GOVERNOR’S REPORT

Greetings to all Tribal members,

I

want to take this opportunity to give

a hearty welcome to the newly elected

Executive Committee members Isaac

Gibson, Kathy Deere, and Jeff Gibson to

their leadership positions for our Tribe.

I really appreciate the new ideas this

group has brought to our meetings sense

my main interest is moving the Tribe

forward economically and culturally

and providing more and better services

to you, the Tribal members. All three

are presenting some very good ideas in

these areas, and I look forward to a very

productive year for the Tribe.

During the May disaster the employees

of this Tribe really went above and beyond to assist our Tribal members in the

clean up and providing meals to those

in need of help. Their extraordinary

efforts were mirrored by several Tribal

members who volunteered countless

hours to the operation and made it all

possible. Thanks to you all.

At the present time, we are awaiting the

decision of officials in Washington D.C.

regarding the probate hearings involving the CPN’s. As soon as a decision is

heard, we will meet with everyone to

notify you of the decision.

There is an attempt to form a Committee

in the Johnson Community to get development of the area started. A feasibility

study would be required before

the commitment of Tribal dollars to any

area. If there is a need for a convenience

store in the area we will certainly be the

first to try and find a vendor, or develop

a Tribal store.

In closing, some of our relatives are

not feeling as well as they should. My

thoughts and prayers will be with them

every day at all times.

Lt. GOVERNOR’S REPORT

I

would like to thank everyone that

supported the new administration in the

recent election. As I have only been on

duty for a month, this report will be limited. We have had several meetings with

Donnie Smith, Fiduciary Trust Officer,

Southern Plains Region. When I came

on board I found out immediately that

the Master Decision Maker for Indian

Probates has made nine (9) recommendations to date, that Native American’s

owning less than 5% interest in AST

trust land that pass away without a will,

be ceded back to the Citizen Potawatomi. We are corresponding with the Office of Special Trustee, former Lieutenant Governor Little Axe and Governor

Blanchard made a trip to Washington,

D.C. to speak with Assistant Secretary

of Indian Affairs, Larry Echo Hawk

in trying to stop this. The Executive

Committee are all united in this effort.

There will be meetings held with information regarding what you can do as

individual tribal members to stop OUR

land from going to the Potawatomi.

Please watch the tribal newsletter for

meeting dates and information.

We are also working on putting together a current transportation improvement plan. Under the organizational

chart that was adopted when I took

office, I have over sight of the self

governance compacts (BIA and IHS).

If you have questions regarding these

programs or any other tribally related

issues, please let me know. I will try

to assist in anyway I can.

I am looking forward to the upcoming

two years. We have some challenges

on our hands and I plan to meet them

head on. Once again, thank you for

your support and I look forward to

working for you as Lieutenant Governor.

SECRETARY’S REPORT

H

ello Tribal members.

Well it’s been a slow couple of weeks

around here with the new officials getting to know their programs, coworkers

and settling in their offices of choice.

Hopefully we will get on track and

move onward. I look forward to work

with the new officials and hope we can

move this tribe into the next generation

of Economic Development.

I would like to update everyone on the

lowering of the Blood quantum. We the

EC passed the resolution on March 17,

2010 to lower the blood quantum to one

eight, and then I proceeded to calling

the BIA on what the next step would be

for the referendum election and finally

received a call back on July 1, 2010 on

how to proceed. I was to send a copy of

resolution and a letter of intent to the

Regional Director Mr. Deerinwater at

the Anadarko office and that he would

delegate it out to one of the Directors.

Well as of July 13, 2010 we are still

waiting on this to happen and for them

to get back in touch with my office. I

have left numerous voice messages to no

prevail. So as soon as I hear something I

will update you on the progress.

I am currently a volunteer in the AARP

program and would like to update the

members of our tribe about some of the

Legislative Priorities that have been

currently passed.

HB 2776 Effective November 1, 2010:

Lists information that is in the public’s

best interest to know when the caretaker

of a vulnerable adult has been charged

with causing death or near death, including circumstances of the investigation.

HB 2733 was vetoed by Governor and

the language was added in HB 1964,

which was approved, and it went into

effect on July 1, 2010. This language

makes it easier for relatives to petition

and acquire guardianship for minors

and establishes a judicial procedure for

custody by a relative after a parent has

abandoned the child.

SB 1289 Effective November 1, 2010:

August 2010

Amends current law to provide that any

person who has pled guilty or no contest

to, or received a deferred sentence, for a

variety of offenses cannot be hired as a

nurse aide by a long-term care facility or

home health/home care agency.

