Reservation opposes the calling for negotiatedrule making by regional offices for the

distribution of road maintenance funding; and

CCT feels that any negotiated-rule making

should be at the national level in the

government-to-government process; and CCT

supports the use of the current national

maintenance distribution formula which consists

of land base, population, and road miles which

has been in existence since 1997, utilizing the

TPA Process.

Okanogan Nation Alliance on fisheries issues related

to Enloe Dam and fisheries restoration in the

passage above Enloe Dam, and that CCT approve

Joint letter of Commitment regarding these issues, and

that the Chairperson or her designee be authorized to

sign the attached Joint Letter of Commitment.

The BPA has awarded funds in the amount of

$23,000.00 to each of the Columbia Basin Tribes for

the purpose of enhancing government-to-government

communication among the tribes and BPA: and, these

BPA funds are insufficient to accomplish much as

other tribes, could be used to significantly enhance

tribal sovereignty in regional issues; and, a proposal

for pooling of $100,000.00 of the BPA money from

the awards to the UCUT tribes; and, the BPA requires

a scope of work for the funding, the Colville Tribes

put forward the following (see attached); and, it is the

recommendation of the Natural Resource Committee

that we resolve that the $23,000 of the BPA award to

the CCT will be pooled with $23,000.00 from each of

the other UCUT member Tribes for a combined

UCUT budget of $115,000.00 to support central staff

for UCUT, and, we further recommend that the fiscal

agent to UCUT for these funds will be the Spokane

Tribe of Indians, following Spokane Tribes’ normal

accounting process. It is further recommended that the

Chairman or designee of the CBC be authorized to

sign all documents pertaining to this funding pool.

The Colville Tribal Gaming Commission is

authorized to promulgate rules and regulations in

furtherance of the purposes of Chapter 6-5 of the

Colville Tribal Code pursuant to CTC 6-5-54(b); and

the Colville Tribal Gaming Commission has

determined that Regulations 27.1 through 27.10 of the

Rules and Regulations of the Colville Tribal Gaming

Commission are in conflict with the requirements of

CTC 6-5-21 and CTC 6-5-54(b), which define and

establish the Colville Tribal Gaming Commission’s

Regulatory and Rule-making authority; and the

Colville Tribal Gaming Commission recommends that

the CBC eliminate the existing conflict in the Rules

and Regulations of the Colville Tribal Gaming

Commission by enacting the contents of Regulations

27.1 through 27.10 of the Colville Tribal Gaming

Commission into the criminal code of the Colville

Tribes; and the ORA has made several technical

changes to the proposed language. Now therefore be

it resolved, the Law & Justice Committee does hereby

recommend that the CBC enact the contents of

Regulation 27.1 and 27.10 of the Rules and

Regulations of the Colville Tribal Gaming

Commission into law as a new section of the criminal

code of the Colville Tribes; and be it further resolved,

that the Law & Justice Committee recommends that

the CBC enact these provisions on an emergency

basis as a new CTC section 3-1-300 through 3-1-390

to be titled “Gaming Offenses,” a copy of which is

attached to this Resolution as Exhibit “A”.

Recommendation of the Community Development

Committee is to rescind two resolutions that adopted

road mileages to be placed on the BIA System Roads

Inventory. The first resolution was 1997-297 for

822.75 miles and the second resolution was 1997-403

that listed Ferry County Roads of 157.50 (sequester)

for a new total of 980.3 miles. The current BIA

System Road Inventory mileage is 980.30.

Recommendation of the Community Development

Committee is to allow BIA Roads to improve the site

distance for vehicles turning into the Nespelem dump.

It would require excavating a small hill just north of

intersection of Nespelem School Loop Road and

Nespelem Dump Road. The excavated material will

be stockpiled at the dump for use and covering refuge.

Legal description of small hill is T.31 N., R. 30 E.,

W.M. Section 35 (Tribal-38A). Attached Cover Letter

and Photos attached.

Recommendation of the Community Development

Committee is to allow BIA Roads to use a portion of

the Mineral Hill Road to set-up a Borrow Site and this

material to be used in conjunction with the

construction of the Colville Agency to Town of

Nespelem Bicycle Path. The required material is

estimated at 10,000 cubic yards. This excavation of

Mineral Hill Road will open the road for two way

traffic and the disturbed areas will be reseeded when

project complete. The site is identified as T.31 N., R.

30 E., W.M., Section 25 (Tribal -7). Attached is a

cover letter and photos.

To authorize the transfer to and receipt by the

Hazardous Waste Account established under authority

of the Tribal Hazardous Substances Control Act

(HSCA), CTC 4-16-7, the sum of $235,000.00 from

CTEC (the transfer of $35,000 has already been

authorized by CTEC) to be administered by the

Environmental Trust Department to carry out the

purposes of the HSCA with respect to the Quality

Veneer and Lumber site within the Colville

Reservation and as provided in CTC 4-16-7(2), in

accordance with the following budget. Consultants -$172,000.00; Staff Travel --$5,000.00; Attorney

Services --$58,000.00; and to authorize and direct the

Accounting Dept. to establish a separate account and

line item, or other appropriate accounting method, so

that the Hazardous Waste Account may be

administered in accordance with CTC 4-16-7. Office

of Environmental Trust will perform testing and

analysis of the QVL landfill and waste water ponds

and report results to the CBC.

Confederated Tribes.

That any and all previous resolutions dealing with

complimentary hunting and fishing permits for

spouses of the Colville Tribal members who are from

other tribes be rescinded, and that the Tribes shall no

longer issue complimentary hunting and/or fishing

permits to members of other tribes who are married to

Colville Tribal members.
