at the cultural center. Casket

bearers were; Solomon Warrior, Kaden Warrior, Jeriah

Buffalohead, Brett Eppler, Dusty Collins, and Michael

Smith. Honorary casket bearers were; Mark Collins, Matt

Buffalohead III, Melvin Collins, Mike Page, James LeClair,

Wayne Criesforribs and Steven Gomez.

the last Friday of the month before the

Chief Judge of the District Court. The

Pawnee Nation District Court Judges will

determine if any active cases will need

to be transferred to another Judge. The

Pawnee Nation Prosecutor and Public

Defender will appear on the Chief Judge’s

docket the last Friday of every month,

unless otherwise appointed.

for the current Associate Judge, Phillip

Lujan, appointed by Pawnee Business

Council, will end on September 27, 2019.

Kaeson Augustine a pawnee, seminole, navajo and mexican will be

appearing on a new series called #PsychicKids on the A&E Network

starting Aug. 21st thru Sept. The show focuses on youth with spiritual

gifts and the paranormal. Kaeson is the son of Marcus Frejo and a

pawnee descendant of Big Axe, White Eagle, Red Fox, Leading Sun,

Little Eagle and Paul Little Eagle. On his Seminole side Black Tiger.

Pawnee Seed Preservation Project Summer Internship

Sky Seeing Leading Fox recently had the opportunity

to work with the Pawnee Seed

Preservation Project. Starting, she

did not know what to expect, and she

knew nothing about the project or

anything about corn.

When Sky Seeing Leading Fox arrived

in Nebraska, she immediately got to

work on the corn and made fences

to help protect the corn from the

storms that night. Ronnie and Kahheeta taught her a

lot about the corn. She learned the

basic anatomy of the corn and how to

document and photograph the corn.

Sky Seeing Leading Fox learned about

the different varieties of Pawnee corn

and what makes them different from

each other. She can say after her first

internship with the Pawnee Seed

Preservation Project; she is more

aware and appreciative of the project.

Title VI Thoughts

Elder Advisory Board update: President

Blade McLendon, Secretary Kathy Wichita,

and Treasurer Ann Collins invite elders and

caregivers to attend the monthly meetings

held on the fourth Thursday every month

following breakfast at 10 am.

Planning Time: Staff will be focusing on

conducting a needs assessment to go along

with our program design for the 2020-2023

applications for the Elder Program.

have questions for the Elders, please feel

welcome to post a question for them on

our Facebook. We will be sure to have an

elder respond!

Helping Hands of the Elders-Helping-Elders

have conducted homebound visits, getting

fragile elders out and about to go shopping

and socialize at the Elder Center. We are

harvesting from our gardens and Helping

Hands have been shelling beans for the

pantry. Also (17) elders are attending

Pawnee County Farmer’s Market every

Friday … eating fresh!

Quality Movie style Popcorn: Before

too long we will have popcorn available

at the Center every Friday for your home

movie night! Donations for the popcorn are

welcome to support Elder outings. They

would like to go to Oklahoma City to take

in the museums and art galleries.

Volunteers are welcome … Seniors come

on by and join us at the Elder Center (901

Agency Road) Monday – Wednesday noon

meals and Thursday breakfast at 9 am.

Pawnee Seed Preservation Project Summer 2019 Narrative -Kahheetah Barnoskie

Another exciting summer for the Pawnee

Seed Preservation Project. As it has for

the last couple summers, the Pawnee

Seed Preservation Project (PSPP) has

worked with farmers and friends from the

Pawnee homeland to grow the ancient

Pawnee corns in

Nebraska. These

farmers

work

hard to grow our

Pawnee

corn,

returning every

kernel they grow

back in the fall.

And this was

a tough year for growing. Many intense

storms brought flooding throughout

Nebraska this year, causing so many crops

to be planted late

or not at all this

spring.

Luckily

this year, PSPP

had over a dozen

gardens growing

Pawnee corn in

its homeland this

year.

This

summer,

PSPP had two

Pawnee interns

up in Nebraska

helping maintain

and document

Pawnee

corn

gardens;

a

handful

of

Summer VISTAs

working

with

Pawnee Nation

College

to

maintain Pawnee

gardens

in

Oklahoma; and

many volunteers lending a hand in the

gardens, at events, at farmers markets,

and with the processing and selling of the

Pawnee cornmeal. Thank you to all those

awesome people!

And another special thank you to an

amazing friend and sponsor of the Pawnee

Seed Preservation Project, Heather Henson.

Heather recently bought some prairie

land in Nebraska along the Platte River.

The

summer

VISITAs got to

visit and help

with an ongoing

plant survey on

that land this

summer guided

by new friends,

The Crane Trust. To aid with Pawnee visits

to this land, and other homeland sites,

Heather also

graciously

donated two

beautiful yurts

to the PSPP.

One of which

was assembled

and available to view at the Pawnee Indian

Veterans Powwow.

So, as the summer comes to an end, the

Pawnee Seed Preservation Project looks

forward to autumn and the harvest season.

as there will be another fun Fall Harvest

event this year in October after the harvest

in September.
