Sec. 3. Subject to IC 22-12-2.1, the department shall adopt fire safety rules that prohibit the occupancy or use of Class 1 structures that do not comply with the department's rules governing the number, type, location, identification, repair, and maintenance of emergency exits, smoke detection devices, and other emergency communication devices.
