Notice of Lodging of Consent Decree Pursuant to the Clean Air Act
Notice is hereby given that a proposed modification to the consent
decree in United States v. Princeton Enterprises, Inc., et al., Civil
Action No. 90-76-C, was lodged on December 5, 1996, with the United
States District Court for the Northern District of West Virginia. The
original consent decree in this action required Riffle Equipment
Company, Kenneth Riffle, and Myron Jackson to collect and bury certain
asbestos-containing materials at the former Adamston Flat Glass Plant
in Clarksburg, West Virginia. After the original consent decree was
lodged and entered by this court, the City of Clarksburg removed the
bulk of the asbestos-containing material from the Plant property.
Therefore, the proposed modification of the consent decree removes that
portion of the consent decree that required the defendants to bury the
asbestos-containing materials on the Plant property. All other
requirements of the consent decree would remain in effect.
The Department of Justice will receive, for a period of thirty (30)
days from the date of this publication, comments relating to the
proposed modification of the consent decree. Comments should be
addressed to the Assistant Attorney General for the Environment and
Natural Resources Division, Department of Justice, Washington, D.C.
20530, and should refer to United States v. Princeton Enterprises,
Inc., et al., DOJ Ref. #90-5-2-1-1462.
The proposed modification of the consent decree may be examined at
the office of the United States Attorney, 111 Main Street, Suite 200,
Wheeling, West Virginia; the Region III Office of the Environmental
Protection Agency, 841 Chestnut Building, Philadelphia, Pennsylvania
19107; and at the Consent Decree Library, 1120 G Street, N.W., 4th
Floor, Washington, D.C. 20005, (202) 624-0892. A copy of the proposed
consent decree may be obtained in person or by mail from the Consent
Decree Library, 1120 G Street, N.W., 4th Floor, Washington, D.C. 20005.
In requesting a copy please refer to the referenced case and enclose a
check in the amount of $1.05 (25 cents per page reproduction costs),
payable to the Consent Decree Library.
