Notice of Lodging of Consent Decree Pursuant to the Resource
Conservation and Recovery Act, the Clean Water Act, the Clean Air Act,
and the Emergency Planning and Community Right-To-Know Act
In accordance with Departmental policy, 28 CFR 50.7, notice is
hereby given that a proposed partial consent decree in United States
versus The Sherwin-Williams Company, Civil Action No. 93-C-4267, was
lodged with the United States District Court for the Northern District
of Illinois on February 6, 1997. This proposed consent decree would
resolve the United States' civil claims against The Sherwin-Williams
Company under Subchapter III of the Resource Conservation and Recovery
Act (``RCRA''), as amended, 42 U.S.C. 6921 et seq.; the Clean Water
Act, as amended, 33 U.S.c. 1251 et seq.; the Clean Air Act, as amended,
42 U.S.C. Secs. 7401 et seq.; Subchapter IX of RCRA, 42 U.S.C. 6991 et
seq.; and the Emergency Planning and Community Right to Know Act, 42
U.S.C. 11001 et seq. Under the terms of the proposed consent decree,
Sherwin-Williams will pay a civil penalty of $4.7 million, perform
supplemental environmental projects that will cost the company a total
of $1.1 million, undertake a corrective action to investigate and
remediate contamination to the soil and groundwater at and emanating
from the

company's Chicago facility, and perform other injunctive relief.
The Department of Justice will receive, for a period of thirty (30)
days from the date of this publication, comments relating to the
proposed consent decree. Comments should be addressed to the Assistant
Attorney General for the Environment and Natural Resources Division,
Department of Justice, Washington, D.C. 20530, and should refer to
United States versus The Sherwin-Williams Company, Civil Action No. 93-
C-4267, and the Department of Justice Reference No. 90-5-2-1-1829.
The proposed consent decree may be examined at the Office of the
United States Attorney, Northern District of Illinois, Everett McKinley
Dirksen Building, Room 1200, 219 South Dearborn Street, Chicago,
Illinois 60604; the Region 5 Office of the Environmental Protection
Agency, 77 West Jackson Boulevard, Chicago, Illinois 60604-3590; and at
the Consent Decree Library, 1120 G Street, N.W., 4th Floor, Washington,
D.C. 20005, 202-624-0892. A copy of the proposed consent decree may be
obtained in person or by mail from the Consent Decree Library, 1120 G
Street, N.W., 4th Floor, Washington, D.C. 20005. In requesting a copy,
please refer to the referenced case and enclose a check in the amount
of $32.25 (25 cents per page reproduction costs), payable to the
Consent Decree Library.