These are just a few of the Bills that

will go in effect this year and there is

many more to come for Senior Nutrition

Program Funding, Grand parenting and

Long-term Care. Will keep you updated.

There are a couple of other ideas that

the state has to raise revenue by $180

million and they include: expanding

the state’s vehicle insurance verification

program by using cameras mounted

on state highways to record and ticket

motorists driving without insurance;

develop a procedure to collect sales tax

on internet and catalog sales not currently being collected; a new 1 percent

fee insurance companies will pay on

health care claims, which is expected

to generate $78 million and should be

matched 3-1 with federal funds to be

used to stabilize the state’s Medicaid

program. So keep an eye out

TREASURER’S REPORT

Greetings Tribal Members,

F

irst of all, I want to thank you all

for your vote of confidence in electing

me as your Tribal Treasurer! Appreciate the calls, emails, and support you

have all shown me! NIAWA, Elders for

their delicious meal they prepared for

the “Swearing-In Ceremony”.

Secondly, I extend my congratulations

to the other newly elected officials,

Isaac Gibson, Jr., Lt. Governor and

Jeff Gibson, Representative. All of

us are committed to work together for

the development and enhancement of

our tribal programs and services for

Absentee Shawnee Tribal Members.

Our commitment is to work towards

making our Tribe known as a trendsetter

once again!

Thirdly, I’m giving you an update of

my first couple of weeks in the office

of Treasurer. I’m finishing up my last

few weeks at my current job, so I have

been part time here at the Tribal complex

and part time at my other job. Moved

into Governor’s Bldg on the east end;

we have had a special meeting on two

resolutions, (See Resolutions Passed); a

get acquainted meeting with the Finance

Department; Employees Committee’s

Recognition lunch; Pictures taken for

complex, newsletter, and website; All

Nations Bank; Shareholders’ Representative Quarterly with Li Si Nwi Health,

Inc and the Absentee Shawnee Tribal

Health Authority, Inc; Luncheon meeting with Attorney General Office Staff;

Office of Special Trustee concerning

probate court cases; and numerous informal meetings between staff and EC

members.

Lastly, Financial Audit for 2009 is

ready and if you want a copy, please

give me a call. As of December 31,

2009, net assets for the governmental

activities and business-type activities

increased $781,164. Tribe, as a whole,

improved its financial condition from

the prior year. The finance department

deserves a big “Thank You” from us all

in their commitment and diligent manner they have shown in making sure our

processes for tracking and transacting

purposes are kept up to date. Keep up

the excellent work! It takes all of us

working together to make sure we get

our documentation submitted to finance

in a timely manner to get things done!

The Indirect Cost Proposal for 2011 is

in final stages with a final review and

completion of an audited trial balance to

accompany the proposal. It is imperative the accounting / bookkeeping be

caught up and continues to stay caught

up so that audits go smoothly so that

Indirect Cost rates will stay up to date as

well. Audits affect the ability to submit

indirect cost proposals which affects

grants. The Indirect Cost proposal target

date is due June 30, 2010 and we should

be able to submit the completed proposal

by July 17, 2010.

This department, as always, would like

to extend a special thanks and note of

appreciation to the Executive Committee for providing the tools, resources

and support to enable the finance staff to

reach the accomplished goals and to continue with this effort. A special thanks

and note of appreciation to Program

Managers and Employees of the Tribe

for their assistance and dedication in our

group effort toward accomplishing our

goal. Now that we are caught up, we

are dedicated to continue our efforts in

this direction.

JUNE

Our 2009 Audit is complete which

includes the MD&A (Management

Discussion and Analysis) and has been

submitted to the Federal reporting offices. The MD&A report is an informative report within the 2009 Audit;

which is a brief review and explanation

of the Audit. Accounting continues to

stay caught up and Financials are being

completed Quarterly and being reported

to the Department of Interior – June 30,

2010 2nd Quarter 2010 reports will be

submitted as soon as the June books are

closed and by July 31, 2010 at the latest.

The Absentee Shawnee Tribe’s Finance

Department has a very hard working

group of people and it is an honor to

work with them and at the Absentee

Shawnee Tribe. We are all very excited

to welcome the Tribe’s new Treasurer,

Kathy Deere to the Executive Committee and we are very anxious to work

with Ms. Deere as we believe she

brings strong values and governmental

knowledge to the Tribe. The Finance

department welcomes the Tribe’s new

Lt. Governor Isaac Gibson and Representative Jeff Gibson as well. Welcome

and Programs. In working together, we

have found the most time effective and

cost effective processes for transacting business. Thanks to the Executive

Committee and all the programs for

to stay caught up.

