## Text

(a) This subchapter prescribes the policies and procedures
 governing bidder qualification, bidding, award, and execution of a
 contract entered under Transportation Code, Chapter 223, Subchapters
 A-C.
(b) As an alternative to using Transportation Code,
 Chapter 223, Subchapters A-C, and therefore, this subchapter, the
 department, if the department satisfies the requirements of Transportation
 Code, §223.001(c), may award under the State Purchasing and General
 Services Act, Subtitle D, Title 10, Government Code, a contract for
 certain materials to be used in the construction or maintenance of
 a highway or for traffic control or safety devices to be used on a
 highway as a purchase of goods.
