Motion to adopt the House Rules by Maple Stuivenga, seconded by Dallon Wheeler Sr., motion carried.

Amendment to the House Rules to add rule #14 that don't diminish the rights as individuals as a tribal member of

the Nez Perce Tribe. Motion maker withdrew the motion.

Motion to adopt the agenda by Maple Stuivenga, second by Marilyn Bowen, motion carried.

Subsidiary motion by Maple Stuivenga, seconded by Mary Jane Souther to recess for lunch at 11:00 am and

reconvene at 1:00 pm for River James Walker and to include the auditors during the NPTEC Treasurer's report,

motion carried.

Motion to dispense of reading of the minutes by Maple Stuivenga, seconded by Dallon Wheeler Sr., motion

Motion to adopt the draft minutes with corrections Fall 2011 General Council Minutes by Mary Jane Souther,

seconded by Glen Jackson, motion carried.

Resolutions Committee Report - Danae Wilson

Motion by Cassandra Kipp, seconded by Lee Bourgeau to adopt resolution regarding trespassing on tribal

land, motion carried.

Erik Holt - that Law Enforcement and Jurisdiction be taken into consideration.

Dane Wilson (response) ~ the resolution does state law enforcement.

Mary Jane Souther - that the Talmaks & Mud Springs Encampment be included in the trespassing.

Chairman Moffett — will ensure that it includes ALL tribal land whether it is trust or individually owned.

Motion by John Strombeck, seconded by Helen Strombeck to table the draft resolution impact feasibility

study, motion defeated.

Motion by Bernice Moffett, seconded by Erik Holt to adopt the draft resolution on the impact feasibility

study, motion carried.

Motion by Carla Timentwa, seconded by Alene Powaukee to Nez Perce Tribal Executive Committee

(NPTEC) to look at the budget line item public relations to move funds to implement the feasibility study for

this fiscal year 2011 and not to exceed $25,000, motion carried.

Chairman's Report

Implementation of the Settlement Agreement: The United States agreed to pay the Nez Perce Tribe

approximately $95.8 million over seven years beginning in FY2007. So far, Congressional funds of the

Snake River Basin Adjudication (SRBA) settlement funds is on track. From FY07 through FY10, the BIA

received $61,853,336 in trust for the tribes. On August 2, the Secretary of Interior approved our application

to take the SRBA settlement funds out of trust and our proposed management plan for the funds. On

August 5th, the BIA closed its SRBA accounts and transferred $62,615,431.04 to the Merrill Lynch who will

be the investment manager for the funds.

In December of 2006, the Tribe filed two complaints against the United States based on its

mismanagement of the Tribe's funds and other assets that are held in trust by the United States. We are

represented by Native American Rights Fund in both cases, and both courts are in Washington, DC.

Indian Health Care Improvement Act Implementation (IHCIA) ~ Indian Health Service & Health Human

Service working with tribes on how to best implement all of the provisions.

Questions

Shelley Higheagle — would like to know the information of the audit on the Nez Perce Tribe's Higher

Education Program.

Chairman Oatman response — That will be covered in Treasurer's report in the auditor's report.

James Lawyer — two concerns on the Snake River Basin Adjudication (SRBA) implementation and the

Rapid River land purchase,

Laura Major — the investment on the SRBA

Chairman Oatman response — the funding that we have received to date from the SRBA settlement

Treasurer's Report

Questions:

Justine Miles - February the city of Lapwai fees for water, sewer, & garbage. The Contractor was at the city

council meeting. Who is responsible for the wastewater treatment program and who is funding it? Who is

the principle interest on the wastewater? Is it the Tribe or city of Lapwai residence?

Treasurer Moffett - The owners of the facility will be the Nez Perce. The design and construction was paid

by the Nez Perce Tribe. The city of Lapwai will be billed by the Tribe and that may the reason for the

increase on fees on the water, sewer, & garbage.

Kay Kidder — A feasibility study has already been conducted

Jackie Taylor - Gaming revenue 65% goes to the Tribal government. What is it utilized for? How much

goes to the maintenance of the casino and the Express store.

Treasurer Moffett — page 106 .15% will go to improvement for the casino. Marketing study on the Ahtway

Plaza. The Enterprises currently conducted interviews for contractors

Shelley Higheagle - NPTEC salaries. Is it true their salary is 1.65 million? Where does the money come

from for NPTEC travel?

Mary Tallbull- in 2009 per capita for two payments of $1500 one to be dispersed in December 2009 and the

second June 2010. To date we have only received one per capita payment of $1000 in December 2009.

This payment did not come from our gaming allocation. What happened to the 17 million dollars that was

reported from the Gaming Enterprise budget and why have we not received our second per capita?

Nancy Wheeler ~ What is the reasoning

Annual budget proposals. Charitable line item.

Jennifer Oatman — that the Nez Perce Tribe Executive Committee (NPTEC) fo include in the next fiscal

year budget an honor flight for World War II veterans.

