Notice of Lodging of Consent Decree Pursuant to the Clean Water

Act

In accordance with Departmental Policy, 28 CFR Sec. 50.7, notice is

hereby given that a Consent Decree in United States v. USA Waste

Services, Inc., Civil No. 96-C-1613 (N.D. Ill.), was lodged with the

United States District Court for the Northern District of Illinois on

March 26, 1996.

The Consent Decree concerns alleged violations of section 301(a) of

the Clean Water Act, 33 U.S.C. 1311(a), resulting from the defendant's

discharge of fill material into wetlands without a permit from the U.S.

Army Corps of Engineers. USA Waste Services, Inc. unlawfully discharged

fill material into wetlands in connection with its operation and

expansion of the ARF Landfill in Lake County, Illinois, just north of

Chicago. Under the Consent Decree, the defendant would perform

restoration/mitigation and would pay a civil penalty.

The Department of Justice will receive written comments relating to

the proposed Consent Decree for a period of 30 days from the date of

publication of this notice. Comments should be addressed to Linda A.

South Dearborn St., 5th Floor, Chicago, Illinois 60604, and should

refer to United States v. USA Waste Services, Inc., Civil No. 96-C-1613

(N.D. Ill.).

The Consent Decree may be examined at the Clerk's Office, United

States District Court for the Northern District of Illinois, 219 South

Dearborn St., Chicago, Illinois 60604.