I

hope everyone is inside and out of the hot weather. If you are working in the heat make sure you are drinking plenty of liquids. I want to thank everyone that supported me in this past Election. It has been nothing but

pure joy being able to work beside the other Executive Committee members and I know it’s too early to say,

but I’m very optimistic that we will move this Tribe in a different direction. So far, I have had some real good

meetings with the directors that are over the programs under me. I intend on meeting with everyone on campus,

because I believe that it just doesn’t take 1 or 5 people to make the tribe successful it takes all the employees!

Next month I will have more time to update you on all the events that are happening within the tribe. I would

like to thank the Employee Committee for welcoming in the newly elected Executive Committee Members with

a meet and greet luncheon, that was served at lunch time and the turnout for the event was very encouraging and

promising. So once again NE-YI-WA! For your support. I look forward to what the future brings to the Absentee Shawnee Tribe!

AST EMPLOYEE

T

he Employee Committee would like to say Thank you to those

employees that brought food to the employee picnic. Thank you to

the Executive committee for their donations for the picnic. Thank

you to the Diabetes department for taking over the responsibility

of the games we had at the picnic. Thank you to the Maintenance

and OEP departments for all their help. Thank you to Title 6 for all

that you did and for the donations. Thank you to Building Blocks

for your help. A special Thank you to Darrell Larney, Andy Warrior,

he annual employee picnic was a blast, many comments that

picnic. When we all come together as one, we can make good

any employees gathered by Shawnee Lake in good spirits

of enjoyment and gratitude. We gathered in a way of fellowshipping with one another with a dinner and games. The “Employee

Picnic” was put on in appreciation for the all the employees who

selflessly give to the Tribe. Absentee Shawnee Tribal programs

are challenged with opportunities for enhancing tribal members.

Many of the employees take on a great task of seeing goals are

achieved and what as a tribe can take on new accomplishments.

There is great deal of responsibility and tasks must be performed

in a timely manner. Sometimes each position may consist of

helping another co-worked to reach the department objectives.

These efforts are appreciated and would like to expressed in a

2010 Red Earth Run

O

n June 19th, the Healthy Heart program attended the

2010 Red Earth Festival Run. Healthy Heart individuals

participated in the Red Earth 2K walk and one Healthy Heart

individual participated in the 5K run. Over 20 individuals

participated in the event.

The Healthy Heart program attends various statewide walking

events to promote healthy lifestyle activities among program

participants. Research has shown it is possible to reduce

the risk of developing cardiovascular disease and diabetes

maintaining a healthy diet and physical activity. During these

events Healthy Heart participants enjoy a fun day of physical

activities and camaraderie with each other.

We are currently recruiting individuals for the Healthy Heart

Program. If you are interested in becoming a member and

would like information regarding the Healthy Heart Program,

determined in 2009 that Contract Health Services, excluding

vision benefits, will not be extended to those residing outside

of the catchment area.

Eligible Tribal Citizens must reside in side the defined catchment area for at least a period of thirty (30) consecutive

days prior to becoming eligible for Contract Health benefits.

The five (5) county catchment area includes Pottawatomie,

Oklahoma, Cleveland, Logan and Lincoln counties.

Tribal Historic Preservation Office

T

here are but a few American Indian figures who continue to garner the historical spotlight—nationally or internationally — as

often as Tecumseh. Historical descriptions of Tecumseh, whether they be by friend or foe, tend to describe him as a man of

exceptional character, energy and determination. While many of his Shawnee brethren, with the exclusion of several groups

of Shawnee in Ohio, were settled west of the Mississippi River, he and his brother, Tenskwatawa, the Prophet, along with their

cohorts from a number of tribes, headquartered their inter-tribal confederacy in a settlement known as Prophetstown in north

central Indiana. This confederacy was formed and led by Tecumseh to resist further American expansion on Indian lands.

During the War of 1812 Tecumseh’s confederacy allied with the British and helped British forces tip the scales in their favor in

battles waged against the Americans. Presently, plans are being made by a number of organizations to observe the upcoming

200th anniversary of the War of 1812 and events are also being planned to commemorate Tecumseh’s role during this period.

Myself, Michael Mann and Eastern Shawnee Rep, Robin Dushane had the opportunity to participate in the first of these

commemorative events thru the symposium, “The Gathering of the Storm: The Rise of the Tecumseh” in Vincennes, Indiana.

This initial symposium was held in Vincennes because before the breakout of the War, Tecumseh came to meet with Indiana

Territory Governor, William Henry Harrison at his residence in Vincennes on two occasions, once in 1810 and again in 1811.