Motion by Mary Tallbull, seconded by Shelley Higheagle that NPTEC provide a full financial report of their

travel from FY09 to present and what was beneficial of them going on travel by Friday, May 6, 2011

aftemoon, motion carried.

Subsidiary motion by Lee Bourgeau, seconded by John Strombeck that NPTEC provide reports on their

travel and that these reports are to be mailed out with the NPTEC minutes, motion carried.

Motion by Sarah Sedgwick, seconded by Mary Jane Souther to go into Executive Session while the

auditors give their reports, motion carried.

Motion by Maple Stuivenga, seconded by Glenyce Jackson to come out of Executive Session, motion

carried.

Motion by Maple Stuivenga, seconded by Glenyce Jackson to accept and excuse the Treasurer's report,

motion carried.

Motion by Julia Davis-Wheeler, seconded by Maple Stuivenga to accept and excuse the Merrill Lynch

report, motion carried.

Meeting called to order at 8:52am by Chairman Elliot Moffett

Public/Private Sector Reports

Rebecca Miles, Executive Director, Nez Perce Tribe:

A short written report on page 16. The fiscal year starts October 1 to September 30.This General Council

you have received a full year report.

David Holt ~ SRBA, Sewer/Water Waste Project, Right of way, &

James Lawyer — Restore the voucher program and the meal for the Seniors Program.

Rebecca Miles ~ She informed Jackie McArthur fo get the meal program going for the Senior’s Program.

Reimbursement will speak with James personally on the issue. Funding we will had to give back.

Mary Jane Souther — one of our richest assets on our reservation is our children. Would like to have a

better confirmation that we are going to protect our children within our tribal community and our tribal

homes, Children are being put in “white” homes and children are being taken home to staffs residence. To

get a task force going for the protection of our children.

Rebecca Miles (response) — A draft reunification plan. We are past the task force and actually in the

implementation plan.

David Penney ~ A meeting in Lewiston and some of our children are not covered under the Indian Child

Welfare Act (ICWA) of 1978. A resolution was passed in 2007 for tribal enrollment membership. Where is

the report of the enrollment survey, what is the timeline? The report was supposed to be given this General

Council.

Roberta Bisbee (response) — A report is on the back of the table of the tribal enrollment survey,

Motion by David Penney, seconded by Bernice Moffett to have a meeting on Saturday of the 2011 Fall

General Council to take action on the findings on the tribal enrollment membership and from that meeting

as a General Council to take it to a vote at the Spring General Council, motion carried.

Brooklyn Baptiste — Intermission for the Treva Ellenwood family. Honor song and monetary donation

conducted.

Chairman Moffett - What steps have been taken in regards to employment? Who is in charge of

employment? Who is concerned the unemployment rate’? What is the unemployment rate and what is being

done about that?

Rebecca Miles — Are you asking me as the tribal citizen or as a General Council Chair?

Chairman Moffett - | am asking as the General Council Chair? Resolution were brought to NPTEC and just

ensuring they are being funneled through to your office. Are there steps being taken?

Rebecca Miles — | have taken a lot of the burden off the Human Resource department. Require a thorough

explanation of the recruitment file from the Human Resource Manager. Ensure that policies and procedures

are being followed. | was directed by Nez Perce Tribal Executive Committee (NPTEC) that comes through

my chain of command. To make sure that tribal preference is being considered. We are very close to

Nez Perce Tribe General Council - 2011 Spring Meeting Minutes Page 4

adopting a universal human resource manual.

Susan Broncheau — | am an Orofino resident and concerned on the water & sewer for the Orofino

residences. What is going to be done about the water pollution?

Liz Arthur-Attao ~ Passed a resolution at the Fall General Council on the raise in the water, sewer bill.

Never heard about the resolution on the assessment of the raise in the bills.

Rebecca Miles - Looked at that the resolution. How we do our collections? Three different locations

(Kamiah, Lapwai, & Orofino) — they are all separated in the billing. Directed to subsidize the billing.

Zeke Domebo — | see alot of championship players in here. In order to be a successful team we need to

utilize teamwork (working together). Stay positive and work together, we will succeed.

Laurie Ann Smith - Soliciting and advertising for a position on the Utility Board. Put your name in so you

can address these issues and learn the procedures of the billing.

Carl Oatman Sr. — If Nez Perce Tribal Executive Committee (NPTEC) is going to say that we are sovereign.

Then need to practice making these laws. No jobs for the tribal members that live upriver. Why are we

giving up laws and opportunities for our people? Get a person in the position that is qualified and keep in

them in the position.

Chairman Moffett - Asking why is the Tribal Employment Rights Office (TERO) Director still vacant? You

do not have a response to that question.

Rebecca Miles — | do have a response. He did not ask that question.

Point of order called. Cannot talk about personnel issues on the General Council floor.

Chairman Moffett — It is taking it out of the realm of it being a personnel issue.

Rebecca Miles - | will respond when he is completed with addressing his concerns.

