Issued pursuant to Sections 59A-2-8, 59A-12-21, 59A-14-3 and 59A-14-11 NMSA 1978 of the New Mexico Insurance Code and 13.1.2 et seq. and 13.19.2.17 NMAC. This Bulletin provides surplus lines brokers with a list of coverages that the Superintendent has determined are generally unavailable in the authorized market in New Mexico at the present time and are thus exportable. A diligent search among admitted insurers in New Mexico is not required for the placement of insurance coverages that are included in this export list.

We wish to remind surplus lines brokers that the placement of coverages not on the export list requires that brokers perform a diligent search for placement among admitted insurers that the broker has reason to believe might consider writing the type of coverage involved. Receiving declinations from admitted insurers that do not write the line of coverage being sought does not constitute a diligent search. Brokers who violate these rules will be subject to enforcement action.
