Notice of Lodging of Consent Decree Under the Comprehensive Environmental Response, Compensation, and Liability Act
Under 28 CFR 50.7, notice is hereby given that on February 24, 2006, a proposed Consent Decree in
United States
v.
Coffee County, et al.
, Civil Action Number 4:05-CV-5, was lodged with the United States District Court for the Eastern District of Tennessee.
In this action the United States sought, under Section 107 of the Comprehensive Environmental Response, Compensation, and Liability Act, 42 U.S.C. 9607, recovery of response costs incurred by the Air Force in response to releases of hazardous substances at the Coffee County Landfill located on the Arnold Air Force Base in Tennessee. The City of Manchester, City
of Tullahoma, and Coffee County Tennessee (the “Defendants”) are paying $225,000 collectively. This settlement is based on the Defendants' ability to pay.
The Department of Justice will receive, for a period of thirty (30) days from the date of this publication, comments relating to the proposed settlement agreement. Comments should be addressed to the Assistant Attorney General, Environment and Natural Resources Division, P.O. Box 7611, U.S. Department of Justice, Washington, DC 20044-7611, and should refer to