Rebecca Miles ~ | would like to make a statement before | reply to his question. Mr. Chairman, yesterday

you took a pretty hard stance that personnel issues will not be tolerated. My job requires me to ensure an

employee is being accountable for the job duties. | am not allowed to talk about personnel issues. My

managers have to hold their employees accountable. The secretary has the highest respect of Certified

Indian Blood (CIB). It really shows your intentions Mr. Chairman.

David Holt - The Crow Tribes has a 100% tribal membership employment. Upper mobility with in-house

employees. On-line banking: who is monitoring the staff that handles our money and who ensures that they

are not transferring funds to persona! bank accounts.

Judy Oatman — How can the Nez Perce Tribe adopt a policy on “whistle blower’ complaint? What about

workforce protection act?

Lisa Guzman - When you have issues, you should be addressing those issues as a tribal member and step

down as the chair and come on to floor to address those issues. You are suppose to be presiding the

meeting and | see it as a conflict of interest on your part.

Orders of the day called by Lisa Guzman. Motion has been defeated.

Nez Perce Language Class from Orofino youth gave a presentation on what they have learned.

Jamie Olson, Executive Officer, and Nez Perce Tribal Enterprises: We are currently in the conceptional

design phase of the expansion at Aht'way Plaza. Lilly Kauffman and Tony Johnson have been working on

the construction.

Laura Major - Going to ask about the casino up here in Kamiah. Last month did not have any drawings at

the end of the month. The prize amount went from $500 to $250. This is false advertisement and

misrepresentation on behalf of the Nez Perce Tribe. Why didn’t the commission approve our drawings until

the end of the month? How much money did we lose last month? Why is the tribe doing this to us people?

Jamie Olson- The gaming commission did not hold up the promotions for the Itse Ye Ye Casino. The

revenue has been flat for the Itse Ye Ye. The advertising went out before the promotion was approved. The

purpose of the promotion is to increase play at the Itse Ye Ye Casino.

Etta Axtell — Loss of profit, we have certain customers that turn the chairs so that customers can not play

the casino. A lady was harassing her and telling her that she was playing that machine. When she left that

woman turned the two chairs by her machine sideways so that nobody could play the machines by her.

Would like to be treated fairly.

Marissa Rickman — We do not have professionalism at our casino and this is the cause of loss of revenue.

One incident drove her husband to work and the kid that has the key to open up the Camas Express did not

show up until 2 to 3 hours later. We are losing out on business when this person shows up late to open up

the facility.

Jamie Olson - do appreciate the concerns and that we do deal with them.

Liz Arthur-Attao — certain groups that. Exxon gas cards can be used at any Exxon stations. When | get a

ticket from Coeur d'Alene that | have to get the gas station from their establishment. Make the suggestion

that we implement the same policy for our gas cards.

Nancy Wheeler — What is the part-time status.

Jamie Olson - Any employee who works over 24 hours a week.

Katherine Jackson - The shuttle service needs to hire more employees. When we ride the shuttle why do

we have to write down our player's club card number? Why don't we receive player's points when we play

bingo?

Motion by David Penney, seconded by Gwen Carter to direct the Enterprise Board and the Nez Perce

Tribal Executive Committee (NPTEC) to conduct a Nez Perce Tribal 50/50 raffle bi-annually basis, motion

carried.

David Penney - it is just another game.

Question

Leslie Randall - Are these actual numbers of patients? Be better to put a percentage and this is

misleading. Breakdown by ages.

Shelley Higheagle ~ that people can get a checklist to go by so that we get services. Why do we have a

pharmacist who

Tonia Garcia - My daughter who lives in Clarkston, Washington came out to the Lapwai facility for an

appointment and when she arrived she was informed that her appointment was cancelled. Why do NMPH

cancel appointments and the physician is there? This should be reflected in the report also.

Lisa Guzman — | will look into why the appointment was cancelled and why she was not called.

Nancy Wheeler - which the Kamiah clinic ts not going to be closed. Why should we have to wait for

medicine to be sent from Lapwai. Why does the Lapwai clinic have 4-5 people working in the pharmacy in

Lapwai?

Nancy Wheeler — We do have an educated pharmacist. Why, was she not considered for a part-time

position rather than being furloughed?

June Stewart - Why is the physician assistants getting the same pay as a physician when they are not

getting the correct diagnosis.

Maple Stuivenga -thank the NMPH staff for their treatment shown towards her at her visits to both the

Kamiah & Lapwai clinics.

Sara Sedgwick — Prescription drugs that are given fo people diagnosed with diabetes. Transport runners to

attend marathons and/or fun runs.

Lisa Guzman — June Stewart thank you for your concerns. NMPH will be putting out an advertisement for

medical providers. Cancer is a huge issue right now. The amount of money we spend on medication for

cancer. | am all for preventative for cancers. Sovereignty is not being violated or

Justine Miles - Wanted to commend the NMPH staff and for the devoted staff that shared the passion and

professionalism. Thank you Lisa for coming to work for your tribe, it is a tough job.