Harrison called for these meetings because he was concerned about reports he was receiving of the increasing numbers of

Indians settling in Prophetstown and the effects of these numbers on Euro-American settlements.

Below is an excerpt of one of several American interpretations of Tecumseh’s speech spoken in Shawnee to Harrison in 1811:

“Brother: I wish you to listen to me well. As I think you do not clearly understand what I before said to you, I will

explain it again. Brother, since the peace war made, you have killed some of the Shawnees, Winnebagoes,

Delawares, and Miamis, and you have taken our land from us, and I do not see how we can remain at peace if

you continue to do so. You try to force the red people to do some injury. It is you that are pushing them on to do

mischief. You endeavor to make distinctions. You wish to prevent the Indians doing as we wish them—to unite,

and let them consider their lands as the common property of the whole; you take tribes aside and advise them

not to come into this measure; and until our design is accomplished we do not wish to accept of your invitation

to go and see the President. The reason I tell you this, you want, by your distinctions of Indian tribes in allotting

to each a particular tract of land, to make them to war with each other. You never see an Indian come and

endeavor to make the white people do so. You are continually driving the red people; when, at last, you will drive

them into the Great Lake, where they can’t either stand or walk.”

A Speech by Tecumseh (Source: Edward Eggleston and L. E. Seelye, Tecumseh and the Shawnee Prophet, Dodd, Mead and

Co., N.Y., 1878, pp. 182—86).

Following this 1811 visit to Vincennes, Tecumseh then journeyed south to encourage the southern tribes to join his movement.

After his departure, Harrison’s impression of Tecumseh is captured in this report:

“The implicit obedience and respect which the followers of Tecumseh pay to him, is really astonishing, and more

than any other circumstances bespeaks him one of those uncommon geniuses which spring up occasionally

to produce revolutions, and overturn the established order of things. If it were not for the vicinity of the United

States, he would perhaps, be the founder of an empire that would rival in glory Mexico or Peru. No difficulties

deter him. For four years he has been in constant motion. You see him today on the Wabash and in a short

time hear of him on the shores of Lake Erie or Michigan, or on the banks of the Mississippi; and wherever he

goes he makes an impression favorable to his purposes.”

Though Tecumseh’s life ended at the Battle of Thames in 1813 and with it his plans for an inter-tribal confederacy, his efforts are

remembered and his bloodline continues through a number of descendants among the Absentee Shawnee today.

News from the Elders Corner, July 2010

O

ur recent hot weather did not deter our Elders from

having their regular monthly meeting, Saturday, July 17,

2010 at the Resource Center in Little Axe. A quorum was

established with twenty-five (25) tribal members present and

thirteen (13) guests present. Elders Council officers were

present, that included Gene Parker, President; Mary Birdtail,

Vice-President, Kathy Deere, Treasurer and Cynthia Longhorn, Secretary. The meeting was called to order at 10:15

and the invocation given by Don Schulenberg, husband of

tribal member, Esteline Schulenberg. Celebrating birthdays

for the month of July were Esteline Schulenberg, Mary Birdtail and Ed Little. Announcements were heard that included

news of Gerry Roller having a recent procedure that will

require several months recuperation. Gerry and Lee Roller's

daughter is recovering from a recent health crisis, also. A

item brought before the Council by President Parker was

the subject of children at the meeting. It was pointed out

the past discussions had indicated that only Elders and their

legal spouses should be in attendance at these meetings.

Next, Dora Citty stated that she would be making and donating a dress for raffle that would be available in August.

Cynthia Longhorn explained to the Council that due to a

malfunction of the copy machine, page tow of the June 26,

2010 minutes was inadvertently left out and was not available for review on this date. A motion to table the Minutes

until next months meeting (August) was made by Serena

Daugherty and seconded by Emily Longman. The motion

carried. Treasurer Kathy Deere presented the financial

report of June 2010 with copies available for those in attendance. The AST balance was given to be $9,944.09 and the

Elders Council was listed as being $3,605.64. A motion to

accept the report as given was made by David Little, Jr. and

seconded by Serena Daugherty.

Special guest speaker was Mr. Donnie Smith, Fudiciary

Trust Officer of the Office of the Special Trustee of the

Southern Plains Region Office, Anadarko. He addressed

tribal members regarding the American Indian Probate Reform Act of 2004. Mr. Smith provided some very important

but little known facts about this Act and encouraged AST

members to request and attend Will preparation workshops

and learn how and why some arcels of AST land are being

allowed to be given to the Citizen Potawatomi Nation. Man

questions about different situations were heard and Mr.

