Lodging of Consent Decree Pursuant to the Clean Air Act

In accordance with Departmental policy, 28 CFR 50.7, notice is

hereby given that a proposed consent decree in United States v. Salem

Harbour Associates, et al. Civil Action No. 92-0540 was lodged on

August 26, 1994, with the United States District Court for the Eastern

District of Pennsylvania. The consent decree settles an action brought

for violations of the National Emission Standard for Hazardous Air

Pollutants (``NESHAP'') promulgated for asbestos pursuant to Sections

112 and 114 of the Clean Air Act (the ``Act''), 42 U.S.C. 7412 and

7414. 41 CFR Part 61, Subpart M. The Amended Complaint alleges that the

defendants removed friable asbestos roofing materials without complying

with the asbestos NESHAP regulations, in violation of the Act. Pursuant

to the consent decree, defendants have agreed to pay a civil penalty of

$85,000.00 and to comply with the asbestos NESHAP, provide proper

training for inspectors, supervisors, and workers, and provide access

to EPA for inspections.

The Department of Justice will receive, for a period of thirty (30)

days from the date of this publication, comments relating to the

proposed consent decree. Comments should be addressed to the Assistant

Attorney General for the Environment and Natural Resources Division,

Department of Justice, Washington, DC 20530, and should refer to United

States v. Salem Harbour Associates, et al., DOJ # 90-5-2-1-1715.

The proposed consent decree may be examined at the office of the
