bidder acceptance to the high bid, for the Haden Creek Fee

Property oral auction on November 15, 2008 and also be

system. This amendment No. 1 to the Project Summary

for I.H.S. Project PO-04-J93 proposes to change the

method of construction from open cut repair to curedin-place pipe rehabilitation, and purchase O&M tools

for Public Works. To approve and sign Amendment to

the Memorandum of Agreement (MOA) for Indian

Health Service Project PO-04-J93 on the Colville

Indian Reservation and authorize the Chairperson of the

Colville Business Council or authorized designee to

sign all pertinent documents.

To authorize the Tribal Energy Program to submit a

National Forest Service Woody Biomass Utilization

Grant Proposal for the FY 2009 funding cycle. The

Tribal Energy Program seeks funding, in the amount of

$225,000.00 from USDA Forest Service, to provide

assistance in assessing local U.S. National Forest

woody biomass resources that will support the possible

development of the Omak Woody Biomass Power

Project. The Chairman or designee is authorized to sign

all grant application documents.

To approve the attached Attorney Contract for

$30,000.00 with Bullivant, Houser, Bailey for

development of a legal strategy for clean up and

removal of waste on the Colville Indian Reservation

and to authorize the Chairman or designee to sign all

relevant documents. No new tribal dollars are required.

To accept and sign the attached Tribal Court Program

Agreement CTP03T10178 with the performance period

of October 1, 2007 through September 30, 2010. The

grant agreement is offered under authority of Title I of

the Self Determination and Education Assistance Act

(P.L. 93-638) as amended. Authorizing the Chairperson

or designee to sign Agreement Documents and all

documents pertaining to.

To support the request of the CCT Fish & Wildlife

Department and the Public Utility District No. 1 of

Douglas County for an executed copy of the final Wells

Aquatic Settlement Agreement. The settlement

agreement has been vetted through the Confederated

Colville Tribes technical and legal staff and is being

recommended to authorize the Chairman and/or her

designee to sign all and any related documents.

To approve the attached Change Order #1 in the

amount of $28,020.00 to the Pacific Hydraulic

Engineers sub-contract C08-165, new contract total of

$40,810.00 and authorize the Chairman and/or designee

to sign all and any related documents. Funded by BPA,

no Tribal dollars.

To amend Resolution 2008-689, Fish & Wildlife

Organizational Chart, to include the new changes as

the Former Sockwell house to Mr. Stanczak for the

payment of $200.00. Colville Confederated Tribes are

not responsible for any injury/harm to man or beast as a

To approve the exchange of lands of equal value with

William Condon, his property described as follows:

101-742-B: An undivided 24/264 interest in the East

half of the Southwest quarter, the Southeast quarter of

the Northwest quarter of the Southwest quarter and the

East half of the Southwest quarter of the Southwest

quarter of Sec. 1, T. 31 N., R. 28 E., W.M., Okanogan

County, Washington, containing 110.0 acres, more or

less (10.00 acres Equivalent) For Tribal Tract No. 101T5415: A 5.00 acre portion within the Northwest

of Coulee Dam, Washington, Section 31 Township 29

To approve an examination of potential sites in

coordination with Planning Department for a new Fish

& Wildlife Department Building to be located on the

main agency campus or adjacent to existing Fish &

Wildlife Department; to approve investigation of

funding sources (i.e. Tribal Credit) for design and

construction of such buildings (any loans obtained

would be paid back using federal dollars obtained

Tomeo Kamiakin family at the negotiated price of

$1,000.00 from Mr. Richard Scheuerman who

purchased the bag from a private collector. The bag will

be placed in the CCT Museum's permanent collection.

To approve the CCT to submit a joint repatriation claim

with the Yakama Nation for any and all human remains

and associated and unassociated funerary objects from

sites managed by Chelan County PUD and/or Bureau of

To approve the CCT to submit a joint intertribal

repatriation claim with the Nez Perce Tribe, the

held by the Peabody Museum at Harvard University.

This authorizes the Chairperson or designee to sign all

To approve the CCT History/Archaeology Program to

sell the Book of Legends under the copy right of the

CCT. This book was produced under contract with

Bonneville Power Administration for educational

purposes. The Book of Legends and illustrations are a

compilation of Indian legends of the Upper Columbia

River area as told and drawn by various Tribal

members. The book will be sold at the Colville Tribal

Museum and Gift Shop. Any costs associated with

printing and reproducing the copyrighted version of the

book will be covered under the Museum revenue

generated will go back into the same account. This

authorizes the Chairperson or designee to sign all

documents related to this matter.

To approve the delegation of Karen Condon, Colville

Business Council, to the National Indian Education

Association. This resolution supersedes previous ones

regarding NEIA and is effective immediately.

To approve the delegation of Karen Condon, Colville

Business Council, to the First Peoples Heritage Fund,

which was created under the direction of the Tribal

Leaders Congress on Education.

To approve the delegation of Karen Condon, Colville

To allow funding to hire emergency temporary

employees and all associated costs with the 2008

December Per Capita payment in regards to checks,

envelopes, postage and office supplies. The emergency

hire shall not exceed 30 days. Funding shall be funded

from the General Fund

To amend resolution 2008-785 to include the following

deadlines and approve the following department holds.

It is the recommendation of the Management & Budget

and Tribal Government Committee to approve the

$300.00 per capita from account PL7219709 to be

distributed on or before December 8, 208 to eligible

members of the Confederated Tribes of the Colville

Reservation. To be eligible, enrolled members must be

living as of midnight November 7, 2008; New

applicants must submit a complete enrollment packet to

the Enrollment Department by 4:00 p.m. on November

4, 2008; Adoptions approved by the Colville Business

Council by November 6, 2008 will be added to the

December 8, 2008 dividend roll. Relinquishment cases

approved by November 6, 2008 will not be eligible for

the 2008 December Per Capita Payment. Retro-active

payments will not be allowed for the 2008 December

Per Capita Payment. Court orders and departmental

hold list must be submitted by 4:00 p.m. on November