Smith patiently answered all, as time would permit.

Kathy Deere informed those present of the previous month's

requested information about a vendor and price for embroidering the AST logo onto shawls for members of the

Elders Council and passed around a list for those who were

wanting to take advantage of this service. Ed Little asked

about the possibility of acquiring a PA system for use during

our Council meetings. Woody Wilson inquired of the facilities of the Expo Center in Shawnee, site of the November

Pow Wow. The next regular meeting is set for Saturday,

August 21, 2010 at the Title VI Building in Shawnee when a

Bingo and Cake walk will be held at the meeting. A motion

to adjourn was made by Sadie Low and seconded by Trudy

Pickering. The meeting adjourned at 11:30 a.m.

Following that, door prizes were awarded and a pot luck

dinner was shared by all and then the scheduled fund raiser

Cake/Pie auction was held as well as a 50/50 raffle.

amp Nikoti—Summer Youth Leadership Camp 2010,

The Outback…Exploring Excellence has come to an

end. 26 youth participated in activities to strengthen

their leadership and teamwork skills, physical endurance, and cultural identity. We had many guest speakers throughout camp. Our speakers brought important

information to the campers and were excellent mentors.

Everyday was filled with games, learning sessions, guest

speakers, crafts, or field trips. Thank you to everyone

who helped us with camp!

There have been several questions asked of the Indian Child Welfare

Department that we would like to answer to give a better understanding of Indian Child Welfare (ICW).

announce our

third month in

the new child

care center. It has been a fantastic and exciting experience

as we are settling in here. With a lot of new technology, learning

tools and a wonderful staff the children are learning so much

and having a lot of opportunities to “learn as they play”. The

children especially enjoy their large playgrounds and the indoor

play area. On Friday’s this summer the children are enjoying

water days outside. Each afternoon they also look forward to

wonderful activities in the indoor play area. This is a wonderful

addition to the Building Blocks center. As August progresses the

school age children will return to public school. Wow, Back to

School time is coming soon. Here at the center we will also be

continuing are new curriculum for the fall. The children will be

learning more new age appropriate developmental, cognitive,

social, emotional, and physical skills here at Building Blocks

Child Development Center. We are looking forward to a lot

of exciting times in our new center and we are very happy to

be a part of the AST complex family. Thanks to everyone for

your support during the past months as we have settled at the

new center.

WHAT IS ICWA?

The Indian Child Welfare Act (ICWA) is a federal law which sets

federal requirements that apply to state custody proceedings involving an Indian child who is a member of or eligible for membership in

a federally recognized tribe. It protects the best interest of Indian

children and promotes stability and security of Indian tribes and

families. ICWA establishes standards for removal of and placement

of Indian children in foster care or adoptive homes to prevent the

break up of Indian families.

WHEN DOES ICWA APPLY?

ICWA only applies to foster care placement, termination of parental

rights, pre-adoptive placement and adoptive placement of Indian

Children. ICWA does not apply to divorce proceedings, unless the

parental rights are to be terminated, custody proceedings between

parents and family including guardianships, or juvenile delinquency

proceedings. For example, ICWA may apply if an Indian child is

removed from his or her family by the state and placed in foster care.

WHAT CAN I DO IF MY CHILDREN ARE BEING ABUSED?

If there is reason to suspect abuse/neglect of any child, a report to

child protective services (CPS) should be made immediately. If the

child resides on trust land or on a Reservation then that particular

Tribe’s CPS should be contacted. Housing authority houses may

or may not be on Trust land. All other homes would be considered

to be on state land and the State’s Department of Human Services

CPS would need to be contacted and the referral would need to be

made through their agency. Tribal CPS CANNOT (solely) investigate

suspected abuse/neglect on state land.

WHEN DO I CONTACT INDIAN CHILD WELFARE?

The ICW department is here to assist with cases involving the abuse/

neglect/abandonment of an Indian child for that Tribe.

You may contact the Absentee Shawnee Tribe’s ICW Department

any time you may have a question. If the ICW department is unable to assist you directly, best efforts will be made to refer you to

someone who may be able to help.

The Absentee Shawnee Tribal Pharmacy (Shawnee Location) can fill prescriptions

for enrolled tribal citizens only.

The Absentee Shawnee Tribal Clinic Pharmacy in Little Axe can fill prescriptions for

tribal citizens written by Physicians not located a Tribal Clinic under the following

circumstances:

1. The prescription is for an Absentee Shawnee Tribal citizen who has

an

established chart at the Little Axe Clinic.

2. The prescription is on the formulary of approved medications and

stocked in

the pharmacy.
